10 THE COUNTY CLERKS. PREPARING FOR BATTLE--MESSRS. ‘THOMPSON AND GUMBLETON SCANNING THE SITUATION— VIEWS OF COUNSEL. ‘There was less excitement in public places yester- day concerning the removal of Mr. Gumbleton and the complications growing out ef it, There were the same crowds gathered about the public offices which were to be seen since the trouble began, and rumors, if anything, were more plentiful than before, ‘here seemed to be a strong sentiment expressed on all hands that the Governor's action was pertectly proper and legal in removing Mr. Gumbleton; ‘but it was equally strong and general in condemning the forcible entry of the office by Mr. Phompson and those whom he called to his aid, In reference to the lutter it was said by many that there is not a shadow of excuse to be urged for their course, as they were civilians in no way interested except by sympathy. Much speculation was indulged in as to the future disposition of this matter, and Justice Dufly’s decision on the application to release the ac- cused on bail, which will be delivered on Saturday, is awaited with considerable interest by not only those concerned, but the public generally, THE NEW AND THE OLD. Mr, Thompson, the new County Clerk, was at his office until late last evening, surrounded by several intimates, among whom were Thomas Costigan and Emanuel B, Hart. Mr. Thompson, when addressed about the Harlem ,Police Court proceedings, spoke flippantly, remarking that ‘tit was only fun for us.” Ho said that phase of the aflair gave him very little concern. The police guard at the door of his office is still maintained, but why this precaution is still taken is not clear. No removals were made, but it is eaid that the pressure for appointments is so great that several ivportant changes will be made on the Ist of April. Mr. Thompson said last evening that there were no new developments and that both sides are resting on their oars until Justice Duffy’s opin- fon 1s rendered. Mr. Gumbleton spent the greater part of the day m consultation with Mr, Mitchell, his counsel in the police court proceedings, Mr. Gumbleton was reti- cent us to the next step to be taken after the decision of Saturday on the question of accepting bail, and said that in the meantime matters are im the nature of an armistice. Mr. Mitchell severely criticised the claim made on the other side that no eximuation of wit- nesses should be gone into. ‘Taking up the Second Revised Statutes, he pointed out sections 1 and 2 in support of his position, which read thus Whenever complaint shall be made to any iia i trate that a crim 1 offence bas been committed it 5] on Be the duty of such magistrate to examine on oath tI Compluinart ‘und any withoasos who may be produced by ~ Section 13 provides, on the same point, that “the magistrate before whom arty such person shall be Drought sbail proceed as soon as may be to examine the complainant and the witnesses produced in sup- port of the prosecution, on outh, in the presence of the prisoner, m regard'to the offence charged and in regard to any other matters connected with such charge which such magistrate may deent pertinent.” “That,” Mr. Mitchell remarked, “should satisty any one that we stand on perfectly tenable ground.” Mr. Mitchell went to Albany last evening on some mysterious mission in connection with the pen Clerk matter. ‘The natute of his errand coul *mot be ascertained, but it is believed to have some connection with the appeal of Mr. Gumbleton to the Legislature asking for the appointment of a special committee on its part to investigate the whole subject of his removal, which ‘was introduced in the Assembly yesterday, and which communication also charges Governor Robinson with having acted in # partisan, unfail irit. Itis @pparent that Mr. Gumbleton and his immediate counsellors are determined to employ all channels Bud sources to work up-public sentiment on the sub- fect. What this may result in is food for gossip and conjecture, especially as the charge brought against Mr. Thompson is so entirely novel, there having been, it is asserted, but three such cases—that of “misdemeanor in taking possession by torcible entry and detainer’—ever brought in the courts of this city. EX-COUNTY CLERK GUMBLETON APPEALS. TO THE LEGISLATURE FOR A COMMITTEE OF IN- VESTIGATION—TEXT OF HIS MEMORIAL, ALbany, March 26, 1879. A memorial was received in the Assembly this afternoon from Henry A. Gumbleton, late County Clerk of New York, which, after reciting the pro- ceedings hadin his removal, asks for a special com- mittee to investigate the case. It was read in due course. Mr. Holahan offered a resolution to appoint such s committee. Mr. Strahan, rising to debate, the resolution went over. The following is acopy of the memorial :— ‘The undersignod, Henry A. Searcely had the audience deserted the galleries and auditorium of the Grand Opera House last night when an alarm of fire brought the fire engines to the spot, causing « great commotion in the neigh- borhood, as it was supposed that the premises were burning. Frank Mayo had been playing Davy Crockett, There was ® full house, and had the accident hap- pened fifteen minutes carlicr, in all probability there would have been # panic and a great loss of life. The house was almost empty; a fow stragglers were atill in the gallery and lounging around the vesti- Ddule, A man, whose name could not be ascertained, when passing out at the lobby on the Twenty-fourth street entrance, lit his cigar, and threw the unburnt end of the match away carelessly. It fell in # crack in the partition, where a defective gas pipe was located, It igni the escaping gas, and @ loud explosion followed. The attaches of the theatre applied a Habeock fire oxtingwishor to the flames, ond a signal was sounded for the Fire Department contingents, They promptly respon to the call, but on their arrival the danger had i. The entire structure was filled with smell of the burning wood and the smoke was dense. The woodwork around the pipe foran area of ten feet was consamed.
