She Hasn't the Small Pox—Rallroad News-—-Other Matters. Correspondence of The Bee. CrariNDA, May 4, 1882.—Our city is enjoying a season of heretofore un- excelled prosperity. A rumor of an imported case of small pox among us a few days ago is probably false, as there seem to be no developments in the case to indicate the presence of the disease. Weo had a severe siege of the epidemic during the winter, about twenty-five cases out of forty proving fatal among the railroaders, and our people have becomo used to the usual exaggeratod reports that are published about small pox, when some poor fel- low ls enjoying the luxury ot a short season of measles or seven-year itch. Woe are sitll honored with the com- pany of the great civilizer of the century, viz, the railroad builder, but the more rigorous administration of our newly elected city officers has stopped much of the devilment that seemed before to be a necessary accompaniment to their presence among us. Rails are now laid for nine miles out on the Tarkio road, or Denver short h\m and the work will probably be throufi to Coin in about six days. The track-laying is not progressing so rapidly on the H. & 8. road, but will probably be oomgl\:tad between here and Shenandoah by July 1st. The location of the machine shops on the H. & 8. is now becoming a subject of considerable moment to several towns along the line, and especially Clarinda and Shenandoah jealously watching their interests. Our town sustained a severe loss o few days ago in the death of Prof. Keller, leader of the C., B. & Q. band, and among the most distin- guished if not the most eminent com- ser of band music in America. eath did not enter suddenly, for he has been a sufferer for months. The greenback oracle Gen., J. B. Weaver regaled our people with a speech on Saturday last. Although a little out of season, as also their doc- trine is since the drouth and grass- hopper and pestilence have failed to impoverish the country, he was fa- vored with a full house, and sdcceeded 1n extracting a fat fee from the breth- ren at the close of his speech. The friends of the prohibition con- stitutional amendment organized here this week for a vigorous fight. The organization is about complete in the county, and there is no doubt but what Payne county will give a very large majority in favor of the amend- ment. PROMIsKED HANGING IN IOWA. F.W. Georgo Convicted at Des Moines ofthe Murder of Dr. Eaps, the Jury Recommending Capital Punish- ment. Drs Meanes, Ia., May 6.—The trial of Fountain W, George, charged with murder in the first degree, which has been occupying the attention of the distriet court for the pest three weeks, finally terminated yesterday in a ver- dict of guilty of murder in the first degree. The exact language of the verdict®eing as follows: We, the jury, find the defendant, Fountein W. Gecrge, guilty of raur- der of the first degree as charged in the indictment and determine that he shall be hung by the neck uatil he is dead. The peculiar wording of the verdict in determining the penalty arises from | & stabwary provision enacted two years | 8go, restoring capital punishment, but| placing its infiictien entirely within the pswer of a jury. No judge osn pass entence of death upon a prison- er in Jowa unless the jury expressly declacesffor the same, or can » judge modify a verdict. It must be approv- ed or set aside. This is the firat de- termination to hang that has been ex- Freued by & jury under the present aw. The verdict-did not seem to un- nerve George. He seemed compara- tively unconcerned and shook hande with each of the jurors, declaring that he belioved each had acted honostly. Thejury was outdwo days and it was| gener lly believed that manslaughter would be the verdict. The defense set| up was insanity produced by epile; 10 attacks of whiah s well known fi‘&' is subject. The crime for which George hu been convicted was committed on Bun- daymorning, July 24, last. It was| occasiorned by teouble between hira and & Dr. Epps about a young girl who! had vecently come to town. George claimed that his irterest in the weman was purely honosable, and thet it arvserrom a desire to protect herérom the intrigues of pastieslike Epps. The latter had taken her to a boarding house.on the east side, where he was paying her bills, and on the morning of the murder George called at th house, but Epps was not in, told ¢hat he wowld shortly return George went to the nearest street cornerand waited. Shortly Epps ap- peared and Geoxge met him, asked kim where ke was going, end he responded ““to the boarding house.” George ce- plied thet if he did he wouldshoot him, Epps continued on his way across the street, George following, revolver in hand. When he reacked the middle of the street, and whea about thirty feet from Eipps, he fired. The latter then started on a run &own the road, George about two rods behind. A second shot was fired, ‘Epps ran a fow steps ferther, staggered and fell. The murdener came up to him, being yet uncertain of his work, put the pistol to his breast and pulled the trigger, but it snapped, and as the ovowd gathered he was compelled to retire. He was soon captured and has since been confined in the county Alter the murder George told no two stories the eame. To one he says that ke was given the charge of Lotte Martin by her dying father, aud that he loved her as a ehild and wished her to be well takon care of; that she had been seduced and was about to beeome a mother, and accordingly to prevent such & diserace as would result to hor fair fawe, he had employed Dr, Epps to perform an abortion on her, Dr. Epps wanted to accomplish that pur- pose in one way and he wauted him to do it in another and more mild man- ner. The doctor refused to comply |ca with his wishes, and he being ofraid that the girl would die under the ope- MAY 9, 1882 1 — ration, resolved to kill' the dootor to prevent his killing the girl. .
