The prosecution rested last ovoning, Mr. Playford opened for the defense this morning, outlining the case, which will bo emotional insanity. He made an oloquent address and said the defense did not deny the killing, but would show that at the timo the deed was committed the past wrongs and outrages upon the family made the defendant unable to control his will and would prove that after tho shooting of his father mental disturbances, which were hereditary in the family, took a strong hold of him and affected his renson. Dr. Fuller testi fied that ho had been the family physi- cian for aeventeen years; always believed James mentally deficient nclined to harbor fcolings of enmuty until he becamo a monomaniac; considered him an imbe- cile, not an idiot. Mrs. Nutt said James was always a good boy and much attached to his parents; considered him the ro- verse of mentally strong; hearing Dukes’ lettors he bocame morose and the acquit- tal of the former greatly excited him; once when he came home from town he was much agitated and said, ‘‘Mother don't you think that villian Dukes had the impudence to look at me and laugh."” For a weok before Dukes was shot James would scream murder in his sleep and frequently walked the floor and wept. l\}rn. Nutt was cross-examined, but nothing new was elicited. Mrs. Anna Wells, vames’ grandmother, and James Wells and Stephen Nutt, his uncles, corroborated the previous wit- nesses regarding the defendant's mental condition. Stephen Nutt explained the pistol practice by showing that it was without design, The words *‘Don’t fail Jim,” brought out by the commonwealth yeatorday, were nothing but an injunc- tion to attond to cutting grass.
