It appears that these two men had been THREATENING TO KILL ONE ANOTHER on sight for saveral days, owinn to some difficulty growing out of each one's rela- tions with a white woman who until yes- | terday lived at a notorious disorderly house on Eleventh street and Capitol avenue run by a woman named Ellen Mitchell. Yesterday the cause of thelr trouble moved into a house near the cor- ner of Ninth and Dodge and both men being in that vicinity followed the com- batants into the alley. Some of these who were present say that Davis and Flowers happening to meet, the former deliberately drew out his revolver and being only two or three paces distance fired, the ball hitting the latter just below the stomach. Davis figmi again, but the bullet flew wide of its mark, Fiowers seized Davis and wrench- ed the pistol from his grasp, when the latter turned and fled. The wounded man followed Davis and fired two shots at him but without effect. The piatol reports brought out SEVERAL HUNDRED PEOPLE, mostly women and children, who, when they saw what had been done gave vent to their fright by screams and cries. Officers Morryaton and Bellamy, who were close by, followed Davis down through the bottoms. The fleeing man took down the railroad track and hid in an empty shed near the Seventh street railroad crossing; where he was found by the police. He was taken to the city jail and the charge of shooting with in- tent to kill set opposite his name. The wounded man was_helped into a carriage and taken to No. 203 North Eleventh street. who had been summoned, soon appeared. Flowers was found to have received A DANGEROUS WOUND from a 44-calibre revolver, on the right side of the median line, twoinches above the groin. The ball took a downward ®nd outward course, and buried itself in the muscles of the thigh, passing within a half inch of the femoral artery. The snrgeons probed the ball, but were unable to extract it. The wound is considered by the attend- ing physicians not fatal, though a very serious one. Flowers stated to the police officers that three or four of those present saw a youug man named Martin Kennel- 1y hand Davis the revolver with which he did the shooting. Upon his statemnent Conneliy was arrested on Tenth street by Officer Uormick. He ‘was kept through the night in the city jail charged with being an accomplice. He denies any complicity in the affair. Davis’ story, as related in the city jail last evening, Is entirely different from that related above, who says that upon meeting Flowers in the alley he (Flow- ers) made a feint as if to draw a revolver from his pocket. The prisoner said the wounded man compellea him to THROW UP HIS HANDS Saturday evening by drawing a pistol upon him, and that he thought he was about to do it again, and whip- ping out his revolver fired at Flowers in solf-defenze. No pistol, however, was upon the wounded man when he was searched. Davis says he bought the pis- tol of a pawnbroker only yesterday fore: noon, and purchased it for the purpose of defending himself from an attack by Flowers The prisoner bears the reputation among his race of being a hard working, honest man who never baforo has been in any trouble. Flowers is looked npon by many of the colored people.s being a desperate character. Twelve witnesses appeared for the state, eleven of whom were Indian girls, anh all agreed that they were bathing in the turbid train stop at the bridge to take water, and that two cowboys who were on the train, and a large mat whose identity was a little mixed, ap- proached and exchanged a fow words with the sun-browned beauties of the foroat, and the assistant matron of the school, Miss Steele, who superintended the ceremonies, But one out of the twelve testified to hearing any indecent expression from the men, and she unable to identify the offender. After all the testimony had been given by the prosecution, the defense moved to dismlss on the ground that the state had failed to make a case. The motion was of course granted, and the prisoners dismissed. The gentlemen against whom the suit was brought are men of families, and are respected in the community in which they live, and the testi- mony did not show that they had done anythiug ont of the way in the matter. Probably the cowboys werea little bold and did wrong in going near the place where the girls were bathing; but it would have been difficult to run the train out of its accustomed course to avoid coming in near proximity to the bathers. It has ever heen suggested that a less conspicuous sand-bot- tomed bath tub might have been selected, 8o if ere really is any one to blame, it is not entirely one- sided. It seems very unfortunate that 80 trivial a matter should be brought into court, and thus add to the burdens of the tax payers without doing any good except, to exonerate the accused from any evil intentions.
