Scott, the decision rendered in the district court by his honor, Judge Reed, must convince every citizen who respects the will of « majority ef the votes cast at a given election that 80 far as his action in the injunction and mandamus suits against tho city council were concerned, he had the law upon his side. The polls were opened at the usual hour and closed at four o'clock in the afternoon, in accordance with the statute in such cases pro- vided. It seems, however, that in calling the olection Mayor Vaughan either through ignorance of tho law or otherwise, ordered that the polls should be kept open until 6 o'clock. On the day of the election, finding he had made a mistake in this regard, he went to each precinct and changed his order. On the closing of the polls at 4 o'clock it was known by those who had made diligent observations as to the result from time to time, that the ple, by about two hundred and orty mlj}:)rily, had voted to abandon the old charter and incorporate under the general laws of the state. They wero hitched to a pump wagon when they got frightoned, dashed down the street, overturning the eame at the corner of Fifth and Pearl strects, and scattering J)um]m and pump handles in every direction; here they broke away from the wagon and continued the race until they raached the trans- fer, where they halted and were cap- tured. GAINING GROUND, Florence Herbert, in ‘“‘Archie, the Newsboy,"” and *‘Capitola,” last even- ing gave great satisfaction. The young lady appears to be gaining in favor in this city. THR “‘CAURCH AND PARISH,” o neat little volume, issued in the in- terest of Saint Paul’s parish, in this city, is just out. The grand jury failed to find a bill against Hettio Ward. 1In the case of Bergman vs. Bergman, court sustained motion for continuance. The court, on conviction, sentenced Rowl to thirty days in the county jail. The case of Peter Ehlers vs. C. and P. Melcbut, was taken up in Judge Reed's court yesterday, John Lindt, assisted by E. E. Aylesworth, ap- peared for tho plaintift, Sapp and Ly- man for defendants. MISCELLANEOUS, Part of the force at work on the Mammoth grain elevator have been qin;;hlrged on account of lack of mate- rial, And again it is stated that there is not a case ot small-pox in the city. William Garner, of Garner town- ship, this county, 1s confined to his residence quite sick. William Powers, one of Council Blufis’ well-known citizens, is lymg dangeroualy ill at his residence on upper Broadway. A little girl was run over by a milk wagon on Eighth street yesterday morning, and received (uite a bruise on her loft side, nothing serious, however.
