Wasmsoroy, May 4—1 a. m— The president yesterdoy signed the paval appropristion bill, post route bill and bl to place William Gaines, late ordnance sergeant United States army, on the retired list. We are told this is a dangerous precedent to call into question and re-open the title to a seat in the senate, but as Tong asthe senat r sitsherelin violation of the conatitution he would favor contesting the eeat. Senator Carpenter -I would like to Kknow exactly what you mesn. When the senate takes up a case, hears it 88 long as it wants to and then decides it, does the senator contend that such 2 case can be re-opened the next week after and goon forever? Senator Vance—I don’t, but I hold that this declive of “Resadjuciata’ does not apply to this case. As long s justice is not done then the case can and should te re opened en it can be shown that the senator holds his seatat the hands of a mob instead of a regular legielature then he was ready to have his seat brovght in‘o question or that of any other mem- ber. Senator Vest was then recognized, but yielded to Senatcr Saunders, who called up the bill to extend the north- emn boundary of Nebrasks, and the bill was taken up, and after discussion was recommitted to the committee.
