Republican saye: John Reed Shannon died at his residence north of New Winchester, last Saturday evening and was burled on the following Sunday. Mr. Shan- non was & noble soldier during the war, and whilo in the service of his country contracted a diseaso which was in all probability the cause of his death, He was an upright man, a good neighbor, and respected and honored by all who knew him, WARMER AND WARMER Grows the Fight Over the Smith Stock—The Latest Phase of Litigation, The fight over the Smith stock of dry goods still continues. Tuesday afternoon Lewls Cole, who holds under the sale made by Smith, brought in the distrlct court his action In replevin to secure from Sheriff Miller the stock of goods, The replevin papers woro Issued late in the afternoon and placed in the hands of Coroner Drexel, that official bolng able to conduct such proceedings agalnst the sheriffi. The papers were served by Coroner Drexel In the afternoon, and he took eesion of the stock, Ho appointed Messrs, George Ames snd D, J. Donahoe as appralsers to make a re-valuation of the stock. All persons were then excluded from the store by Coroner Drexel except the watchman, the appraisers and their clerk. The work of appralsement was then conducted with locked doors. A rumor became current toward evening that the appraisement gave to the stock a valuation of §565,000. Immediately mensures were actlvely taken to throw suspiclon upon the actlon of the apprals- ers, because the amount of valuation was not up to that found by the attachment appralsers, Coroner Drexel was not sat- Isfied with the appralsement as made, and rejected 1t, as well as the bond ten- dered him by Mr. Cole. He then appointed new appraisers. Meanwhile the plalntiff In the replevin proceedings has removed the case Into the Unlted States court. New papers In replevin have been secured. Peabody va the clty of Omah ult for $10,000 damages on ac- connt of street grading at the corner of Fourteenth and Jones streets, done In 1873, The case s slmilar In Its nsture to & large number of others which make the rulings of the court of general Im. portance, and being also the pioneer case it Is very clossly contested, About the moat Important question involved fs whether benefits to property by reason of grading streets can be offset in an actlon to recover damages as against the cost of changing the property so as to make It conform to the street grades. This rfl:eltlon Is one oconcerning which there has been a widely dlveraified dlffer- ence of oplnlon. It orlginally arose at the time of the appralsement of damages by reason of the change of grade on Far- nam street. The clty attorney Connell, waa called on then to glve his opinlon In the matter and ho held that the benefits to properly should be taken into account, and consldered s an offset to the damages. That s the question the at- torneys In this partlcular case, who are Kennedy & Gllbert and W. R. Redick, for plaintiff, against W. J, Connell, the city attorney, for defendant, have been arguing for the partday, and was declded by Judge Wakeley. He held that it was proper to conslder spectal benefits re- sulting from the grading of a strect as againat the cost, and he instructed the jury that they might conslder such bene- fits, as If, for Instance, renderlng prop- erty desirable for business purposes, which prlor to the grading would have no value for such purpose. COURT MATTERS. Olegg Acquitted on the Grounds of| Insanity—Legal Jottings. In the distrlct court yesterdsy morning thefoase of the state va. George Meyers charged with robbery was called fortrial. Meyers Is the man who was accused of attempting to rob the Iowa farmer detec- tive, Bays, of a watch and chaln and re- volver. Bays came here about three weeks ago to hunt up a gay Lotharlo who had seduced his daughter. CLEGG ACQUITTED. The Olegg case reached its terminus Tuesdsy evening and resulted In accused belng acquitted on the grounds of insan- ity. About fifteen minutes after 5 o’clock District Attorney Estelle finished the closlng srgument, and Judge Neville dellvered his charge to the jury. That body retired, and was out about half or three-quarters of an hour, when they re- turned with a verdlet of acqult- tal for defendant on the grounds that he had been proven to be insane. Taylor vs, Edholm & Erickson In favor of plain- #iff. It seems that abont two years ago one Davld Hill purchased at Edholm & Erlckson's a gold watch, making = present of 1t to Mra, Taylor. He agreed to pay for It by monthly installments, and gave a mortgage which was never filed. He falled to make the paymenta a8 agreed, and Edholm & Erlckson se- cured the watch from Mrs, Taylor, she suing to recover possession of 1t. A good opening for & merchant tailor. A Mother Attempts to Steal Away Her Children, But is Check-mated by Her Husband, A short time since Mrs. Homan filed a petitlon for a divorce from her husband, Henry Homan, Slnce that time Mrs. Homan has been llving apart from her husband and Mr, Homan has had charge of the chlidren, They have beer kept by a lady llving on Howard ntreet, be |y tween Twelfth and Thirteenth streets. Tuesday evenlng Mrs, Homan visited house where her children are kept and atttempted to obtaln possession of them. She got both children In her charge when the lady who was keeping them gave the alarm and Henry Homan and hls father rushed over to the house. The elder Homan obtalned possestion of the young er child and Henry Homan seized hold of cne arm of the elder child, while the mother held on to the other arm. What Gen, Howard has to Say---bairs| in the West, The Omaha Troops In Kansas—De- partment Marksmanship, Gen. Howard returned yosterdsy from hls tour of observation among the western posts, He ls looking hale and hearty, He was recelved at the head- quarters by the officers of his staff, with considerable warmth, and held a sort of informal reception during the day, dis cussing military matters with the varlons officlals of the headquarters, A reporter for the Ber who dropped In upon Gen. Howard yesterday, ob- talned from him a few Interestlng facts with regard to matters In the western portion of the department. He proceeded first to North Platte, where he Inspected the Ninth cavalry, under Gen. Hatch, and eaw a parade of the colored troops. Shortly after that Gen, Hatch left for Ogallala. Ge Howard then visited some of the wes- vern posts of the department—Forts Brldger, Douglas, Laramie and Sldney, ae well as Cheyenne. At Fort Russell several of the Shos- hone and Bannock Indlans came down to the post, while he was there, and pro- tested violently thelr Intentions of peace and friendship for the white man. In- deed Gen, Howard thinks there Isno further trouble to be apprehended from the Indlans In that quarter of the de- partment, and that the redskins In fact throughout the department are in a set. tled and easy conditlon. *‘In Utah, and especlally In Salt Lake,” sald Gen. Howlrd, In answer to a ques- tlon of the reporter, *‘I found things in a very unsettled state. The Mormons are still excited over the unjust way In which they fancy they are belng treated by the government, and the Gentlles are equally excited over the recent insults offered to the American flag by the Mormons. There is a strong undercur- rent of feellng which Is bound to cause some trouble before long. The Mor- mons are terribly jealous of any fancied encroachment on their rights, while the loyal American cltizens are equally de- termined In thelr way. In fact Governor Murray would be powerless to maintaln his authorlty were it not for the assis— tance of the troops.” THE INDIAN TROUBLES, Gen, Breck has received no further news from the seat of trouble or from the department of the Platte troops which are now sta- tloned at_Crossfield under command of Colonel Morrow. The soldlers are not having a very pleasant tlme of it in that unsavory part of Kansas, and complain bitterly of mablility to procure wood and water, The foolish excltement at Ogallala h entlrely dled out, and the few settlers who were 8o rash as to seek the protec- tion of the town while under the Influ- ence of a panicky feellng, have returned to their homes.
