Created the Conflagration. Another Explosion Yesterday Morn- ing—An Itemized; List of the Insurance—Woodward Dead, It 1s estimated that there were five thousand people at the dlatlllery fire yes. terday morning, and many of them hung out about the place until long after day- light. They gathered from all parts of the olty, therefore the event was the subject for much conversatlon yesterday. 0. N. Woodward, the poor fellow who got burned, dled about 6 o'clock Isst evening, He suffered greatly all day. The most plausible theory of the orlgin of tho fire {s that given by the man Woodward, who was injared. Ho eays that when he went luto the alcohol room with the lamp, he smelled gas, and apprehending danger, thought he would turn back. He finally concluded not to do 8o, however, and went farther In when saddenly the gas exploslon occurred, which caused the fire. It s thought by Chtef Butler that this s the best theory, presuming that the gas was Ignited by the lamp. A eensational story is golog the rounds to the effect that the origln of the firo wos Incendiary. It was stated that Mr. Iler had recelved a letter from an anonymous source, In which the writer conveyed tho hint that unless a certaln foreman who had been discharged was restored to his place the dlstillery would be fire. When a reporter for the Bee ques- tioned Mr. Iler about thisyesterday he re plied that he had recelved an anonymous letter, but not about a foreman that had baen discharged. What tho writer did say was that a certatn foreman would have to be discharged, that he was re- ceiving outside commisslons, etc. No threats, open or covert, were made that the distillery would be buorat, ANOTHER EXPLOSION., At11.45 yesterday moruing Foreman Hoban and Eogloeer Cammins went Into thealcohol room for the purpose of examin- Ing the water meter. One of the men it a match and read the meter, and the engineer thinking there was no danger lit a candle. An explosion followed. Foreman Hoban and Eagineer Cummins were blown out of the bullding, through a window. Hoban wes not greatly in- jured, but the engineer sustained a se- vere scalp wound on the back of hls head. The exploslon undoubtedly re- sulted from alcohol gav. For Trade.—Nance county lands for stock of general merchandlse or hard- ware. Address John Linderholm, Cen- tral Clty, Neb. DANGER AHEAD. Property owners to bo Held Liable for Injuries Resulting From Defective Bidewalks, . A number of notices sligned by Mayor Boyd were placed In the hands of Sherlff Miller yesterday morning, to bs gerved on owrers of property opposite which acci- dents have occurred from defective slde- walks, A number of sults have recently been commenced against theclty,amount- ing to $40,000 damages, alleged to have been sustalned by reason of personal in- jurles reselved {n coneequence of defeot- ive slde walke. The ownership of prop- erty opposlte which theee accldents have occurred has been carefully looked into by the city attorney, and it is now proposed by the clty authorities to hold the property owner liable for any judgments which may be recovered sgainst the clty. On this account these notices have been signed by the mayor and placed In the hands of the sheriff for sexylce. The notice In each case informs the property owner of the pendency of the sult, the name of the plalutifi claiming damages, the amount claimed and farther notifies the property owner to appear and defend such sult and that for sny judg- ment which may be recovered, the city will hold him liable. A reporter of the Bg, for the purpose of sacertalning the legal polnt involved in this actlon, called yesterday on the city attorney, and in response to an inquiry as to the effect of serving the notlces re- ferred to, was informed that as a matter of law, a property owner after recelving such a notice could not questlon the amount of judgment which might be ob- tained agalnst the city (and which he was oalled upon to pay)snd that the only question which could be ralsed would be !&nt of whether the clty could throw the liabllity upon tim, As to the liabillty of property owners to make good to the city ita loss in con- sequence of defective sldewalks, Mr. Connell stated that smong the best lawyers there was some controversy; that while some courts, those of Illinols in particular, hold that no euch liability ex- ists, other courts of equa'ly high standlog have by recent and abl decislons held that this lisbility does exist. “This question,” ssid Mr, Conuell, “will unduubtedly be ralsed by some of these property owners who have been called Into court to-day to make them- selves defendants in these damage sults, The issue will undoubtedly be hotly con- tested, and the outcome will be of the greatest lmportance to THE DAILY BEE--THURSDAY, JULY 30, 1885 the city. 1t is astonlshing 10 note how utterly reckless and negli- gent many cltizens ars with reference to their sidewalks oppoelte thelr own prem- fses. Many who would not think of allowing a bullding to remain uninsared for a slogle night, permit their sidewalks to remaln for weeks and months in a dan- gerous and dilapidated econditlon, rot knowing at what time a llabllity of £10.000 may incur to them as the result of such negligence and indifference.” e —— The Right Man Caught, The public may rememboer the case of the telegraph operator, Willlam Patton, who was arrested here last winter by the pollce, on the eupposition that he was J. O. Pusey, the defaulting clork of the Leavenworth penetentlary. He was afterwards released, as It was proven conclusively that he was not the right man, He threatened to sue the clty for a heavy amount, but for some reason falled to do so. The followingapeclal from Leavenworth tells of the arrest of the real offender, Pusey, In Pltteburg, on Sunday: A detective of Pittsburg arrived here to-day with J. G, Pusey, defaulting clerk of the Kansas pevitentiary, Pusey forged vouchers, embezzled about $5,000, and fled from here the 27th of last November, A large reward was offered. He said to.day that he went from here to Topeka, thence to Kansas City and St. Louis, where he took a boat for New Orleans, and went to work on the exposition grounds, He had spent all his money on women and wine, and _had £1.75 when he reached New Orleans. There, under disguis ho frequently met Kansas renple, and once on the street passed Fred Glick, son of Gov, Glick, and Detective Daakburst, of Tufiek who had gone, there to loo] for _ him, From New Orleans he went to Memphis, where he worked awhile, and last April went to Oincinnati, where he has been ever since, doing odd jobs for a liv- ing: He is a fine machinist, and was a mem- ber of the brotherhood of locomotive engi- neers. He had arranged to go to England, where he had lruud position a8 a machinist offered him, and was trying to earn money enough in Cincionati to pay his way there, Pusey attributes his downfull to love of whisky and an alliance with a notorious woman of ill-repute here, upon whom he lav- ished a great deal of money.
