Stevens, general agent Chleago, Rock Island & Paclfic, Councll Bluffs, JUDGING BETWEEN JUDGES, Aylesworih Fails to Get Onto the Dis- trict Bench, The judiclal contest has at last roached a declslon, Judge Locfbourow being al- lowed to remain on the dlstrlct bench, and his majorlty over Judge Aylesworth being fixed at fourteen, The judges in rendering the decislon denounced the tampering with the ballot boxes, shown by the evidence, but still held that enough votes could be shown up by the evidence to make Judge Loofbourow’s msjority as stated, which Is about seven less than the officlal canvass. Judge Aylesworth proposes to appeal to the su- preme court, but whether such an appeal will be entertalned or aot Is a question. The matter of costs remalns to be fixed also, and the court will meet next Friday in Des Molnes to adjust this, it belng supposed that Judge Aylesworth will be called on to pay this bill, which is sald to reach to nearly $800, although others declare it cannot justly be half this amount, This declsion spolls the chances of the mayor appoint- ing Alderman Mynster to the superior court, as Judge Aylesworth will now continue to occupy that position. The disapointment to the mayor and his little circle of admirers will be greater than to Judge Aylesworth, as the positlon he now holds is In some respects better than the one he was struggling for, He is well situated, but the hungry mouths which were open for his eoup in case he should get the dlstrlct bowl, will have o look elsewhere for something to fill them., —— PERSONAL.
