Notice of any such removal, expulsion or reduction in rank shall be given by the board in writ- ing to the officer or permanent member concerned, who, if agerieved by such re- moval, expulsion or reduction, may, with in ten days after recelving notice of such action of the board, appeal therefrom to the surerior court for New London county, which shall hear sald appeal and render judgment thereon. They shall have power to retirs any member” of the Police or Fire department for mental or physical disabllity and vlace his name on the retired list. as herein- after provided, and such member shall not thereafter be entitled to pay or com- pensation from the city unless assigned to duty by the chlefs of the dspartment. His pay for the time so assigned to duty shall be that of a regular member of his department. The chief of each of the Police and Fire departments respectively shall be the chief executive officer of his department, and shall be chargeabls for its efficiency and responsible for the execution: of &Il laws and the rules and regulations of the degartment. SECTION 61. POLICEMEN'S AND FIREMEN'S PEN- SION AND RELIEF FUNDS. Fow Funds May be Acquired. There shall continue to be a fund for the policemen and a fund for the firemen of said clty, known as the Policemen’s Pension and Relief Fund and the Fire- men’s Penslon and Relief Fund, to which shall belong: 1. All moneys and securities included in the funds now existing in each de- partment. 2. All bequests and donations, from public or private sources, to either de- partment on account of services rendered, or for the purposes for which the fund is established. 3. All mopeys or property presented to any member of either department on account of special services, except such as may, by special vote of the Board of Public Safety, and with the approval of the Mayor, be retained by such member. 4. Such monthly assessments on the salaries of members of the Fire depart- ment, and of the Police department not exceeding two per centum per annum, as the trustees of such fund may determine. 5. Sald Policemen's Pension and Re- lief Fund shall also ‘include .all lost, abandoned, unclalmed, or stolen moneys In charge of the Police department, and all moneys arising from the sale of lost, abandoned, unclaimed or stolen property in charge of said department, now made available for the purpose by the statute laws of the state. SECTION 62. Boards of Trustees. Said Policemen's, Pension and Reliet Fund shall be under the general control of a board of trustees consisting of the Mayor, and the Treasurer of sald cky, and said Firemen's Pension and Reliet Fund shall be under the genera] control of a board of trustees consisting of the Mayor, the Treasurer and the chief of the fire department of said city, and sald boards may invest or re-invest sald re- #pective tunds as the state laws relating to the investnient of trust funds permit. The Mayor shall be the president of each of sald boards and the city treasurer shall be the treasurer of each of said boards, and the treasurer shall be the clerk of the board of trustees of the Po- licemen’s Pension and Rellef Fund and the chiet of the fire department shall be the clerk of the board of trustees of the Firemen's Pension and Rellef Fund, and sald clerks shall keep true and accurate records of the doings of the respective boards of trustees. SECTION 63, How Members of Departments are Re- tired. 1. The Board of Public Safety of said city by the affirmative vote of the whole number of its members, and with the approval of the Mayor, may retire per- manently any permanent member of the Police department or of the Fire depart- ment who, after five years’ service in the department, while in the actual perform- ance of duty and by reason of the per- formance of such duty and without fault and misconduct on his part, shall have become permanently disabled, physicaily or mentally, 50 as to be entirely unfitted to perform ordinary duty. Sald board may also retire, by like vote and with the Mayor's approval, any permanent member of sald departments, who, after twenty years of meritorious service, has become, in the judgment of said board, unable to perform active duty. To such permanent member, retired as aforesaid, there shall be pald from said fund dur- ing his life time, in monthly installments, a sum to be determined by said board, not greater than one-half: the regular vearly compensation received by him in service before retirement. No vote for retirement under the provisions of this section shall be passed until such medi- cal examiners, as said Board of Public Safety may appoint, certify that the dis- abllity under consideration exists. Any vote for retirement may be annulled by aftirmative vote of all the members of said Board of Public Safety together with the Mayor's approval. 2. Should the resources of either or both of said funds at any time become in- adequate to meet the bayments provid~d for in this act, such sums as are avail- able shall be used pro rata towards the payments to all members entitied thereto. 2. All members on the retired list of ald departments shall, in consideration of receiving payments herein provided for, be subject to the ordérs of the Board ? Public Safety, which may at'any time require any of such members. to be re- examined and, in case he shall be .re- ported caprbie of performing duty, may, by the affirmative vote of all the mem. bers of said bodrd and with the Mayor's #pproval, restors him to such seryice in said department as to sald board may seem proper. 4 Any person who shall neglect or refuse to pay such assessment as may be levied upon him according to the pro- | vislons of this charter as a member of elther of said departments shall not be entitled to any benefits from sald re- spective fund. . SECTION 64. Department of Public Werks. Public Work: Beginning on the first day of January in the year.1923 and annually thereatter, the Fiscal® Year of thie department 'of Public Works, aforesaid, shall - be -the calendar year. The : Committes on Public Works and the Street Commissioner of sald city, In office at such time as this charter shall become eftective, - shall continue in - of- fice, until the first day of January in the year 1923 and until their successors, the Board of Public Works under this charter, shall have been’chosen and qual- ified. s The Board of Public Works, aforesaid, Board of *| having the control of the Department of Public Works, shall consist of five res- ident electors of said city, who shall serve without pay, and who shall hold no other city office, and who shall be appointed as follows:—On the first day of Janu- ary, in the year 1923 the Mayor ofysaid city shall appoint two members of sald board to serve for one year, two mem- bers to serve for two.years, and onemem- ber to serve for three years from and after their ‘appointment and until their successors shall have been appointed and qualified; amd afinually thereafter the sald Mayor shall appoint members of said board as explration of terms require, but not more than three members of sald board shall be of the same political party. Said boardshall elect a president from its own number Who #hall preside at.its meetings. Three members of sald board shall constifute a quorum to transact business but a lesser number may meet and adjourn from time to time. Sald board shall hold meetings at least once a month and at such other times as it may detarmine. Special meetings of said ‘board may be called at any time by the president upon reasonable notice to the members, .and ‘shall’ be called within a Teasonable time unon written request of a majority of the members of said board. SECTION 65. Director of Public Warks. On the first day of January in the year 1523, and Dbiennially thereafter, - said board shall appoint a person, with prac- tical knowledge of engineering, for a Di- rector of Public Works, and, except as otherwise provided in this charter, said Director of Public Works, under the su- { pervision-of the Board ot Public Works, shall be responsible for streets, highways, public avenues, aileys, bridges over rail- roads, public grounds, public parks, ex- cepting Mohegan Park and ‘such public parks as may hereafter be acquired by sald city, sidewalks, curbs, gutters, and crosswalks within the limits of said city and the opening, grading, improving, re- pairing, and cleaning the same: and “he shall have charge of the public build- ings In said city used and occupied by the Department of Public Works; and he shall have charge of constructing, Te- pairing, cleaning, ard generally caring for sewers. drains, culverts, slulce-wa; and catch-basins within the limits of said city; and he shall have charge of pub- lic fences, public stairs, public trees ex- clusive of those in Mohegan Park and such public parks as may hereafter be acquired by said city, Yantic Cove. all within the limits of sald city; and he shall have charge of collecting and dis- posing of garbage and ashes within the limits of said clty, and sprinkling and olling streets. Sai2 Director shall have charge of the ‘making and shall preserve all surveys, mars, plans, drawings, and estimates re- lating to all works under the ocharge ot said Department of Public Works. Sald Director, subject to the approval of sald Board of Public Works, shail make all suitable rules and regulations in regard to said Department and the conduct of its business, and he shall ap- point such ' assistants and employes a: the needs of said Department shall re- quire and he shall fix their compensation and the manner of paying the same. He shall appoints necessary clerical assist- ance with salaries to be fixed by the Board of Finance. SECTION wpen Petitions, etc., Relating to Highwaysy Bullding Lines, etc. It shall be the duty of sald Board of Public Works and said Director to take immediate action, hereinafter provided in Sections\118, 120, 121, 122 and 123 of this charter, on any petitior, application, proposition, or resolution. submitted to them by thy Board of Aldermen.and re- lating to construction, alteration, ex- tension, enlargemert, discontinuance or exchange of ~ highways, streets, public walks, -public ‘avenues or public landing placea in sald city and the taking of land therefor, it required; and designating bullding lines ar§ taking land therefor, it. required; and paving, macadamising or improving any highway; and desig- natine silewalks, curbs and gutters, and the taking of land therefor if required; and the laying .out of drains and sewers and the taking of land therefor, if re- quired; and any other public improve- ment not herein mentloned. Aetler -SECTION 67, Removal of Obstractions.
