One of these rulos, in describing the an- ties of the captain of police, says: *‘He (the captain) shall keep a book, to be known as a receipt book, Fn which shall be taken a receipt for every article, whether money or other property, taken feom prisoners, that it may be roturned to them or deposited with the clerk.” ‘With this order of the mayor as back- ing the prisoners sre belng brought to police headquarters and searched there, thelr effects retained, and the prisoners then taken to the jail. The city marshal, for some reason which does notappear, claimscontrol over the effects, The fact is that the city council in 1884, three months before the mayor went into office, and long beforo tho po- lice rule was written, passed an ordi- nance providing, not that the city mar- shal, nor the police should take charge of such effects, but that the olty. jailer shall be the cnstodian. The ordinance provides that the jaller shall be appolnted by the marshal with the advice and approval of the councll, and says: “Itshall be the duty of the city jaller to keep Ja book provided by the city councll, in which he shall regis- ter the name of the officer making an arrest, the charge preferred, the name, age, occupation, natlvity, and residence every person committed to his care, together with a correct inventory of all monles, dangerous weapons, or valua- bles of any kind whatever, which may be the property of any such person, or firm in hfl possession, The clty jailer shall place all such monles,'dangerous weapons or valuables in the safe In the jail until disposed of by the proper authoritiee and shall deltver up the same only on the written order of the city clerk, said order to be endorsed by the person authorized therein to recelve any such property men- tioned in this section.” The ordinance thus making the jailer who is now Bates, the cus- tordian of all such valuables, does not provide that he should give any bonds at all, a rather strange sort of pro- ecdure. It remains to be seen whether the mayor’s order or the clty ordinance will prevail. Either the mayor or the city council must back the track. Both or- ders cannot be carrled out very well. It is said that the no- tico of the contest was sent from Des Moines to Atlantic, Judge Loufbourow’s home, but he was not there. A messen- ger was accordingly dispatched to this city, where he was holding court. The messenger arrlviog at night, sought rest in sleep, and did not serve the notice until the next day. 1t was then dlscov- ered that It was too late, the day of ser- vice haviug just passed. Had the notice been served the night the meesenger ar- rived it would have been in time, but as it was 1t came just too late, It is claim- ed that this tardiness has knocked the bottom out of the whole case. Jack Reynolds refused to testify either for or against Bedford in the case tried.
