The latter finally agreed to step outside the house, and have it out, On going out, knowing that Jeffoirs had *‘a billy and a gun” he dld not give him time to ute them but jumped onto him, bore him to the weound, and they had quite a tussle, Grimmelman getting his face badly marked and bloody, and Jeffelrs getting still worse. Both were very bloody and when separated Jeffeirs pulled out his revolver, and hefore any bystander realized what he was going to do he fired the ball striking Wheeler, who stood near by. Wheeler fell to the ground, and was taken into the house, while messengers were sent for surgeons Dr. Lacy, of thls city, and Dr. Nusem, of Crescent, were soon in attendance, and found that the ball had strack Wheeler In the left side just above the groin and had gone downward, They probed in vain for it and could not find it. Whether the ball lodged in the mus- cles or inside the abdomen remainsa wyatery. [f the latter it is thought that there is little chance for him to live. Explanation of Some of Oharges Made Againat the Police, the The charges made by the Council Bluffs Herald concerning rome of the po lice force, and especlally concerning Cap- tain Hathawsy and Officer Cusick, seem to have fallen to the ground. Thelr ex- planation of the affair, as corroboratad by witnesses to the transaction, Is in sub- stance as follows: Last Saturday evening a party, consisting of several persons, came Into John Nicholson’s saloon and called for drinks. Mr. Nicholson, in his endeavors to keep up the reputation of his house for orderliness and decency, has Instructed his bartender not to sell to any drunkenfman One of the crowd was pretty full, but as he was leaning agalnst the bar his condition was not notised. After settiog up the beer a dis- pute arose as to payment, and Mr, Nicholson, who was busy in the rear room tetting up lunches, came out and directed his battender to le' d the drunken man out, As the birtender attempted to do #o vhe fellow fell to the floor, being too drunk to stand. In falling his head struck, dezing him for a few seconds, but after sitting in a chair a few moments he rellled enough to start out, but as he staggered out he commenced vomiting, and a8 he went out the door Capt, Hath- away, who was passing, was a target, the captain’s overcoat receiving a decidedly unpleasant spiash. Officer Cuslck, who had been standing guard at the coasting place, was just oo his return, and ar- rested the drunken man and took him to the station. Capt. Hathaway went into Mr. Nicholron's and got his clothing sponged off. Such seems the de- talls of the aflair, out of which such & sensation has been worked. Captain Hathaway has been given the credit of strengthening rather than weak- ening the discipline of the force, and as one of the ex-officers wss in the crowd drinking at the place, it is supposed that he was the one responeible for the sena- sational charges, There seems to be enough to bring agalnst the police or at least members of ths force, without get ting into the realm of fiction or need- lessly stretching the truth, and thoss ac- cused are at least entitled to their expla- nation and to a hearing.
