"Thomas, trustee,appellant, vs. the Brown. ville, Ft. Kearney & Pacific railrond com- puny, et al., on an appeal from the Tnited States circuit court, district of Nebiaska. This was a suit of a foreclo- sure of a mortgage upon railroad prop- erty belonging at the timo the mortgage was executed to the Brownville, Ft. Kearney & Dacific railroad company, but afterwards transferced by consolidation to the Nebraska railrond company. The mortgage was given to secure certain bonds issued to the construction company under a contract for building tho railroad, The appellant is the trus- teo named in the mortgage and sues in behall of the holders of the bonds se- cured by it. The defence sot up is that the mortgage g out of a fraudulent | contract with the construction company, and the contract is illustrated by the Credit Mobilier case.
