Judge Biodgett announced that Judge| Barrows was cngaged in a case at Bast| Greenwich that would probably oc- cupy several weeks, that the statutes require a session of the court at Woon- | socket gt this time, and that there- fore .he must open court there on Wednesday. It was probable that he might be ‘able to return to Westerly next Monday and the spare jurors were cxcused until that day. Through attorney, piea was brought by Everett Iitzgerald, of Westerly, for deferred sentence and that he be re- leased from the state workhouse. The\ ple a was granted and a bond of $500 furnished. Assistant Attorney eral Sisson made no_objection. told the court that Fitzgerald had| been arrested for intoxication and placed on probation, that he violated ihe probation. Last December he was rearested, pleaded molo to the charge| of being a common drunkard and was sentenced to serve a year in the state work house. Attorney Sissn said Mr. Titzgerald was a machinist b, trade and could get a job in Westerly his home town, and probably profit by the punishment he had alrea ed. Counsel for Mr. Fitzgerald told the court that his client was not of the type of men who are classed as common drunkards, but at periods he | had overindulged in intoxicants. He! | said Mr. Pitzgerald Liad been employed | |« great many years at the Cottrel | plant and believed would be given em- ployment there as a completely re | formed man from the use of intoxi { cants. THer husband v entioned as residu- | ary legatee under the will, but by rea- son of his death this was imposible, | | and Mrs. Netherwood was not 2 ben | ficiary. At a subsequent session of| the probate court, Mrs. Netherwood filed another will for probate in which she was named as principal benefic- iary. This will was dated December| 18, 1913, was claimed to be the last will and testament, and Mrs. Nether- wood said she found it in a burcau drawer at her home in New Jersey. There were several hearings on both wills before the probate court, and Attorney Samuel H. Davis, rep- senting some of the heirs declared this second will to be a forgery. The re- sult of the hearings was that Judge Edward M. Burke, admitted the will of as the last will and testament of Crandall, practically agres- hat the second will was a_forg-| 7, as alleged by Attorney Davis. JMrs. Netherwood then directed her | counsel to take an appeal from the| | decision of the probate court. The! | case was known in the superior court docket as Bessie Netherwood appellant against Samuel H. Davis, appellee The attorneys in the case were Judge Herbert W. Rathbun and John J.
