In petitioning Justice Philbin ves- terday for an order t{o examine the physicians, the attorneys declared Mrs, Sterry “expects to and can prove by them the following facts.” 1 That on or about Dee, 28, 1911, (the date of the execution of the will), Dr. Gregory and another phy- sician examined Sterry and found he was. insane. 2 That Sterry had heen a perfodie drinker for vears and thar for six months previous to Dee, 28, 1911 he had been excessive in the use of &lce- holic stimuiants, and for six weeks previous te said date was mentally upset. 3 That just previous to the tion of the will Sterry was cated. The contestant was married ts Sterry in 1911, but seon afterward sued for a separation. Sterry an- swer was that his marriage was ii- legal. alleging Mrs. Sterry had not been properly divorced from her first husband, Albert S. Rennie. In Jan- ary, 1413, Justice Newburger de leg in favor of Sterry. Mrs. Sterry applied for a new trial She learned, she declared, that Rennie had been forhidden to remarry by decree of divorce his first wife got, and because of that fact declares her ‘maerriage tc Rennie invalid. = Justice Newburger took this view and di- rected a new trial of the Sterry suit, which was pending when Sterry died.
