Alphonse” will be played, and Saturday evening “Led Estray.” Reserve your seats at Eberhart’s, Concerning the new play of “Di- vorce,” as acted by this company, the Louisville Courier-Journal, of a recent date, contains the following: The audience present at “Di- vorce” last night was the largest and most fashionable we have ever known congregated in Louisville for asimilar entertainment. Brilliant musical or theatrical stars have drawn as large, or perhaps larger houses, but no mere company, with- out a notable name to head the list, has ever had such & compliment tendered it here. Not only was every seat down stairs and in the galleries occupied but the aisles and lobbies were filled, and hardly stand- ing room at that. The ladies were generally in brilliant toilettes, but hardly in evening dress. It was altogether a memorable entertain- ment in_the history of such affairs here. The company producing “Divorce” is well worthy of this unusual patronage. . 8. Distriot Court. The following business was trans- acted yesterday in the United States District Court, Judge Dundy, presi- Cassius L. Mather, of Red Cloud, and J. H. Lucas, of Culbertson, ‘were admitted to practice. John Roesink vs H C Barret, et al. Dismissed for want of jurisdic- tion. In the cases of the United States 'vs. Robert Pryor and Reuben Mun- ger, found guilty of having in_pos- session counterfeit money with m- tent to pass the same, and who have been in confinement some three months awaiting trial, were senten- ced to pay a fine of $1 and costs and recommitted until November 7th, Found Guilty. Tobias Claus, the discharged sol- dier, who was some weeks ago ar- rested for stealing some small arti- cles from the house of Miss Emma Davis, was yesterday tried at the District Court. The defendant was charged with grand larceny. District Attorney Connell presen- ted the case to the juryin an able and eloquent manner; Mr. J. Osgood Adams, a young and rising attor- ney, appeared for the defendant Mr. Adams made an eloquent ap- peal to the jury in behalf of his client, who had served in the war, and had been honorably discharged. This fact alone it seems entitled the prisoner to merey, and Mr. Adams thought, all things being coasidered, it was no more than fair that he should Ye acquitted. The jury weighed well the logical remarks of the counsel, and after retiring for a few minutes, returned a verdict of guilty of petit larceny, they having found the ar- ticles stolen not to be of greater val- ue than the sum of nine dollars. His Honor, Judge Lake, sentenced the culprit to thirty days imprison- ment in the county jail, to which he was escorted by Deputy Sheriff Hanlon. The favorable verdict of the jury in finding Claus guilty of only petit stead of grand larceny, was un- doubtedly brought about by the elo- quence of Mr. Adams, which over- shadowed in the minds of the jury, in this case at least, the ability and experlence of District Attorney Connell. Mr. Adams was assisted in the case by Mr. Edward Simeral, another young attorney, who is des- tined to rise at the bar. The case of Charles Edwards, charged with burglarizing the Cali- fornia wine store, next came on for trial. The defendant in this case was also represented by Messrs. 1874. United States vs. R. Elliott, found guilty of selling liquor and tobacco without posting up tax stamp, was sentenced to pay a fine of $25 for the first offence, and $10 for the sec- ond, and costs. United States vs. G. Hines, found guilty of selling liquor without post- ing up taxstamp. Sentenced to pay a fine of $25 and eosts. Adams and Simeral. Enterprise and Coal. The Black Hills excitement is still growing, and as any informa- tion concerning the ‘“land of gold” will prove of interest to our many readers, we insert the following from the Sioux City Journal: Mr. F. W. Stone, a young man from New York City, reached Sioux City on the 10th of September, and on the 12th he, in company with two other plucky young fellows, whom he fell in with hera, started out with a mule team, well provis- ioned and well armed, for the Black Hills. Mr. Stone’s party has re- turned. He informed us_ that he went withiz about fifty miles of the Black Hills, und could have gone farther had he been so inclined, but under existing circumstances ' the party concluded that it would be policy to return. They saw Indians every few days, and sometimes the reds made it rather unpleasant for the boys, as they would hover about in such close proximity as to interrupt their forward march, and compel the par- ty to throw themselves in a defen- sive attitude. Mr. Stone says the Indians never attacked them during the night-time, and this he attri- butes to the fact that he had with him a couple of very large hounds that would scent the Indians afar off and would keep up a deep baying while they were in the vicinity of the camp. Mr. Stone and his companions were within about two and a half miles of the scene of the fight be- tween the Brule Indians and the Yankton party, and saw the Yank- ton boys after they got back home. They presented an altogether de- moralized appearance, and every one of them bore some wound or bruise received in the engagement.
