Both Yost and Furay were present. Mr. Lew Hilll, formerly chief postal glerk gf Omaha, was one of the witnesses who {gstifipd in the examination, His testmony was {o the effect that James Stephenson had, in consideration of seeuring & mail contract in which he was not the Jowest bidder, paid him $75. The amount was an orderon Yost and he returned to Hill $42.50, $10.00 of which was paid by Hill to Captain Smith for procuring an as- signment of tha gontraet from ihe lowest bidder. James Stephenson, who listened during a portion of this testimony, called Hills liar, and was going to smash a chair over his head, when Hil] remarked that he could not do it too quick, Hteph- enson's loud talk created considera- ble excitement in the neighho hood, No blood was spilt at Jast accounts, Btephenson, when exam- ined, admitted paying the $75 to Hl, but claimed that it was a check, and declared that he could produce it. He was in- vited to do po, but he finaliy admitted on returning to the room that hecould not find it. Yost put in a point blank denial of this transaetion, and also produced a paper purporting to be an_affidavit from Captdin Smith denying that he (Smith) received $10 00 the Mr. Byerequested Yost toshow him the atfidavit, but the request was de- clined. Wm. Bamberge, formerly maile ing clork to James M. Pattee testis fled that he had seen a vast quanti- ty of lottery ecirculars put up by Pattee’s clorks, and assorted by Btates according to postal regula- tions. They were there stamped and the stamps were cancelled on them in Pattee’s office. Sometimes from five to ten mail sacks well filled with circulars thus stamped and cancelled In_one day: and put into the postoffice reatly for ship- ment. Mp. Hawley remarked that this was somewhat Irregular, but then It was ap accommodation to the postoftice, and saved the clerk’s much labor. Bamberg also testified that he had scen a costly and mag- nificent set of silver plate, which Pattee had purchased and presented to Yost. Mr. Hawley thought there was nothing improper in that. He sald the Assistant Postmaster at Chi- cago was recelving presents nearly every day. Ypst; admitted _the stamping and eanceliig of the cir- culars at Pattee office, as well ‘as the scceptance of the silver plate from Pattee. Bamberge further stated that Yost was in the habit of turmning over all the letters that came to him by mall as postmiaster, inquiriug about the character and reliability of Pattee’s lotteries, to Pattee for answer. «There is nothing wrong in that,” said Mr. Hawley, “I might have done the same thiug," C.
