In the cases of Zipp va. the city, Kil- feather va. the city. Damon va. the city, and Gilfoile va. the clty, a change of venue was yesterday granted on motion of the clty attorney. The cases are tor damages on account of changes in grade, and will now go to Mills county. City Attorney Holmes Olearly Points Out the Illegal Acts of the Council, For some time past the council has been allowing a peculiar class of bills, which arise in about this way: A man furnishes goods or does work in accord ance with a contract with the city. His bill is allowed, a warrant drawn for the amount, ho sells the warrant at say twenty-five per cent discount, and then prosents a new bill to the council for enough to cover the twenty-five per cont discount, and this is then allowed. Some such bills have been presented amount- ing to hundreds of dollats. Tur Bee has already shown that by this doing the city pays enormous intereat, for for every soventy-ive cents of work they pay at the end of & year one dollar, and six per cent interest, or in other words pay $1.06 for soventy-five cents worth of work on goods, or thirty-one cents interest on seventy-five conts, which amounts to over forty per cent interest, No merchant could do business safely or keep up his credit by borrowing money at forty per cent interest and the city can surely not do so. This matter was referred to City At- torney Holmee at a recent moeling, and ho propared a very clear and full roport, which he presented to the council last night, in which bhe openly pronounced such a course illegal. It remains to be scen whether the council will override this opicion as ic has others, and allow such bills whether or no, The city attorney in his report cites the law providing for sources of revenue to the “city, and_concerning the llmita. tion of indebtedness. In connection wlth this he put the pertinent question, how can it be said that when general warrants of the city are at a large dis- count in the market, that they have been fssued on a true baeis of anticipation of the revenues to be derived on the tax levy for the current yeari Hesays: “A full answer to this is that the issuance of warrants to pay or make up the discount void, for the discount shows an excees of issuance and all warrants thus issued to make up the discount are void for they do not come within the anticipsted ‘revenue to be realized, and are prohibited by the con. stitution. Otherwise if the practice of 80 issuing warrants to make up cash deficiencies where the tax revenues were iosuflicient, wouid avoid the protection intended tobe given to citizens of a corporation coming within the lines of the statute, No evasion of the constitu.
