Incidents and Impressions of the Guitenn Trial Washin Corcespondinee Clacin. ati Com rela At the head of F d-a Half street, a couple of squares to the north of Pennsylvania avenue, located the pile of buildings devoted | to the administration of justice in this District of Columbia, Tt is a not in logant structure of brick nised with plaster imitation of stone on the outer walls as to ive th into a no tion of something more substantial and made to look at a distanco like some of the government marble insti dis- | | el 80 tutions of old Grecian architecture, with ample portico and plain fonic | colunius and spreading wings. In frout standing high on a granite shaft is the statue of the first of the line of assaseinated American presidents look ing away, with his back on the scenc of to-any ~away off, to the land of his freedom. Away to the southwest, of the Potom off] you see through a vista opened by | a wide avenue the Washington monu ment, now brought to an alutnde that suguests somothing more imposing than a whitowashed chimney of a factory, to which, for the life time of eration, it was most fitly compared. Intervening buildings shut out the view of the capitol half a mile off to the eastward, but the Goddess of Liberty on the summit, with her face to the rising sun, may teke a wrathful or pitying glance at the criminal van as it passes by morning and evening from and to the prison, a mile beyond 1t is doubtful whether these ¢ surroundings diverted the attention of many of the crowd who jostled cach other on the portico yesterday or to- day, and will probably continue to jostlo each other for a fortnight to come. Within the building, on one sido a jury was sitting out the tos mony in some civil action iuvolving, perhaps, a few hundred dollars, and 1 the opposite wing 18 being enacted the closing act of one of the most dra- matic passages in American history. It has been occasionally referred to as a farce by hasty writers, and I doubt not a large section of, not the majori- ty of the people of the country at c, o mile | | large have somehow come to look upon the proceeding as a poorly played farce after a terrible tragedy. It has not impressed me that way: By the kind- ness of Marshal Henry T found easy admission and a good seat this morn- ing, not with any expectation of “‘mak- a report,”— that is mosteffectively done by the regulars of the profession, but to gather up such trifles as inter- est a new observer, The court room is large, airy, and would bo ample for the accommoda- tion of all ordinary crowds, but now it as been more than crowded before the twelve unfortunate men condemn- ed to try the case are - conducted into the jury-box, an ' the criminal whose Fancy Goods | deeds and fate enlist the attention of two continents, is hustled in from a room behind the “bench,” and given his accustomed seat. It is his tuen to testify in his own behalf, and as he takes the witnes md on the crowd- ed dais, so close to the jurors that he could shake hands with them, you look in vain for anything in his per- son or appearance to distinguish Charles Guiteau from other men whom you are meeting in every day life, on the street, in the counting room, in business and professional cir- cles—everywhere. You have been, perhaps. in Mead and Tussaud’s ‘‘Chamber of Horrors,” and carry a vivid impression of some of the ghast- ly features of the place. The next time you go there you will probably find as a new attraction tho counter- fert of the criminal now on the witness stand, and if 8o you willsee nothing to particularly distinguish him from the other murderers, though a majority of those known in ‘‘State cases’” show more breadth of brain and linaments graven by hard thinking. He poises himsclf easily for his task, and proceeds to give prompt, plain, direct, pertinent answers to all ques- tions propounded by his able counsel. He knows the exact situation, but is not_disconcerted. Opera-glasses are in lively requisition in the audicnce. He bears the scrutiny with easy non- chalance. His answers ave consistont, straightforward, and given always without the sli. htest hesitation— this applys only to the direct examination, however. ~He is more cautious when taken in hand by counsel for the Government., Judge Porter does not find it so difficult to make him wince, as for instance, when he forces from him the unwilling, though not very reluctant confession that he lied ssterday, when he he was strictly virtuous” at Oneida. A wicked observer whispers, ““There, you see he was sane cnougl when he was there g At the end of two hours, having failed to get inas part of his testi mony a newspaper ioterview tl published last August, he is taken “‘unwell,” aud asks for a recees, to which the opposing counsel do not object, and relief comes to the strained nerves and muscles of a thousand auditors, more or less, Left to gather up the impressions fixed by the scene you say the audi- ence, composed in about equal num- bers of ladies and gentlemen, the gentler kex perhaps predominating, with an almost entive absence of the rougher element, has been as well-he- haved and self-respecting in manner as any audience you are accustomed to mectat the lecture orthe pluy, Eo- tire decorum has been preserved, and if sometimes a slight ripple of laugh- ter went through the room at some unexpected incongruity or effort at wit, the thundering call of “gilence’ from the officer of the court, which rebuked this natural effervesconce, seemed hardly nceessary even to vin. dicate the claims of justicy lute submission in her courts, Judge Cox, who, by the way, was | appointed by President Hayes' from tho bar of this city, would he re- graded as a model presiding officor in any court. Tho illustrated papers lave given a very fair impression of his personal appearance, as woll as of all the more noticeablo actors in the scone. He is not one of those offi- clous personages who assert them- selves on tho leust occasion, and rarely interposcs 50 long as counsel succeed in conducting this cuse with- out serious interruption or disagree- ment. His rulings are regarded as almost uniformly favorable to the de- fense, so far as the admussion of evi- dence *is concerned. and in that I to abso : WEDNESDA have not heard that he has been serr ously questionced by the prosccution The marshal and his assistants per form difficult and delicate duties promptly, and well. Just before leav ing Ohio, T met a gentleman « scrved with sucl popularit a8 to insure himself four terims country where there is a full averag number of aspirants for office. He s an old and intimate_pevsonal frierd of General Garfield, WhenI met him | he was in a white heat of indicnation | from just reading a spirited account | of the preceding day's trislof Guitean, “Do you think 1'dlet that devil vo | on that way if I was an officer of the | woriff ina Guiteau—he alw pronoutices his | Gat-o, with the accent of the firat syl Iable and giving the “a” its sound in | rat -~ may be mad, but it is not a mad- ness without method. Thoseumost ob- | servant of the case agree that any vio- | lent suppression of his demonstrations would have been favorable to hins in | carrying out the programme by which he is hoping for acquittal. The de- | fonse, “‘simmered down to a pint amounts to this, that whon a man ac- | copts a formof rehgious belief that ini- | pels him to commit an atrocious, pre- | meditated, diabolical murder, such be- lief 18 an evidence ot insanity, and the more atrocious and unprovoked the murder, the surer the evidence of a mental unsoundness, suticient tosccura immunity from punishment. And there is no use trying to dis- guise the fact that in the atmosphero of the court-room a conviction for the crime of murder is no longer ex- pected. Outside the court-room, in the corridors of the hotels and on’ tho| streets, men discuss the question of | sanity with equal pertinacity for or against, and wind up by saying, “You must give the prisoner the benefit of the doubt.” I suppose they would give a tiger or a rattlesnahe the benefit of a doubt. But what will bo done about it! It is hardly worth while to press the inquiry. Half a million of armed men used to sing: “Well | tree They caught him, but didn't hang him, ‘Ihe hanging of this assassin has | been, commercially speaking, already discounted, hut he takes his meals punctually and reiterates to the jury his joke about having been too woll fed ‘U hanksgiving Day, end not fecling 80 well since. Tt is not surprising that next to the prisoner interest and enriosily conter on his sister, Mrs. Scoville, whose interest m her worthless vagabond brother when he was brought to fac the fate of an assassin secured counsel for his defense and who now watche with untlagging concern the progr of the trial. he sits with the speeta- tors that rim in around the outer cir- cle of tables occupied by members of the press, in no respect remarkable in personal appearance save that the features show unmistakable traces of some great sorrow or prolonged suffer- ing, and a something in the dark eyes that you think you have seen before in places where the occupants are not free to come and go as they wmight choose. Her apparel, modest to abso- lute plainness, suggests anything rather than luxury or affluence. B. J.
