City Attorney Comnell's Tnvestigations on the Sabject, Some of the Evils of the Old Plans of Laying Out Additions—The— New Ordinance, Some time ago the oclty counocil passed the following resolution with regard to addltlons to the clty: Resolved —*‘That the city attorney be and Is hereby Instructed to ascertaln whether, any person or persons are ling lots In violation of the recent or- dinance requiring acceptance of all addi- tlons of land not within or adjoining and contiguous to the city limits, and if it shall appear that the sald ordinance ls belng violated, that he shall forthwith proceed against all such partles under the provisions of the ordinance, providing penalties for 1t violation, it is the in- tontlon of this coancil that the provis- fons of thls ordinance shall be main- talned and obecrved legally.” Mr. Obnnell, since that time, has been pursuing a line of Investigation, some reference to which will doubtless prove engaging to those Interested in the growth of the oity, In the first placs the ordinance referred to, which was passed some two months ago, provided, in the main, that: ‘‘Every owner of any tract of land within corporate limits of the clty of Omaha, or adjolnlng and con- tinguous to same, before offerlng for salo this land shall canse it to be acour- ately surveyed, and shall cauee to be made a plat of the addltlon, with refer- ence to known or permanent monu- ments, which shall designato explioltly the lands laid out, and shall particularly desoribe the lots, blooks, atreets, avenues, alleys, etc., belonging to the addition.” Further, the streets, avenues or al oys, In such addition shall be Ilald out with reference to the atreets, alleys and ave- nues of the contlguous clty limits and shall be continuations of these thorough- fares. Furthermore, the residents in any sush additlon shall be entitled to all the r'ghts and privileges enjoyed by residents of the clty, and shall be subject to the ame city government. Mr. Connell, in conversation with a re- porter yesterday, eaid that he had been pursulng this matter closely, and so far as he could dlscover, there were no lots belng sold in any addltion to the city which had not been surveyed and platted in the way prescribed by the ordinance. 1f any such vlolations are discovered the gullty parties will bo prosecuted, he sald, to the fulleat oxtent of the law. “‘Bat,” he continued, ‘‘there s one thing that ought to be noted. Ia many additlons now laid ount the streets and alleys are not Iald ont so as to correspond to tho adjoining ones of the city property and the resul’ {s a hopeless labyrinth of thoroughfares. In many Instances not the slightest attempt was mado to maln- tain the continuity of the streete, I can show you places on the msp of this city and {ts additions where the streets are so lald out that a person has to walk three blocks to vislt his nelghbor a stons’s throw away and where echool children in the samo additlon are compelled to go six or elght blocks In a round about way to attend a echool which is but two or three blocks away. “There 18 no doubt in my mind but that 1f the clty had compelled, from the beginuning, the property owners to lay out thess'additlons with reference to the straets adjoining, within the olty limits, that the property would have been worth $600,000 more than it is to-day. Of course, there {s nothing t> do now but to inslst upon a stelct enforcement of the ordinance as recently passed, but it is in- deed a pity that the original charter pro- vislon which gave the city council the right to ineist upon the additions being lald out in the proper manner, was not enforoed,” However, thls provislon was not en- forced and remalned a dead letter. Untll this ordinance was passed two months ago property owners could plat out their additions to sult themselves, and If not accepted could put their plat on record and go ahead gelling thelr lots, 1t Is Interesting to note that there are over one hundred additions to the city proper.
