Which Would Knock all Their Indictments Into ‘‘Pi.” The Plena in Abatement to be Argued This Morning. The week devoted in the district court to the trial of criminal cases began yesterday with the case of the state va. Lee Stits, who is accus ed of having stabbed his brother sev- eral months ago during a drunken fracas in South Omaha. The victim of the crime, Henry Stitz, was stab- bed first in the head and again in the back near the spine, the latter wound producing paralysis of thellower limbs, He was hauled to the court house yes- terday in a cab and carried up stairs in a chair I:{ tour men. The jury was impannelled by 11 o'clock and the trial at once begun. KOSTERS ARRAIGNED, Pending the statement of this case to the jury, Hon. J. C. Cowen, coun- sel for Chas. Kosters, indictea for the killing of Oscar Hammer on Christ- mas morning, asked that Kosters be arraigned. Kosters was in the court room and made his appearance before the bar without any especial sign of discomfiture or agitation. William McCandlish, Theme: ‘‘The Influence of the Bible on the Oivilization of the World During the Era of Bibla Societies;” and a twenty-five minutes’ address by Rev. G, W. Wainright, district super- intendent elect. Theme: ‘‘The Bene- fits of the Diligent Study of the Serip- tures upon the Character.” The report of the secretary and ‘reasurer and the president’s report of church contributions were interesting documents. Rev. Mr. McCandlish, who has served as superintendent of the dis- trict including Nebraska, Wyoming and Colorado for the past thirteen years, rotires in March, and will be succeedcd by Rev. G. W. Wainright, of Blair. There are now 94 Bible organiza- tions in this district, three-fourths of which have been orgil‘mizud during Mr. Candlish’s time. An Omaha Merchant Who is Climb- ing Up Rapldly to the Top of the Ladder. Nearly two years ago, one mornil;“ in May, 1880, a BER reporter who was passing down 10th street on bus- ess, saw a new sign flung out to the breeze, and on entering the store- room on the east side of 10th, near Jackson, found the proprietor, a pleasant and energetic young man, | was some apirited dancing in which THE GERMAN THEATRE, wine Heynold on Her Re- Appearance on the Ger- man Stage, Last evening quite a large and ap- preciative audience assembled in the German theater to witness the per- formance of Alwine Heynold in *“The Milkmaid of Schaneberg.” Miss Heynold sustained the title role, which was exactly suited to her unique style. When she first made her appearance on the stage, accom- panied by a big black dog dmwing a cart containing milk cans, she was greeted with a burst of most enthu- siastic applause. Her acting was all through the play irvesistibly droll and during the duet wish Lindemann, at the conclusion of whieh they doth stab themselves to the heart —with fans, the awdience were convulsed with laughter and she was vociferous- ly reealled. During the evening some lively songs were sung, in which there were some very effective local Xits. The execrable condition of the sidewalks on Tenth street, and the obnoxious Slocumb received some emphatic censure at the hands of Hesrr Mol- chin. Mr. Lindemann, as Henry, was ex- cellent, and gained several encores; and Mr. Bergmaun, as Nagel, de- picted a drunken scamp, remarkab)y true to nature. The charaster of Brennecke, the obquitous newspaper reporter, was ably spstained by Mr. Kuester, and Mr. Lutze in his triple character, sustained his parts exceed- ingly well. Miss Grossmaun as Louise, acted with her usual charmiug grace and in the suicide scene her emotional delin- very effective. Miss Bushmann as a srevant, and Miss Thiessen as a gover: ness, played with their aceustomed ability and: all the minor roles in which Mrs, Mader, Mrs. Grossmann and Messrs. Willig and Penner took part, were fairly well sustained. At the conelu on of the play there all joined with gusto. Steinhanser's excellent orchestra contributed the musical part of the melange. The claim ia that the selection of names was entirely in disproportion to the number of persons in the prc- cincts, and that this disregard of th law invalidates the whole business, The district attorney took until to- this morning to reply, and if the plea is not sustained the trial will probably begin on Wednesday. The effect of this plea, if held good, would be to invalidate all the acts of the recent grand jury and discharge all the prisoners indicted by them, in- cluding Kosters, and it is hardly likely that a special session of the rand jury would now bo called, even if it could be legally done. ers in the great Empire state.
