[ o——————— s ———————— e ——————————————-— HALLS OF JUSTICE. Various Matters ia the Legal Dispen- saries, he Laud Perjurers Held to Bail, District Court Doings, Yesterday was the day after Christmas. Everybody was feeling lively and braced up by the holiday pleasures. Businees was brlsk everywhere over the eity, and fairly 80 in the corridora of the courts of justice. The Valentine land perjurers, John Bell, Emlle Johnson and Lawrenos Lar- son, were brought before Judge Dandy yeaterday morning, bat not arraigned. Their bail was fixed at $1.500 each, $1,- 000 for conapiracy and €500 for perjury. It was wo arcanged that each went bail for the other, as he financial standing of all throe is sufficiently good to warra nt such a procoeding. It is stipulated, how- ever, that each one is to appear every day, in order to satisfy the aathorit fes that all ‘is well, Judge Dundy has not yet passed sen- tonce in the Lovejoy case. Tho delay has been made to allow the counsel for Lovejoy's bondsmen to appesr and file a bill of exceptions, or tu take other ateps to secure a stay of proceedings. The period allowed for such proceedings ox- pired last night, and it is probable that, woh being the case, Judge Dundy will ‘o judgement to-day. District Attorney Lambartson cama up from Lincoln yostorday and went down again last night. J. R. McDonald, clerk of Franklin county, is now in the city. Mr. McDon- ald is & very clever Jooking gentleman, bat is now under indictment for conspir- acy to defraud the government, by sell- ing liquor without a license, He will probably be arralgned to-day. DISTRICT COURT, The case of Whitehorn vs Cranz et al was still on trial before Judge Wakeley yesterday. George Brutto, convioted of larceny at the recent term of court was sentenced to four years ay hard labor in the state enitentiary yosterday by Judge Neville. rutto will be remembered as the Paxton porter, who stole the trunk of a traveling mon at the Paxton last March. The argument for a new trial in the case of David Dodson, the embezzling salesman of MoCord, Bradey & Co., who was recently convicted by jury trial, will bs made to-day by Dodson’s counsel, Mesors. Lake & O'Brlen. The billof ex ceptions alleges the usual failuve of the jury to reportin accordance with testi- mony, error on the part of the judge in charging the jury, and general minor errora throughout the trial Among other and unimportant papers filed yesterdsy in the district court, was a petition from Toura Irving asking for alimony from her husband, Edward J. Irving. It ap- pears that this couple were married in October, 1882, in Council Bluffs, since which time the couplo have been living in Omaha up to August, 1884, when Mrs, Trving filed application for a divorce from her husband. She charges him with drankenness, cruelty and fatlure to support. ., SWEET REVENGE. ¥ Desiro For That Savory Morsel filkeveals ajTale of Infidelity and Blasted Hope, About elght o’clo:k last evening, Mra. Jennie E. Shaw, a woman living near the corner of Fourteenth and Harney, was knocked down by a man, cut over the face and head with a billy and terri- bly brulsed and kicked. Her cries and as well as the frantic calls for of several fomalo oye witnesses THE DAILY BEE SATURDAY DECEMBER 21 1884. Briefly summarized, the history of the case in somewhat as followa s The taking of evidence, pro and con, in the cate is done by direction of the county judge of Cook county, 1ll. The cae In polnt s that of ey eral property owners on Warren avenue, a west side atreot in Ohicago, which has been ordered paved with sheet asphalt, There has been only one Chi- cago street paved with real sheet asphalt, and that only last summer, too recently tobe tested by time. These property owners who had a weakness for cedar block pavement appealed, and both par- ties—the city and tho property ownera— having consented to sucha plan, the judgs decided to take evidence in Oma- ha and in Washington asto the durability of asphal, Theso depositigns of testimony at Omaha and Washington, will be forward- ed to the county judge and apon this documentary foundatlon he will base his decislon, which will silence or sustain the objectlons of those who are opposed to asphalt, The deposition of testimony was con- ducted with counsel according to the usual legal forms, Hon. G. W. Dane, of this clty, represented the Chicago authoritios, while Mr. E J. Harkness, of Chlcago, appeared for the property owners. The testtmony haying been brought to an end, Mr. Barber, of the asphalt company, has left for tho east. The deposition in Washington will com- mence next Monday morning. The witnesses examined were as follows: For the city of Chicago: Samuel Shears, James Craighton, Gen. O. O. Howard, U. 8. A , John Frank, George St. Homan, J. J. Strickler, Andrew Rose- water, A, L Strang, J. B, Redfield, |T. C. Bruner, N. B. Falconer, J. E, Boyd, J. L, McCague, Edwin Davis, 8. A. D. Balcombe, Thomas Murray, D. H. Good- rlch, Edward Rosewater, James Stephen- son, J. H. McShane. 8. R. Johnson, William Fitch, C. E. Squires. For the objectors — Joseph Barker, Frank Marphy, Charles Fanning, E. M. Morseman, J. H. Butler. The balance of the testimy seems to be very largely in favor of asphalt, and the aephalt men are very much _elated over the outcome of the trial. Not antil the testimony of the Waehington peoplo is taken, will the final result be made known. —— " Lilly Olay at the Academy, Lilly Olay’s company played to a crowded house a4 the Academy of Music last night. From the time tho curtain first ro o until it was rung down for the last time the audience was convulsed manner of depredations, not ogly in Orasha and vicinity, but even in the state of Jowa. When the robbery of Mr. Duke’s store ocsurred, that gentleman, !n com- pany with James Davls, the detective, set to work at the long and difficult task of forreting out tho burglars, Varlous clews were followed up, only to result in disappointment. Tho teati. mony of Lottie Coombs, McClelland’s former mistress, furnlshed a strony basis for an hypothesis, which it seema now lacks nothing of verification. The guilt of McClelland and his pals was, to thoso who were working up the case, an assured fact. The oniy thing thatremained to be done was to clinch the liuke of testimony that should fully bind them to conclu- sive guilt, Acting uvon this precon. ceived theory, Mr. Davis and Mr, Dake ventured their efforts. Floating rumors which led them to suspect this locality or that locality were followed up. In his search for the atolen goods, Mr. Davis met with one or t#o exciting incidents, On one occasion he went to Plattmouth. Thore a falso charge of watchstealing was placed against him and he was lodged in jail with a noted crook who was suspect- ed of complicity in the robbery. While in jail, Davis overheard and frustrated a plan which this gentleman had laid to overpower the sheriff and break jall. This plan of “spotting” was practiced up in the various towns throughout the state until both Mr. Dakes and Mr. Davia bo- came apprised from source too reliable to distrust, of the oxistence of a burglar gang throughout Iowa and Nebraska, Finally Mr. Davis received an intima- tion that Wilson & Co., of Lincoln, know conslderably more about tho Dukes robbory than they were willing to tell. By a system of clever decoy enough evi- dence was obtained againat the firm to warrant the belief that they were run- ning a *‘fence” for the receipt and sale of stolen goods. A search warrant waa sworn out last Sunday and the premises were thorsughly examined. _ Bofore the search was completed, Mr. Dukes recov- ered about $500 worth of Sheflileld cut- lery, which he recognized as having been stolen from him. ~ A large quantity of hardware, stolen from Burke, of Lin- coln, and T. Sinhold, the Thirteenth street merchant of thia city, was also discovered hidden away in various hid- ing places. This work of raneacking]wasjkept until varlous lots of atolen goops were recover- ed and returned to their owners. Wil- #on was arreeted, but was afterwards re- leased on ball. The Dakes plunder was formaly turned over to Shertff Miller, of Omaha, who has given it under form of with laughter, and frequent'y encored members of the company, Among the several parts of this rare entertainment Miss Catherine Nelson deserves speclal mention, whose trained doves and dogs manifested to what a wonderful degree the brute creation can be educated. Alice Belzac in her marvelous invisible wire exercisen is a phenomenon. Tho mid-air evolutions of Zse were also greeted with loud applause by the audience, The cencluding part of the cntertain- ment, “‘An Adamless Eden,” is a short but pointed play, and the varlous mem- bers maintained their several parts to of peaple, who rushed into tho house, ovidently expecting to discover the com- mission of mome horkible crime. Tho wounded woman was placed upon a bed and Dr. W. O. Spaulding summoned. In the confusion incident to this little scene, the man who had made the astack, slipped out of tho door and was soon lost in the dark. This little incident involves a tale of decldedly spicy and sensational featuros, There has been boarding at the house of Mre. Shaw for some timo pasta young girl, whose name at present nced not be mentioned, This girl 1t seems has been guilty of intriguo with a certain well known man of Omaka, whose name, for family consideratione, is supprensod. For a long time the bllls of the girl were paid by her married lover. At length, however, her board bill became several weeKs in arcears, and to repeated invita- tious to come to the front and *‘plank down,” the merchant declined. It seoms, moreover, from information at hand, that be determined to “‘shake” the girl, prob- ably having weariod of her charms. At any rate, Mrs. Shaw and the young girl sought to secure revenge. They suc- ceeded admirably. was written yesterday morning S. to the wifo of the gay mai ried man, setting forth the clrcumstances of her husband’s infidelity. The wife, & fondly trusting young creature, was shocked when she received the note and would not belleve tne tale it told her. She repaired at eonce to Mrs. Shaw's house and heard and saw. She returned to her home, in an agony of pain and grief. Meeting her husband last evening she began at once to reproach him for his faithlessness toward her, Without waiting to hear the full extent of his upbralding, the maddened spouse drives down town, up tothe residence of the woman who had betrayed him and breaking in, discovers the object against whom, for the moment, his 8. fl'm. thought of vengeance is directed. @ beats her until she s wellnigh insens« ible, alips out, and escapes under cover of the durkness, He flod across the river, and is now, it is said, in the state i of Towa, beyond the lmmediate reach of the law. Mre, Shaw will probably recover from the effoct of her injuries, The wife, of course, takes to heart greatly her hus- b'l"%]' perfidy, and is well nigh incon- sola erry Obristmas Wedding, Ohristmas eve Mr, J. B, Piper, of city, and Miss Emma Kunapp, of reenwich, Conn,, were united in mar- tlage. The ceremony took place in this city at the resldence of the bride's sister, Mrs, Reynolds, on Twentieth and Leaven worth streets, In the presence of a selec! party of friends, After the ceremony they were eacorted to their new home, nea Purk avenue, which was already prepar- the satisfaction of all present. e — Bad Man Saffstrom, August Saffstrom, the young man re- cently employed by Mr. J. F. H. Loh- man, who eloped by himeelf so uncere- moniously a few weeks ago, has been heard from. He bobs up serenely with an epistle to his former employe, and writlng from Los Angelos, Cal, Mr, Saffstrom says that married life, by by reason of its toils and vexations of soul and epirit, had finally superin- duced in his delicate organizition an un- conquerable feeling of nausea, Ho had, consequently, determined to leave home and friends in Omaha, never to retura. Meanwhile, Mrs. S.fistrom is grieving over her husband’s course, and ex- periences the most polgnant eorrow at his determination to deaert her. Army Headquarters Gossip. The headquarters people are very busy just at present making up and auditing accounts, Gen, Howard is particularly rushed in looking over tho records of tar- get practice, and awarding certificates. Major Alfred T. Smith lefc the city Christmas morning on a threo weeks’ vis- it to relatives in the east. Adjutant General Taylor is suffering from & soverely sprained ankle. The evidence against John McClelland, which has been obtained in this connec- ton, is said to be complete, The tesil- mony also implicates Patey Hogan, The connection of Sandy Forbes, Frank Burns and Lew Carroll with the criminality, 1f, indeed, there ba any con- nectlon, i not yot apparent. 1t ls prob- able however, that the evidence in this directlon has not been fully developed. The most important festure of the case, however, is that In this connection, proof positive has been obtained of the exlstonce of an organizad gang of rob- bers throughout the state of Nebraska and Towa. The ring has a general ron- dezvous or headquarters in this city, while minor stations ay'‘fencea” exista at Lincoln, Council Bluffs, Sioux City, Missouri ~ Valley, Red Oak and at other points in the locality. The whole gang is organized perfectly, and each sec- tion is 80 detailed as to be able to place perfect confidence In the other., The minor details of the ring need not yet to be made public, as the ends of justice will best bs subserved by the suppres- sion, for the presant, of further facts. About the on- ly change reported to-day is the resigna- tionof Mr. George W. Lyndon. Mr. Lyndon has for somo months past; held the chief abstract desk In the freight government, and the atock was in_effact distributed among the contractors for no coreideration whatever, This defiance of Iaw has characterized ths management of the road from that timo to this, and the company has contrived by its great money power to keop the hands of the govern- ment from doing anything to enforce its obligations, -In selecting its agents and attorneys it has taken good care to have in its pay men cf influence in public affairs, and the secrot doingsof its lobby at Washington would farnish an Interest. ing chapter. The sudi- tor of railroad accounts when notified of thenow issuo of etock took it upon him- self to say that no exception would be taken to the proceeding and to announce the remarkabledoctrine that this inflation of stock would increase the value of the company’s property and add to the seca- rity of its creditors. Ho was been re- warded by a lucrative placein the com- pany’s service. In the meantime the company was do- Ing nothing to provide for its obligations to the government in the payment of in- tereat on the eubeidy bonds and their final redamptlon in compliance with its charter. 1t went on paying dlvidends and utterly disregarding its obligation to the government which hasso liberally aided it. Finally, in P878, under the lead of Senators Edmunds and Tharman, and in apito of a powerful lobby, congress grap- pled with the subject and passed the so. callod Thurman eot. Among thess who wero ready to sorve the company by do. feating this measure and did their utmost to that end were Senators Matthews,Sen- ator Teller, now secretary of the interior; Senator Blalne, now a candidate for president, and Representative Butler, who is paraded before the public as the favorite of the anti-monopolists.
