SENTENCES FOR MANSLAUGHTER. John Brown, the Italian, who was convicted in the Court of General Sessions late on Thursday night of manslaughter in the fourth degree in having killed John Regallio, a fellow countryman, with a club at No. 16 Baxter street on Christmas night, was called to the bar for sentence yesterday morning, by Assistant District Attorney Herring.. The accused, a sharp featured, wiry little man, was ao foreman in Durand’s looking glass factory and his victim an organ grinder. During a carouse Brown became enraged and attacked Regallio with a macaroni roller, with which he beat him on the head, Brown bore by no means 4n enviable character, hay- ing been concerned in sevaral affrays, When the jury retired they stood eleven to one for convic- tion of manslaughter in the third degree, The dis- senting juror held out for four hours, and finally concurred with his associates as to the guilt of the prisoner—the degree, however, being reduced to manslaughter in the fourth degree, This escape was cousidered @ lucky one for the prisoner, His counsel, Mr. Howe, before sentence was im- posed, ealled the attention of the Court to the good character that had been given him by his former employer. In passing sentence Judge Cowing observed that the jury in the very mud verdict rendered had exhaus all the mercy that could be shown. Under the circumstances it was the duty of the Court to impose the full penalty of the law—two years in State Prison at hard labor. Peter O'Rourke, 4 canal boatman, convicted a few days since of causing the death of a lad named Denis Sullivan, was called up in Part 1 of the Court of General Sessions yesterday for sentence. ‘The tacts developed on the trial were that Sullivan und two other boys were fishing at the foot of pier Kast River when, provoked by some trivial cause, ‘the accused threw a brick at them, Sullivan reeeivingt the blow on. head, which caused him to fall into the river, when he was drowned. In extenuation, it was urged that there was no intent to cause death, The jury returned # verdict of manslaughter in the third degree. In view of the previous excellent char- acter of the prisoner Judge Gildersieeye impored the mitigated penalty of two years in the State Prison at hard labor. A STORY OF THE SEA, A libel was granted a day or two ago in tho United States District Court, by Judge Choate, against the bark Augustine Kibbie, and the vessel was seized by Deputy Marshal Jeffries while unloading a cargo of sugar at the stores in South Brooklyn, The libellant, Frederick Miller, alleges that he was engaged ax ono of the crew of the Kibbie for the voyage to South Australia and return to this port. The bark sailed from New York November 6, 1875, Shortly after her arrival in Port Adelaide Miller alleges that Captain Puineas ¢ ,ina fit of anger and while intoxi- cated, turned the whole crew ashore without cause and would not permit them to return. it is further alleged that Captain Carver then cngaged @ se crew and sailed for Plymouth, England. Charles Bernstein and Abraham D, Freeman, con- victed of arson in the first degree in setting fire to the tenement house No. 11 Ludlow street, were yes- terday brought before Judge Barrett, in the Court of Oyer and Terminer, for sentence, Both prisoners looked very thugh depressed and had evidently made up their minds for the worst. By their sides were also seated their respective wives, in whose countenances were also exhibited the deepest anxiety as to the final result. Mr. Edwin M, Fox, counsel for the prisoners, moved for an arrest of judgment, which was denied, as was also a subsequent motion for a new trial. On being asked if they had anything to say why sentence should not be passed Freeman averred his inno- cence of the crime charged, and attributed his con- viction to the pre, of the District Attorney and Vire Marshal. Bernstein indulged in quite extended remarks. He also avowed his innocence and averred that the fact of his innocence would one day be proved. He begged for mercy on account of his poor parents. . In passing sentence Judge Barrett spoke at some length. He said that the case was so clear, so abso- lutely convincing against the prisoners, that it was positively dificult to charge the jury without seem- ing to close the door against them. As a public magistrate he felt bound to say that their conviction was just, and he hoped that its effect might be wholesome to the community in view of the grow- ing prevalence of incendiary fires, He then sen- tenced both prisoners to State Prison for life. They found him at No. 49 Lexington avenue, where he has been residing while attending lectures at the Twenty-third Street Medical College. Morett, according to the complaint, took a trip to Schoharie county some tine since, and while there made morry with various marriageable young ladies, whom he drove about in carriages and other- Wise ontertained, ‘The bills, however, it is alleged, he was laggard in settling, and the Sherif of Scho- harie came to this city armed with a wartant for his arrest tor false pretenses. ‘Lhe detectives took the prisoner to the Central Office, where he was turned over tu this oilivial, WEIGHTS AND MEASURES, A committee of the Board of Aldermen, consisting of Messrs, Strack, Burns and Foster, met yesterday afternoon for the purpose of acting upon a resolu- tion introduced in the Common Council a short time since in relation to regulating the charges exacted by the inspectors of weights and measures, Mr. Jackson 8. Schultz, Mr. Mills and other merchants were present, Mr. Schultz, in his remarks, pleaded for the abolition of the system of trying to compel citizens to be honest by providing for the inspection of all measures of quantity. He favored the intro- duction of a bill in the State Legislature which would abolish the office of weight imspector, The city should not put a seal on a man’s measures certifying to their correctness when false weights could be sub- stituted for the correct ones when the inspector had departed. Mr. Schultz denounced the course pur- sued by some of the inspectors, and said he would like to see “this last remiunt of barbarism disappear,” Mr. Hill said that when Mr. Jacob A. Banta, one of the inspectors, visited his store he certified to the correctness of a large scale, although the weight was false. ‘This statement Mr. Banta subsequently ¢ nied, and recounted the many disadvantages under which the inspectors labor.
