It proves to have been a premature birth in a respectable family, and the body after being placed in the box was entrusted to | a colored man to bury. It appears that he did not do his duty very well. Dr. Cross was yesterday arraigned & the district court on the charge of mur- der, and made answer that he was in dicted by his true name. This formality liaving been gone through, and Decem- ber 26th set as the day for trial of the case, the doctor retired from the court- room, the old bail being his surety for appearance when wanted. Cox, of The Acorn, figures up that the town of Oakland spends £3,000 for drinks, over £2,000 for cigars, $875 for billiards, $1,000 for the ministry, 81,200 for schools, and $616 for the support of his newspaper. Thisarray of figures will doubtless cause Oakland to cut down its newspaper oxpenditure, Henry Dust, a darkly tinted prisoner, was before Judge Aylesworth yesterday on the charge of stealing a sack of flour from Eph. Huntingdon's store. He was found guilty, and in view of the holidays coming the judge sentenced him to jail for only four days, so that he might be out in time to enjoy Christmas. A. J. Mandel, L. It was ordered that all of the streets which have lately been filled shall be curbed and guttered. 1t was ordered that the slleys between Seventh and Eighth streets, south of Broadway, be filled up to grade. Permission was given to properfy owners on the avenues south of Broad- way, as far as Seventh avenue, to have their curbing set 14 feet into the strect, leaving six feet for sidewalk and eight feet for trees and grass. Lowis Hammer was notified that he must at once complete his contract for curbing Main street or the city would commence action against his hondsmen. “." The | question was in fact whether the city should pay for the filling of the strects | out of the general fund or whether the owners of the abutting property should | pay. Throwing aside all the legal technicali | tios Judge Reed's decision was in sub- stance that where the filling of the street |up to grade was preparatory to paving, that it could be charged up to property | owners, and in the case before him the | face of the papers showed that it was for | this purpose. | The streets in _controversy are Kighth and Ninth from Broadway to the creek, and course it is gonrrally believed that the council has no intention of paving these stroots, and the words “preparatory to paving” are alleged to have been put in the resolution ordering the filling, simply to make the filling technically an incident to the paving, thus making the owners of abutting prop- erty liable instead ' of the city. The papers did not show this claim, however, and Judge Reed passed upon the matter as the face of the papers showed. | Tt is now prm]icuul that the papers will be amended so as to set up that the council put in the words *‘preparatory to | paving” for a fraudulent purpose, |they not intending to pave, and |that the case will be carried jup. A Stanton Merchant Arr taining Money Und Pretenses, Karl, Loy, who is doing a mercantilo business at Stanton, Neb., was brought to this city yesterday in charge of Deputy Sheriff Clatterbuck, who had a requisi tion for him, an information having been filed before Justico Schurz, charg- ing him with obtaining goods under false protenses. This charge is made by Gron- eweg & Schoentgen, who claim that in September last Loy represented that ho had 7,500 to $9,000 worth of goods, 84,600 of notes and _accounts, $600 of real estato, and that his liabilitios were only £5,300. On the strongth of this tho tirm sold Loy $700 worth of woods on credit, and afterwards learned that in- stead of buing in_debt $56,300 he was owing $8,000, and that the other repres- ontations were false. But their fears are certainly groundless, for it is not reasonable to suppose that the small amount which Blair or Fremont could raise toward building the shops there would be any inducement for the com- pany to move their shops away from the terminus of the road.
