THE DAILY BEE---ThURSDAY, APRIL 30. 1885, A MAGNIFICENT STRUCTURE. Te New Court Homse of Donglas Comnty. A Few Timely Remarks Thereon— General Description. Yeaterday the offices of thecounty judge and the county superintendent of schools were moved from the old quarters In Crelghton block to the new court house. The district court rooms will be shortly changed end the work of transfer of quarters feom the old to the new will be completed. Arrangements are already under contemplation for the dadlcation of the new structare, which Is to be pronounced one of the most magnificent county bulldi; in the west. It Is very probable, County Clerk Leavitt observed to a reporter yesterday, that a grand dedleation ball will be given on the occaslon of the formal opening, to show the tax payera of Omaha and Douglas county, what a beau- tiful treasure they possess In the new bullding which {8 hereafter to sfford the conter of county officlal and judlel tivity, A representative of the Brr madea tour of Inspection yesterday with one of tho gentleman connected with the erec- tlon of the structure, and & brief sketch of the new court house may not In this connectlon be uninteresting. THE BUILDING ITSELF is of the masslve classlcal style, 120x137 feet In size, there boing eight stories, In- cluding the basement floor and the five storles of the tower or dome. The ballding is constructed entirely of Berea, 0., randstone, Snlvnnized iron, and cast iron, the foundation being of limestone and theslllsof granite. The bullding Is thoroughly fire-proot, and in polnt of nafety from fire no structura ever erected can surpass it. The maln entrances are on the northand east, and are heavily recessed, flanzed by four heavy columns, with capltals, which support a colonade with a large balcony. ENTERING THE BUILDING The first floor is found to be divided into four sections or quarters by two cor- ridors which run transversely north and south, east and west, Intersecting each other in the centre. In the northwest sectlon of the firat floor are the recorder's office and the county clerk’s private and business offices, together with a massive fire-proof vault. In the southwest quar- ter Is the county court room, together with three smaller ones—county judge’s, sherif’s and jury rooms. There is also a large vault sixteen by nineteen feet. In the northeast section are the treasurer’s private and business offices together with the dlistrict attorney’s office, and a fire- proof vault. In the southeast section are the offices of the county superintend- ent of schools, private and business, and the office of the county commissioners. There are four entrances to the first floor, with vestibules, the entrance on the north slde baving three double doors, the others being single, LEAVING THE FIRST FLOOR by the heavy iron staircase, in the north- west section of the second floor, is the aw library room, separated by a small corridor from the grand jury, witness, and ladies’ waiting rooms, In the sonth west qua.ter s the judge's chamber, to- gother with the room and vault of the clerk of the court, In the northeast sec- tion 18 the largeat room In the bullding, the district court room 45x75 feet, Into which open, in the southeast section, the attorney’s consultation room and the judge's private office. All these offices are fornlshed with large, acious closets as necesilty indicates. On the west slde of the second floor is the_stalr- case leading to the third floor., In this story all the rooms will be left unfinlshed, but on the ssme general plan as the rooms on the flest and second stories, A central shaft, tochnically called a well- hole, runs from the intersectlon of the first floor corridors clear through to the very top of the dume. Leaving the third story by a winding Iron stair case, one ascends to the first floor of the tower or dome. In the tower there are four storles. The first floor connects with abeautifal surrounding bal- cony or balusirads, From this balusirade one commands a magnificent view of the surrounding country, vast expanse of field, woodland and water forming an un- broken vista as far as the eye can sweep, the whole belng a picture of unique and never to be fcrgotten magnificence. As cending from the first floor to the tower, one comes to tho small second story of the dome. Thls also connects by twelve doora, or more properly door windows, with & small balustrade, which supports slxteen massive iron colamus of the Oor- rlothian pattern, topped by elaborate friezo and architrave. From this balus- trade a very good view of tho surrounding country is also to be had. The next or third story of the tower 1s still smaller, beiog surrounded by twelve round ventl- lating windows and decorated cn the outside by sixteen elaborately formed iron consols, placed at regular intervals, which give a massive, though very ornaf appearauce to the base of the dome. THE NEXT AND LAST STORY of the tower Is very small, On each of the four sides of this story are placed the glaas dials, five feet In diameter, of the monster clock which s to be placad, at some future dsy, on the fourth floor. These disls will be illuminated In the evening, and will herald, dsy and night, for many miles, In each directlon, the “haaty flight of Time.” The bell of the dome Is an irregular quadrilateral, sup- ported and ribbed by massive iron bsams and covered with zino, The dome it- self, taken as a whole, Is the most mag- nificent feature of the structure, elaborately ornamented by a cornloes, consoles, and pediments. STANDING ON A PEDESTAL on the topmost extremity of the dome is » splendid figuro of Justlos, with the symbolic scales, & beantiful and magnifi- cont climax to this magnifizent palace of law. The lighting of the Interior is effected by large windows placed at regular In- tervals, surmounted by cornice and pedi- ments of ornate figure. The roof s of tin. Onthe four sldes of the roof, In the center of each side stands a large gable, with frieze cornlce and pediment, while Grecian urns of beautiful deslgn are placed along the edge of the roof. The cornice effects of the roof are plain but handsome. All the galvanized iron work cf the exterior of the bullding has been painted and sanded, giving the ex- act appearauce of stone and marble, THE BUILDING 15 HEATED by stesm, and ventilated according to the latest and most perfected plaus, All riitions, of roof, sides and celllng, have ruudwxouahly concreted, making the structure absolutely fire-proof, The cost of the struclure has been $250,000, of which one half, or $125,- 000 has already been pald in cash out of the genoral fund of Douglas county. How They are Folled—Quinine for Morphine, Placed in & Hack and Driven Across to Towa—The Law in the Oase, Yestorday morning another exolting chapter was added to the now ocelebrated habess corpus case of ‘‘MoFarland,- Morgan-Moore.” Immediately after MoFarland had been released In Judge McCullooh’s court Tues- day from the writ of habeas corpus, on the ground that Farrell had not proven that there had been a copy of the complsint and Indictment against the accused, filsd with the governor of Ne- braska when the requisitlon was ob- tained, another complaint charging Mo- Farland with belng a fugitive from jus- tice was filed In the pollde court, 'This morning the deposition of the testimony waa completed, the arguments of counsel finished, and Judge Stenberg rendered a decislon releasing the prieoner, hclding that he did not care to reverse the judgment of County Judge McCulloch. Meanwhile Attorney Green had filed a complaint charging McFarland with vagrancy, but Judge Stenberg would not entertaln the trial, holding that the action had been taken simply to galn time. The moment that McFarland was dis- charged by the court, he was gobbled up by the ever alert Sheriff Farrall, who was watching for his prey. The ex-con- viet was hustled into a hack and before the astonished spectatora or attorneys could recover from the shock of surprise, the sheriff, with Deputy Ed. Crowell, of this city, and the prisoner, were rattling down Farnam ut great speed. They proceeded rapldly Iowa- wards, though by just what route cannot at this writing be determined. The frlends of McFarland were very much as- tonished by this sudden move on the part of the Mills county officials, and at firat tried to run down the swiftly moving hack, bat, of course, eoon gave up the at- tempt. McFarland is doubtless well on his way to the Madison ponitentiary. THE LAW OF THE CASE. In the first stages of the case, Detno- tive Neligh had advised Sheriff Farrell to seize his man on the first opportunity presented, without reference to the action that might be taken by any local tribunals. This advice was given In accordance with the well-known California dectelon in the Robb case, which establishes the principle that a sherlff who has been delegated by the governor of one state to serve the extra- ditlon papers lssued by {he governor of another, becomes virtually a United States officer, and as such can seize his prisoner according to federal usages. This vlew of the case was also sus- talned by Judge Dundy, of the United States court, Thls declsion is reprinted in full, 1, Fugitives from justice arrested and re- turned under laws of the United States, The governor of a state, in issuing a war- rant for the arrest of a fugitive from justice, the officer who makes the arrest, and the party commissioned to recoive the fugitive aud deliver him to the authorities of the state in which the offense is chargad to have been committed, in pursuance of the provisions of sections 5278 and 5279 of the revised Statuf act under the authority of the lawa of the United Statet, and RO HAC VICE are officers or ugents of the United States, 2, Writ of Habeas Corpus—Jurisdiction. ‘Where a petition for a writ of HABEAS cOR® PUS presented to a state judge or court by a party in the custody of one claiming, in good “Glve me 20 centa’ worth of mor- phine. If I sell het all she asks for she would undoubtedly swallow it all and succeed in her suicidal purpose. So instead of glving her the twenty-five cents worth, I sold her only a ten cent package, which, should she take it all, will prove entirely harmless. She will be put into a deep sleep and waking up will forget all about her suicidal inten- tlons.” *Do you have many such cases?” “Yes, dozens of them. Hardly a week passes but some person, male or female, comes in and asks me for the drug in the same way. Of course, I can tell in a moment what they are up to and govern my sale accordingly. If they ask for twenty-five or ‘filty cents worth of the poison In that pecullarly agitated ~ style of the intending sulclde, I always look out and give them about one-third of the amount they ask for. Otherwise I should have an uncomfortably large number of cases of self destruction piling up on my hands. I can, occasionally, vary this method of harmless deception. For example, a young woman came into my store the other night and asked me for a large dose of morphine. I could tell by her looks that she meant evil, and accordingly measured out a harmless amount of sulphate of quinine and gave it to the woman, who rushed off, and swallowed it, in sweet snticipation, I sup- pose of an immediate leap into faturity. She was put Into a deep slumber and woke up forgetting her woes and mourn- ful intentlons. Both of these thoroughfares were ordered to be paved right away bat 30 daya’ time was given the property-holders t) aecertain and designate the kind of materlal desirod to be used for such paviog. e —— Burned to Death, The little son of Mr. and Mrs, H. C, Mason, No, 20 Williams street, burled at 2 o'clock Taesday, was burned to death on Monday. The particulars of the horrible affair are, that about 8 o'clock Monday morning Mrs, Mason went to her alster's house close by to get a palr of shoes belonging to her child, left there sdnday. The little fellow, only one year and three months old was permitted to remain in the house alone; while his mother was gone, Child like, he oommenced playlng with the fire, from which his clothing csught, and when she returned bis body from the linbs up was buroed to s blister. In that condition the little sufferer lingered until b o’clock p. m. authorities of another state, as a fugitive from justice, in pursuance of tho provisions of sections, shows upon its face that the tioner is 80 held in custody under such claim made, in good faith, the state judge or court has n jurisdiction to ismue the writ. The jurisdiction in such case is exclusively 1n the courts of the United State 3, Same—Duty of Custodian. _ Where a writ of HABEAS COGPUS has been issued by a state judge or court, and been served on the party having the custody of such alleged fugitive, itis the duty of such custodian to make full return to the writ as to the authority under which he holds the pris- oner, and to exhibit to the court the original apers evidencing his authority, and respect- ully decline to produce the body of the pris- oner; and if it appeara from said return, or petition and return, that the prisoner is claimed to be held in good faith, in pursuance of the provisiona of said statute, the judge or court issuing the writ has no jurisdiction_or authority to proceed further, and no jurisdic: tion or authority to compel the prodiction of the body of the prisoner, or to commit the party holding him for contempt in fhus re- spoctfully declining to produce the prisoner. 4, Samo—Effect of Production of Prisoner, The effect of the production of the pris oner would bo to place him in the physical control of the court, and to deprive the agent of all power to execute the superior commands of the laws of the United States, to which he owes obedience, The defense on the other hand, claims that this Robb case 1s not parallel to that of McFarland. Furthermore, they clalm that as McFarland hed been ro- leaged both In the county court and the police court, because the proper steps had not been taken to procure the extraditlon warrant, he was a free man, acd wasnot amenable to cap- ture except through the dus course of legal procers. In other words, the defendant’s attor- neys claim that Farrell’s action ls a gross and indlctable offense of kidnapping. The case is destined to be long remem- bered 1in local circles as one presenting many Interesting features. It is proba. ble that this is the last phase of it, and that McFarland, allas Moore, slias Mor- pan, 1sdoomed once again to the dreary walls of the Fort Madison peniten tiary.
