Hull, the eloquent Inspirational speaker, will lecture in Spiritual hall this eveningat 7:30 o’clock. Subject, “‘Modern Spirltualism,” Miss Hull has drawn large audiences in Omaha during the last month, The wheraabouts of Mer, Nicolls’ shoes does aot yot appear, but it is learned that when he left home he put on no socks, but simply slipped on a pair of low shoes, which In his wandaerlngs he doubtless lost in the mud, this accounting for the fact of his belng barefooted when found. The funeral of James Nicolls will be held thle afternoon at 3 o’clock, at the family residence, No. 130 Broadway, The funeral will be under the auepices of the Odd Fellows, of which order he was & member, The Fourth warders do not take kindly to the fact that, with all the complaints made and the promisas glven, no repre- sentative of that ward has been placed on the council committes on Internal im, provements, streets and alleys, The committee, as heratofore, ls made up of aldermen f1om the east part of the clty. Yesterday afterncon Tom Brown bad some difficulty with J, W, Catlin and an other fellow, the trouble arlsing from Brown calling Catlin “a scab” because the latter has gone to work at the Wabash round house. Brown was first arrested and then he filed information agaiost the two others for aesaulting him, snd they were placed under arrest. Yesterday afternoon Dave Harton ar. rested at the transfer two men whom be suspeoted of having been concerned in the recent burglary at Misequri Valley. Will attend to patients and sll who are afflicted will do well ‘to glve him & eall, Consultation free, THE DAILY BEE-~COUNCIL BLUFFS THURSDAY MARCH 19, 1885 THE OUTLOGK. Conncil Blams Has a Brighter Fature Than Ever, Half a Million Dollars of New Build- ings In Sight, Couneil Bluffs never has had so bright a fatare as now lles at its very feet, There are already ia sight building im- provements which will, when completed, reach fully $500,000. The government bullding has got an appropriation of $260,000, the new ocourt house and jall have been voted for to cost $180,000, the Eplscopal church and the Catholic church will be now carrled on to completion, and scores of lesser building Improve- ments are belng commenced, which caonot bat make the amount swell Into the hundreds of thousands of dollars, and there are several very im- portant enterprises on foot which will add thousands of dollars to the Industries of the clty. The time is not far distant when the wagon bridge connecting Oouncil Bluffa and Omaha will be bullt, Council Bluffs will be greatly benefited by this. Oma ha is getting crowded, and worklngmen requiring homes, ani business men re- quiriog room for warehouses, yards and shops would gladly fill up the botiom Jands, now lying unoccupled, if these lands can bo made easy of access, and communication between the cities can be made closer. Aside from the buildlng Improvements and great promise of the advancement of commercial interests thers are other features rich with promise, The chlef is that the citizens them- selves are getting enthusiastic and full of confidence In the cily. One of the great faults of Council Bluffs has been that its own citizens were continually giving their own town a black eye. Almost any stranger coming to the eity to investigate with a view of settling here or embarking in business, would be told the most dole- ful stories by Council Bluffs people them. selves as to the prospects of \he city. They have been constantly running down the town, and sp-aking ill of it. This sort of talk has done great harm to this city, bat now there ssems an ‘ond of this. The people now seem confident themselves, and to confident that they are willing to invest their own means In enterprises. Tbis general expression of confidence on the part of Council Bloffs' own people cannot but inspire confidence in others. Real oetate men say that already the prices which have been very low, are be- gloning to stiffen somewhat, and there is l‘l’x‘:fl promise of greater activity in that . Another encoursging feature Is that the city’s fivancial affalrs, under the handling of ths new councll, will be based on a more economical policy, so that the tondency will be to mske the burden of taxation lighter Iinatead of heavier. A little retrenchment can be better made this year than other years of a character which will be met by spectal assessment on the property divect- ly benefitted.} Pearl and Bancroft streets are to be paved, and several residence streots will also be paved. Other work will be done also andin fact wha'everjaew is taken of the coming year there eeems nothing but brightners and hope. The city promises to be cleaned up and regulated more closely—morally also. In fact Council Bluffs this year will make a glorlous record for itself every way, and will come 8s near to having a regular a8 it Is healthy for any city, Too much of & boom is liable to result In too great reactlon, but growth sura and solld, is just what Is coming. e — Masonic, Harmony Chapter O, E, S., will meet In regular session this (Thursdsy) even- ing at Masonic hall, at 7:30 o'clock. By order cf the W. M. Carrre HUNTINGTGN, Sec'y. —— Real Estate Transters. The following i3 a list of real estate transfers filed yesterday in the recorder’s office of Pottawattomie county, Iowa, as farnished by A, J. Stephenson, abstrac- tor, real estate and loan agent, Council Bluffs, Iowa, March 18, 1885: R. 8. Harlow to Mary Schmidt, part n} nw} 16, 77, 39, 830, Susan F. The decislon of the supreme court as published in yesterday’s Bex has caused the query to arise on all tides; *What's going to be done about 1t7” No one seems to know, The saloon men are on the anxlous bench, for under {hls de-. olslon it seems that almost any clt'zen can get out aninjunction and clore any saloon in thecity, and still fthe city is urging them on all the time to pay their llconse under the ‘‘pop” ordinsuce. By Inquiry sming the ealoon men yesterday Tae Bee learns that the sentiment prevails quite unanimously among them that the only thiog to do is to go right on as usual, and awalt developments. Some say that there are many good citizens who deem it inexpedient to attempt to close the sa- loons here, with Omaba zeady to catch the, trade, and draw the peopls over there, get them dronk, take their money, and send them back t> the Bluffs sgain; also that to close the saloons will deprive the city of a large smount of revenue, make taxes higher, drive travel away from here, make it a “Sunday” town, aod nct prevent people drinking after all, It s conceded by them, however, that it is no use to fight, and thst if an in- junc'ion is got ageios’ aby of them or all of them, that the oaly thing to do is to close up and get out of town, but many are of the oplvion that the sentiment of the people here will not support any such measures of exterminstion, . Talking with some cf the lesdlng pro hibitionists Tax Brg learns that they be- ligve that & fow men can be found bold enovgh to swear to the necessary in- formations, and thas secare the needed Injanctions, and that thare Is no doubt “‘the saloons must go.' i Both eides seem to be simply wait- fog, but if any break fs made it will probably be within a fow days. It is gemerally conceded by all that the decirion wiil result In the prompt wiping out of saloons in many parts of the in- terlor of the state, but the river towns are greatly in doubt, their loeation belng such as to make it Imposeible to keep rosidents from esslly gotting strong drink from just across the statlon lino, e s The artesian well at the instittulon for the deaf and dumb will soon be conneoted with the bulldings, so as to give a full supply of water for all purposes. The fire-escapes recently put in place ars pro- nounced by experts to be all that is needed for the protection of the people of the Institution. THHE SOHOOL BOARD. The (Committees Appointed for the Coming Year, The new board of education met yes terday afternoon and the organization was compteted by the appcintment by Presldent Atkins of the following stand- ing committees: Teachers, text books and course of study—Macrae and Cooper. Finance—Couch and Bryant. Fuel and warming school houses—Bry- ant and Bell, Butldings .and grounds—QCooper and Couch. Janitors and sapplles—Bell and Ma. orae. The number inattendance from “the initial polnt” increases daily. A day passed at ‘‘the great railroad center” has satisfied your correspondent that this case is the one tople of paramount Inter- eat at the metropolls of Western Iowa. Counsel engaged in the trial of this caute and those Immediately interested have taken permanent quarters here and will patiently await the verdict of the jury. Not o with the camp followers on ecither side. These birds of patsage, come and go at will, One day they are here in force, the next their places will bs vacated. One of the most notloeable features of this great trial {s intenre Interest manifested by the IJadies. Woman {s natarally & partizn, and 1t is safe to say that not one of them has changed her mind, either by force of fact or argument. The McKune forces occupy the north slde of the court room, and there hes beenno desertions thus far, Mrs. Keller always slts at the right hand of Mra. Cross, and Mrs. Crcsy never fails to be at her hushand’s side. Her devo- tion to her husband attracts universal at- tention and admiration. 8he has shown herself a wifo any man might well be proud of, and regardless of what the ver- dict of the jury may be, eshe ha won the respect of sll disinterested spec- tators. The McKune forces far out- number that of Cross, but it can not be clalmed that they are superior either in soclal standing or intelligence, The ad- mittedly high social position of all the parties has attracted wide attention to all the detsils of the tragedy. i Mr. Jobn N, Baldwin began the argu- ment for the defense at 9:45 this morn- ing. The exordium was ehort, fbut of a character well calculated to command the respect and attentlon of the jury. He has a pleasant volce, a commanding fig- ure and winning address. His arts are those of the orator rather than ‘those of the logician. He has however, a trick of coloring adverse facts In a manner well alculated to decelve the very alert. As he proceeds it is often difficult to separate the facts from the conclusious of the speaker. His first eofforts were darected agalest the polnts of law by the state. His defini- tion of the l]aw of malice was In direct conflict to that given by Mr. Pusey. He then entered upon an exhaustless exam- ination cf all the details of the evidence. He compared, explained, reconciled with consumate skill. His argument was con- cluded at 11:40. JUDGE BUBBARD followed in the further presentation for the call for the defense. He continued to revisw the evidence, dwelling at length npon the threats alleged to have been made by the accused. He clearly reviewed all the circumsatances of the kill- ing. He claimed the plea cf self- derenze to be abundantly sustained by the evidence. He pictured the final stru ggle—McKune stealing up behind Cross, dealing the terrible blow upon the back of his head, Cros staggering from the effects, partislly falllng, Then fol- lowed the.second blow fullin the face, the bones of the nose broken, Cross blinded, dezed and .partlally insenrible. Then his aesailant grappled "Cross by the throat—he could not; breathe, his senses were leaving him, It was the supreme moment of his life. The struggle was one of life and death. Both cf ]Vchnna'n hands were claspiog his throat. He man- aged to draw his revolver from his p ck- et. McKune saw his danger, looiened his hold upon his victim’s throat and at- tempted to wrest the revolver from him. Ho turned it toward’s Cross. By asuperhuman effort he sncceeded in turn- ing the revolvertoward’s McKune's body. his own loft hand clasped over the muz- zle of the revolver—pulled the trigger and McKune fell to the ground desd. By the clrcums:ances immedistely sur- rounding this tragedy It must bs deter- mined whether Crots, actingas & reason- able man, bad sufficlent cause to sppre- hend thet McKune intended to kill him or inflict great bodily ivjury. if he had, then this is able homiclde and Cross will be acquitted, The fact that there was cr was not ill-feeling and bad- blood between these men would not jostify the assault by McKune, Cross acted in this matter as any reasonable msn would have done under Jike circum- stonces’ At three o'clock this afternoon COL, W. F. SAPP entered upon the closing the State. He brlefly add upon questions of law, and then circamstantlal history of the e courts, His argument to the jury was airect:d to the purpose of refuting the pronositions claimed by defendsnt's at- torneys to have been established by the evidence, At this wrlting Col. Sapp’s argument Is uncompleted. The charga of the cour: has been carefully prepared and will be read at the conclusion of this ar- gument, The cass will doubtless be finally mitted to night.
