IMPORTANT LAND OFFICE RULINGS, ‘WasuiNaToN, November 14.—Act- ing Secretary Joslyn to-day decided that where a settler has failed to com- ply with the law in making improve- ments, but has tilied the land and his failure to build is shown to have been caused by climatio inflaences, he should be allowed a further period of six months within which to establish residences, Iu the case of Christian F. Ebing- er, of Bloomington, Neb., against Daniel Hearls, Acting Secretary Jos- lyn to-day decided that Ebinger ac- quired no right by presentation of application for timber culture entry during the vacancy in the office of re- ceiver, and that consequently the tract in coyiroversy was unappropria- ted on the day of Hearls’ application. The decision establishes an important precedent which will govern similar cases. Acting Secretary of the Interior Joslyn to-day decided that the s:at- utes restrict a contest against prior timber calture entry to one who seeks to enter it under the homestead on timber culture laws. In the ab- sence of application there is no right of contest, In the decision rendered to-day the acting secretary of the interior holds that a contest for land title instituted by a parent cannot be transferred or inherited by a child, even though 1t shall appear that the contest was in- stituted for the child’s benefit. Of the 26 new senators, seven have already been elected, three democats, three repub- licans, and Riddleberger, Tuere re- main 19 senators to be elected, and to control the senate, the republicans need 10 more, while the democrats need 13, After the election in states which are sure to elect republican and democratic senatore, the two parties will be a tie at thirty-six, There will remain to sottle the question, the states of Colorado and Nebraska. The senate would be a tie if Oolorado and Ne- braska should both elect democrats, The oaly chance of the democrats to obtain control of the senate is in the event that both Colorado and N«braska shall elect democrats and that Mahone and Riddleberger shall abandon their republican allies and vote with the democrats. Both these contingencies are unlikely to occur. Special Dispatch to Tux Brs, Cueveranp, November 14, —This afternoon a strange accident happened at the corner of Seneca and St. Clair streets, where a large block is in process of erection, The walls and flooring being up three stories, a boom derrick 100 feet high and two feet in diameter at the base, was used to hoist materials, Through the break- ing of the shacking of a wire guy at the anchorage, as supposed, the der- rick toppled and broke about twenty feet from the ground and fell with a great ocash. Three men were on the platform sixty feet from the sidewalk, hoisting a load of about three tons of brick. One jumped and caught a lower gay and slid safely to the ground, The other two, a Ger- man named Dietrick Stazed and a colored man named William Price, were 80 injured that they died soon afterwards. Stazen's back was broken and Price was shockingly mangled. Another colored man, name not ascertained, was instantly killed by the derrick falling on him, Still another laborer was badly injured,but may recover.
