A Special Council Heeting on Sower Matters, It is Agreed that '‘SBteps Must at Once be Taken To Prevent a Recurrence of the Late Disasters A call for a special meeting of the olty councll was lssued yesterday afternoon, but as it was Impossible to fiad the mayor and It never found its way Into the handsof the clty clerk, only an informal meeting was held. Three or four pollcemen were dis- patched on varfona missions to secure a legal meeting, but it was no go. At & o'clock the members prosent were called to order and, on motion of Councllman Haskall, Mr, Redfield wan called to preside, Upon invitation, City Engineer Rosewate: was called upon to meke s statement In regard to the deficlencles of the preeent sewer aystem, the object of the meeting belng to take 1m- mediate ateps to prevent a recar- rence of the catastrophe of Tuesday mornlng. Mr. Rosewater began by giving a brief history of the present system. Tae dimenslons of the sewers wera determsed by taking the areage of country they were to draln, which was for North Omaha 3100 acres and for South Omaha 1,100 acres, The calculation was then made for the dimensions from the formula of the best evglneers In the world, In- cladiog R. 0. Pailipe, of Olnclunati, and othera of equal or greater promi- nence, The englneer named spent three monts in Omsha, and after mature examination and Inquiry submitted a plan, embracing both sewers, to the council, which was adopted, All modifications made since have been on the safe side. The estimate fs made on the theory that a sewer with a capacity of half an Inch per hour for a given area wlll accommos- date a ralnfall of an inch per hour, The balance would naturally be ab- sorbed. It Is assumed thut a sewer will have a capaclty for the storm water of any average rain, but it wonld be ruln to base the oalculation on the maximum rainfall. The hotel company, which incladed Caldwell, Hamilton, Barkecr, Pratt, Redick and others, took an appesl from the decree and fild a supersedeas bond in the sum of §60 0C0. The deciston of the clrcalt court was affiemed by the Ualted Statos supreme court, and thereupon sult was brought by Creighton, Kountzs and others upon the supersedeas bond, claiming a forfelture ot the bond and interest, which wonld amount to abont $80,000. At the January term, 1879 of the Uaited Suates clrcuit conrt for Nebraska at L'ncoln, thls cosy was tried by jury, who rendered a apecla verdict, whoreupon the judge entered judgment agalnst the defendsnts for aboat §20,000 Orelghton, Kounizs and o' hars then tock the case on a writ of error to the Uaited States supreme court, and Oaldwell, Hamllton and othcra, do- fendante, took a cross blll.
