The only thing of value it possessed was the grant, and this it lost by fuilure to build the road. The New Orleans Pacific professed to have absorbed its charter and franchise, though the New Orleans Pucific built a road entirely aifferent from the propored Backbone road, The New Orleauvs Pacific, how ever, desired to obtain possession of the rich land grant of the defunct Backbone road. This land grant cov- ored some of the richest sugar lands in Lounisiana. It is now alleged that the private arrangement that was made was that the New Orleans Pa- cific should bond the lands at $3,000,- 000 and glve to certain persons who clalmed to have interest in the Back- hone road §1,000,000 of these bonds. Now, theso persons could have had no lawful interost in the Backbone road, for it was defunct, and its land grant had lapsed, but thep were per- sons who could have prevented the insuing of the patent or the ratifica- tion o? the grant to the New Orleans and Pacific, Many settlers have taken this land in good faith. Much of it is improved and valuable. Farms are comprised init. Lhe vettlers, many of them, pro-empted the land under old lawa. Others have secured lands since 1876, supposing that the Backbone grant had lapsed, and that they could have the land by pre-empting it and pay- ing the government prics fer it. The vettlera, about year ngo, learned of thoe negotiations that had beeu going on between the New Ocleans and Pa- cifio and the persons pretending toown the Backbono interests. They were greatly alarmed. A committeo came to Washipgton and learned that the secrotary was almost ready to sign the patont to the New Orleaus Paottic Congressmen Blanchard and Robin- son, of Louisiana, filed & protest with Secretary Kirkwood against the rati- fication of the grant uutil the rights of the eettlers could be determined. An agreemoent was then entered into with these settlers and Jay Gould's agent by which the agent bound Gould to guarantee the rights of the settlors. Satisfied with this, the settlers withd! their protest, but the guarantee has never been exo- cuted, This action of the settlers, however, stirred up the old Backbone rallroad bhondholders, among them Senator Kellogg.
