Cases in the District Oourt—General Legal Matters, The case of Wylie D. Clegg 1s atill on trial before Judge Neville. Yesterday the defensa continued the Introduc- tlon of testlmony to show the Insanity of the prisoner. Before Judge Wakeley the caze of Peabody vs. the City of Omaha was taken up yesterday. The oase, an old one of a year and a half standing, s one ir which the plain- tiff demands damages for grading near his property on Fourteenth and Jones, In the county court yesterday John and Julis Flannigan commenced sult sgainst he Continental Insurance company for $500 on a policy on which It is claimed a dofault has been nttemiud. The dam. age- to property for which the payment of insurance s asked, It is alleged, were caused by one of the severe storms which place In the early part of April. Kay, to compel payment of a note of $60, alleged to have been signed by these gentlemen, Judge McCulloch has rendered a declsion In favor of de- fendants. The declslon was based on the ground that the note itself showed forth no consideration, and as no evidence was Introduced to show such conslderation, its validity could not be sustalned in oourt, The caze of Ellza J. D. Peabody va, the clty of Omaha was put on trial yes terday before Judge Wakeley. Another “Smothered Sensation” and How it Resulted—Two Hack- men in Trouble, All day, yesterday, thelalr was foll of strange ramors about & hack driver who was eaid to have been killed in the morn- Ing near the Fort by two fellow Jehus The tales were as conflictlng and fncon. slstent as they wero many, and the most thorough investigation falled for a time to elther prove or disprove the truth of them, The true story raps thue: Yesterdsy morning a telephone mes was sage roceived at McShane's livery stable from Maj Croft of rosdhouse fame saying that Geo, Spalding, a hsck driver who worked fer the stable, was introuble, having been engaged in & quarrel in the viclulty of the road house A man was lmmedia ely seut out, with ofticers Bloom and Harigan, Arriving there they fonnd & wice ceordlitlon of affalr ¢Windy Bob,” Puollan and Baby Barnes had besn out al tho road house on the rimpage. They had brcome incenred at the hack driver Spalding because they belicved he hed run Into them about two o'clock in the mornls |:?; the falr groundl.'v'hfl: th o oarriage a party of fast wx;'nn. 1t seems that they immediately followed Spalding to the road house and assaulted him unexpeotedly. He stood up for awhile and severely pummeled Pollan, but when *‘Baby” Barnes’ ele- phantine oaroass hove in sight and he started to ralse his Brobdignaglan fist, Spalding murmured gently, *'I'll see you Iater, love” and slid out. Thwarted In their plans of securlng revenge by pum- meling Spalding, Pollan and Barnes tarned thelr attention to hls hack, and smashed the windows, and broke things up generally, afterwards turning the horses loose. The Inmates of the hack, two young men and two young women, were very much (frightened, but held thelr peace. The two men then turned thelr attention to the road house, and are said to have been engsged for some time In the delightful pastime of throwing all the farnitare out doors. They were soon taken in tow by the po- llce and landed in the olty bastlle. In the meantime the story had leaked out that Spalding, the hack drlver, was missing and nowhere to be found. When the two_ prisoners, there- fore, were arralgned Justloe Anderson frowned upon them as possible murder- ers, and bound them over In the sum of 82,000 to awalt the development of fur- ther evidence. They were remanded to jall and locked by Joe Miller In one of the cellars of ‘‘Murderer’s Row.” Everybody was awalting the findlng of Spalding’s body with breathless intreest, s the only thing necessary to prove that a foul crime had been committed. But all these horrible antlcipations were knocked in the head when Spalding came llmping Into town and explained that he had been hiding for safety. His story Is about as the one related above, except that he claims that was not the cause of Pollan’s mlsfortune. THE OMAHA TROOPS. Arrival of the Soldiers at Orossfield— Morrow to Assume Command. Gen, Breck, adjutant general of the department, has recelved two interesting telegrams from Oapt. Powell, who left here In command of the three companies ordered on Tuesday last to the scene of the Cheyenne difficulty, The first one was recelved Saturday night, and was dated at Wellington, {Kansas, It reads: “Arrlved here in less than 30 hours from time order was recelved at post. Are in excellent spirits; have not had a drunken man on the trip, Extra hard bread with us, Many thanks of com- mand to chief quartermaster for admira- ble arrangements for transportation;about ten miles to camp, POWELL. The next was dated at Crowsfield, Kan- sas, (near Harper) and 1s of not o joyful a tenor as the preceeding one. It will be seen that a soldler’s life in “‘glorious Kansas” s not one of unalloyed ease and comfort. “‘Arrlved here last night about twelve o'clock, There is not a stick of wood to be had here. It must be hauled by wagons or gent on the oars from Harper, nineteen miles distant. No water near the place except at a spring two miles dls- tant, which Is private property. We have to buy water at 25 cents a barrel for hauling to us. It will be hard work to supply twelve or ffteen companles here. We have difficulty in supplying three companies. No tralns beyond Attlca unless extra. PoweLL.” Farther than this, nothing has been heard from the Omoha troops or, in fact, from the scene of the Indian troubles. Col. Morrow, of Fort Sidney, has been ordered to take command of the three companies. Itis understood that the Ninth cavalry has made all preparations to head off the Indians in case they at- tempt to strike the northern trail which leads through Nebraska. This is the usual method of procedure of the Indlans when they get Into trouble, but they will be beautifally headed off in case they at- tempt anything of the kind this time. Gen, Howard, who has been out west for the past several days Inspecting the outlying posts, started Zfrcm Salt Lake this morning and will be in Omaha about ‘Wednesday. o em— POLICE COURT. The Usual Monday Morning Array of Calprits. Judge Stenberg was well oconpied with buslness yesterday morning, as he Is every Monday, and the docket cates were dis- posed of in rapld succession. A. Bloom tried to arrest him where- upon the negro turned upon him and showed fight, He was finally subdued after liberal doses of the club and was taken brulsed and bleeding to the jall, A, Oampbell, likewise drunk and dls- orderly, pald a fine of §5 and costs. C. A. Murray held for a similar charge, was released. Ed Olark, who was charged last week with runnlog off with the wife of a man nomed William Waters, was brought to trial upon the charge and released. Waters, the husband, was arraigned on a charge of beating hls wife, and was held for farther evidence, Thlis case, 1t may be remembered, grew out of the de- sertion of Waters by - his wife, and her aotion In taking a three-year-old child, of whioh Waters sought to retain possession, Sadle MoBride, the only snd notorious, once agaln faced the jodgment bar, to answer toa charge of alsorderly conduct. Well, as peaceably as they appeared then, just =0 peaceably you will find them anywhere on the pralrie, if the white man will let them alone. The easlest thing on creation to do In order to clvilize the Indlan, who s no heathen —1s to get him sway from contact with the white man of his wigwam, the Indian sgent and the sutler—disarm him—pun- {sh him— by the white man’s laws, if he {5 found to have promised protection to the cattlemen’s herds, in exchange for arms, ammunition and whisky glven by the latter, The unscrupulous white man of the pralrie keeps the army continually in un- necessary commotion at the expense of the tax payers of the entire country—and only for his own primary benefit—that of etarting up the Indians.
