Wrangling Over the Estate of an Alleged Lunatic A DRUNKEN HUSBAND. The Police Commissioners in Wholesome Fear of an Indictment Mrs, Diana Bannister, a childless widow, was in April last adjudged a lunatic, A motion to set aside the lunacy proceedings resulted in the appointment of & second com: to investigate the question ot her alleged lunacy. This second hearing ter- minated in aconfirmation of the previous finding, which was followed by the appointment by Judge Daniels of Samuel Goodwin as custodian of Mrs, Bannister’s person and estate, which was valued at $15,000, and her commitment to the Bloomingdale Lunatic Asylum. She remained ini the institution thirteon weeks and was then given in charge of her sisters, Mrs, Jane Giles and Mrs. Ann Elizubeth Ely, who live at No. 71 Huron street, Greenpoint, L. I., the arrangement being that they should be paid $10 a week for her board and care. In these lunacy proceedings Mr. Everett P. Wheeler appeared for Mrs, Bannister and Mr. George W. Wilson for her sisters. Mesurs. Hillier & Hodges were appointed referees to pass on Mr. Goodwin's accounts, It would look to the ordinary mind as though ,the above proceedin; would terminate the case in the pent except the adjustment of the committee's accounts. It was not so, however. Motions and counter motions followed other in rapid succession. Sitting after sittimg ensued before the referee. As natural, then came the footing up of the bills, beginning with the expenses of the lunacy Proceedings and wind- ing up with the lawyers’ fees. The inroads on the estate altogether being something formidable. These various proceedings in court were continuous un- til there came the culminating motion for the re- moval of Mr. Goodwin as the committee. A slight turning of the tables followed. Mr. Wilson now ap- as counsel for Mrs. Bannister, Messrs, Am- rose H. Purdy and Robert J. Pollock tor the sisters, and Mr. Henry, Cooper for Mr. Goodwin. This mo- tion came up for argument yest pefore Judge Lawrence, in Le me Court, Chambers, Volumi- nous counter affidavits were made and the counsel talked with afreedom and acerbity unusual even in courts of justice. Mr. Purdy, for the motion, in- sisted that the bond of Mr. Goodwin was null and void through lack of proper attestation. He even went so tars as to hint at forgery in the document, “The gentlemen may any bond they sar interrupted Mr. wilson,“ “and we will accept “It. is. well enough to say that now, w! this motion is under argument,” retorted Mr. dy, “but I imagine you wili sing a ditferunt song should we present a new bond. The fact is, this man Good- win if a rupt, and that should end the bond question.”” Mr. Purdy then went on to say that as things looked now there would not be a dollar of this estute left soon, and he charged Mr. Goodwin with allow- ing exorbitant tees to counsel and payment of other Veagannt “It's the very who make this motion,” insisted Mr. Wilson, “‘who are spending the money.” “All we ask,” said Mr. Cooper, ‘tis for the Court to wait the report of the referees appoiuted to pass on Mr. Godwin's accounts, and if they find that he has poems a dollar improperly we have nothing more Goodwin has made some mistakes, but they are the resuit of ignorance.” “There has been some stealing soniewhere,”’ re- torted Mr. Purdy, “and I think it time for the Court to interfere.” “The gentleman is right,” sadd Mr. Wilson, ‘about pera ¥ He gent a spy to my otlice, who stole sumo my papers, and not eee with that stole a Giniaoud ring from my drawer.”’ After some further argument and interchange of other professional courtesies between the counsel Mr. Wilson read an aflidayit of Mrs. Bannister, stating that she was kept inacold room at her sis- ter’s one, in Greenpoint; that she was allowed no fire; that she was kept on starvation diet, and wind- ing up with # recital’ot her rescue m the house by Mr. Goodwin a few days since, as already fully published in the Hxranp. “You proved this woinan to be insane once, didn’t you?” asked Mr. Purdy, addressing Mr. Wilson. “Yes,” answered Mr. Wilson, “and I am now going to prove her sane. Her reason was only slumbering temporarily, but she has now woke up to the at- tempt to wrest her estate from her by her sisters, and she swears that neither of them shall ever re- ceive a cent.” ‘Lhe only course the other ‘side seoms to have,’ said Mr, Purdy, “is to abuse everybody; but that’ no argument.” The eps lasted some two hours, at the end of which Judge Lawrence took the papers, reserving his decision. . THE CIVIL DAMAGES ACT SUIT. ‘There was resumed yesterday, before Judge Dan- iels, holding Supreme Court, Circuit, the trial of the suit brought under the Civil Damages act by Mrs, Hannah L, Soully against Daniel Buckley, proprietor of the liquor saloon, No. 404 East Eleventh street, tor $2,500 damages for selling liquor to her husband from January 1 to July 1, 1877, resulting, as alleged, in his constant inebriety, aud thus preventing his contributing anything for the support of himself and family. In the court room there was a large representation of liquor dealers, attracted there by a natural feeling of interest in the final result as likely to affect their sales of liquor in future to men of fam- ilies. Ex-Judge Culver represented the plaintiff as counsel for the Society for the ‘Prevention of Crime, and ex-Judge Dittenhoefer the defendant. “For how long 8, period has your husband failed to contribute anytuing for your support?” was among the questions asked Mrs. Scully vy vudge Ditten- — it yeurs,’” answered the witness. ‘mee long has he been in the habit of drinking?’ “Fitteen years.” Mr. Buckley swore that during the time men- tioned in the complaint he did not seil any liquor to the plaiutif’s husband, and, what was more, gave orders to his bartenders not to do vo. The latter statement was corroborated by the bartenders. Another witness swore that he helped Mr, Scully while drunk to his roome in 1862 Some rather amusing features presented themselves in the course of the summing up. Judge Dittenhoefer, in i course of his remarks, quoted what Judge Van Brant, in a similar euit recently brought betore him, said of the act of 1873 authorizing these suits, pro- mouncing the man who drew the act an ass and the men who passed it fools. In this connection be said that he had no respect for men who in the Legislature clamor for such j&ws, and no sooner are their apeeches ended go to the nearest bar and take adrink. Ex-Judge Calves, in his reply, said that they did not make raids on all liquor deal- ers, but simply ere to enforce the law. The trial of Elen McDonough on the charge of re- ceiving stolen goods, having, an alleged, been cognizant of the fact that her thirteen-yoar- old daughter Mary, employed ss a cash girl in the establishment of Kk. H.
