MEN ATTEND Forty-Fifth Annual State En- campment at Bristol—Two Mystic Women Sue Auto Company For $10,000 Damages Each—Lussia Hearing Goes Over to Tuesday—Stanton Clark Lively at 93. The Westeriy poisoned whiskey ex- citement of two years ago is recalled by the action of the supreme court of the state of Rhode Island in handing down rescripts sustaining the second counts of the indictments against John De Fonti and John Cisco and wife of ‘Westerly, In which the defondants were, charged with manslaughter. The court adopted the opinion of Judge Blodgett before his death and made it the of- ficial opinion of the court. The indictments were returned ' sgainst the defendants at the Septem- ber session, 1910, at Kingston, and <! that on April 24 of that year De Fonti “unlawfully and negligently mold a certaln quantity of wood alco- hel, & deadly poison, which was mixed and mingled with other Iliquids and ]hgxors, to Timothy Riley, instead .of whiskey, which the said Riley request- ed De Fonti to dellver to him, to be drunk by his father, Michael Riley.” It is further charged the liquid caused gl’:eodul.h of Michael Riley on April 25, 10. The charge i mimilar in the Cisco ease except that it is alleged the de- Mvery of the poisonous liquid was made direct to Daniel Sullivan, who was killed by drinking it. Manslaugh- ter is the nature of the charge. The court holds that the first count of the indictment is defective becnuse it does not charge the accused with knowledge of the poisoning of the liquor. The second count in each in- dictment, however, is held to be suffi- e¢lent. The cases went to the supreme court on questions of law raised by the defendants’ demurrers to the in- dictments. The papers in the case will be sent back to the superior court for Washington county for further proceedings. Budlong post, No. 81, of Westerly, Grand Army of the Republic, was rep- resented at the 45th annual encamp- ment of the Department of Rhode Isl- and held Thursday in Bristol by Chris- topher Simmons, Paul H. Hillard and Charles A. Clarke. The session was held In Bristol in honor of the retiring department commander, Ezra Dixon, who resides in that place. There were business sessions in the morning and afternoon and a banquet was given in the evening, at which the guest of honor was Commander in Chief H. M. Bradley and Annie Brad- ley, both of Mystic, heve filed suits or $10,000 each in\the Rhode Island su- perior court against the Nock Auto company. The plaintiffs claim that they were invited by the defendant company to ride in one of the compa- ny'’s automobiles at East Greenwich Nov. 11, 1911, and that the machine ran into a sandbank and was upset. Both allege that they were permétnent- 1y incapacitated as a resudt of the mis- hap. The hearing in the case of Bernard Lussia, charged with shooting with in- tent to kill and murder Antonio Bal- lardi, which was assigned for Thursday in the Third district court, has been continued until next Tuesday, as the injured man was not able to appear in court. Ballardi is in the Rhode Island hospital suffering from three bullet wounds. It is believed he will recover, but it is not probable that he will be discharged from the hospital for sev- eral weeks. Lussia is in Kingston jail in default of bonds of $5,000. It is understood that at the hearing effort will be made to reduce the bond, which will be furnished by the em- ployers of the accused. At the trial counsel for accused will conduct the case on the basis of self defenge. J. Irving Maxson of Westerly was elected president of the Isle of Pines Co-operative Fruit company at the an- nual meeting of the stockholders held Wednesday in Boston. The other of- ficers are: H. B. Humphrey of Milton, vice president; P. J. Evans of Newton- ville, treasurer and general manager; Charlas F. Dudley of Malden, secr tary; William J. Pelissier of Wakefield, assistdnt secretary.
