TWhen thé case first cameé into the superior court in Willimantic, Tn the spring of this vear, Attorney W. L. arbie, represénting the town as the counsel, set up a demurrer in which he conténded that Miss Wardell's claim haag ne standing in court bécause she was not possessed of a teacher's cer-! tificate, as requiréd by the laws of! Connecticut, and this démurrer was| sustained by Judge Gardiner Gre who was presiding. Recently, Geary, Davis and Keefe of, New London, repfesenting -Miss War- dell, filed an améndeéd complaint, in which it was set forth tiat Miss Wardell has been possesséd of ‘“‘a writing” in which it was set out that Miss Wardell was competent to teach, but the writing has been lost and its present whercabouts are unknown. Tt was on this amendéd complaint/ that the demurrer argued on Jriday was based. Both Attorncy Darbie | and Attorney C. T Searls, also repre- | senting the téwn, contended that, be- |ing without a certificate, an essential pergujsite under the statutes. Mies [ Ward€li was nét qualified to teach. Torrey, was executor of his father’s (Patrick Kangley) estate, and the plaintift ims that in réaching an agréemént for a compromite settlement with 6th- ér heirs thé executer concealéed the fact that there was a depesit in the Put- nam Savings bank, of $1.017.50, which, they allege, was part of Kangley's es tats, and that they received only $400. éne quarter of thé amount Kangle had on depesit in a savings bank in TWebster, and accepted that as their full share. It as statéd that the amount on deposit in the Putnam bank was in the name of thé executor, who claimeéd it as his own. Attorney C. E. Searls, representing the plaintiffs, is seeking to sécure for his clients one-quartér of the améunt on deposit_in the Putnam Savinzs Bank. Judge Haines rescrved @eci- n. Judsment for $190.21 was givén for the plaintiff in the case of the Federal Grocery company of Woreester v Abraham Mintz, formerly cnzaged in #ss in this eity.
