The first check offered was.in the amount of $708, dated July 24, 1919, and this Mr. Dorsey declared was bart commission on the sale of three piecen of real estate, one on Tilley and Wash- ington streets to James N. and Nellie Kelley: one on Pearl street to Meyer Holandersky, and one on Pequot ave- nue to Thomas A. Scott. OF this amount $600 was ocmmission, said Mr. Dorsey, and $100 was returned as a deposit which he made on some Main street property. Mr. Dorsey was asked concerning each of the 25 checks ag it was present- ad, and his answer invariably was “1 don’t know what Is was for” “It must have been in connection with some of the buriness” or “I eam’t teil, I have no way of identifying it . James N. Kelley testifed that <« bought the property on Tilley and Was' - ington streets for $12,300 and that both Dorsey and Mr. O'Nefll were present during th transaction. Attorney Burrows or re-direct exam- ination asked Mr. Dorsay it he was col- lecting rent for Mr. O'Neill during the perfod in which these checks were drawn and he replied that he was. Mrs. Ella OWefll, widow of James O'Neill, testified that she never knew Mr. Dorsey until June, 1919, although she had heard her husband speak of him and he told her that Dorsey had been borrowing money from him for 25 vears. She declared that he never paid back what he borrowed. As to the sale of the Pequot avenue property to The Scott Investment Co., through Thomas A. Scott, she said that Mr. O'Neill made the sale without any assistance from Dorsey. but she said that Mr. O'Neill gave Dorsey the check for $708 at that time. She declared that $600 of this represented two per cent on the sale price vf the property. but when Mr. O'Neill gave him the he remarked: “Now 1 am making you a present of $600 on this sale, but understand it is merely a present and I am giving it to you because I am sor- ry _that you did not make the sale.” Dorsey had brought Mr. Pomerantz to the O'Neill home &s a prospective customer at $27.000, but the offer was not accepted. Mrs. O'Ne#il could not account for tha $108 extra in the check. Mr{ O'Nefll said that Mr. Dorsay told her at the houss one day that “Mr. O'Neill had given only two per cent. commission an he owed him an addi- tional one per cent,” Witness said that Mr. O'Nedll overheard thi§ statement and entering the room said: “What cid v, Tom?” Witness said that Mr. “I was just telling Mrs Neill that you have paid me two per cent, and that you owe me one fper cent. more.” Witness said that her husband replied, ‘“That was in the sagreemnt, Tom, and you will never get the other one per cent.” to which she claims Dor- sey replied: ‘That's all might, 1 get money from you whenever I want it.” As late as his last illness when she and Mr. Dorsey were at Mr. OWeill's bedside, Mr. O'Neill said he dfd not owe Dorsey a cent, and Dorsey sald: ‘That's right, you don't owe me a cent” Mrs. Dorsey said that when Dorsey came to New York at Mr. O'Neill's re- quest her husband pald him his ex- penses. ¥She said that Dorsey was not vegular in remitting the rents collect- od and she wrote to her son about it Attorney Hull said he propesed to zo into the question of Dorsey's indebted- mess to the O'Neill estate. “The hearing will be oontinued on a date to bet determined later by ths com- missionrers.
