GEG S S0 GEETHVVEHLVGILL VIO EOT Vlrly Case upreme‘ Court Defendant Chauffeur’s Exceptions Overruled—Case Goes to Superior Court for Sentence—Liquor Cases Con- tinued—Baptist Rally Day Services—(lerk Crandall’s Salary Increased. The supreme court of Rhede Island handed down Thursday afternoon a rosceipt in the Westerly case brought agalnst John Welford, for driving sway without stopping after he had knowingly caused an accldent on the ‘Watch Hill road, by rumning his au- tomobile into a horse and wagon. The defendant’s exceptions are overruled and the case is sent dback to the su- perior court for sentence. The complainant, Chiet Bransfleld, oharged that the defendamt on August 1. 1968, “a!d not after knowingly caus- ing an accident by collision with a team on the highway, driven by one Frank Collins, forthwith bring said motor vehicle to a full stop or, return to said scene of said accident, but then and there voluntarfly and without excuse drove said motor vehicle away from said scene of said accident, with great speed, against the statute,” etc. The defendant’'s motion to quash the complaint was overruled In the su- perior court and exceptions taken. The defendant was found guilty by a jury, and the defendant's motlon im arrest of judgment wag overruied by the pre- siding justice. The ci went to the supreme court on the endant’'s ex- ception to the ruling of the superior court. The question involved imciuded the sufficlency of the complaint and whether the facts stated therein con- stituted an offence agalast the laws of the state, Considerable interest has been #hown in the outcome of this case in view of the frequency with which au- tomobiles s away from an acci- dent, In its rescript the court says en opinion is to follow later. Attorney Harry B, Agard, the pros- ecutor, objected to this unusual mode of procedure and stated that the state was ready to proceed, Judge Willlamg stated the position of the court fn the many points as they were raised, and finally decided to deny the request of Mr. Ledwidge that he be given time to consider but asked for continuance, what he intended to do, eepecially as | no appearance had been made in court as claimants for the seized vessels and liquors. The eourt then called the liquor selz- ure cases, of both Gavitt and Almy, for trial. Mr. TLedwidge made ap- pearance in both cases, and asked that they be continued for one week.
