I really must object now!” said the prisoner's counsel to Judge Otterbourg at the Jefferson Market Police Court yesterday. “Object! Object if you like, Keep on objecting; but what good will that do your client?” replied the Court, “Your Honor, this I know is an honorable court, and you, pardon me, are, I'm sure, a just man! (Rais- ing his hand deprecatingly.) Nay, 1 know ‘tis writ that flattery is food for fools, but wise men some- times partake of it, So, I'm sure Your Honor will not find fault with me for saying Your Honor is not only a Justice but just! Now, sir, I'm @ young man, climbing the ladder of fame and, perhaps, somewhat too anxious tor my client's welfare; but this gy will—nay, must attribute to overweening loyalty to my cause and freshness. As Mr. Harry McDowell and Mr. J. J. Rowan Spong, two theological students, were seated in their room in the General Seminary, in West Twentieth street, last Wednesday night, they were suddenly startled by a loud noise, which sounded like an explosion, and by a general scattering of small pieces of glass all over the room. Springing to their feet they found that a pane of glasa in the lower sash of one of their windows had been pierced bys bullet, Contin on its course the had crossed the room an struck a volume of “Grote’s Histo: Mr. McDowell's library, and then The ball was evidently almost spent as 07 lead mark was discernible on the book and hole in the window pane was about as large as a silver dol- lar, the rest of the glass being considerably shattered. ‘The line of the shot across the room, which is on the top floor, would point to some of the houses on Twenty-first street opposite, but from the spent con- dition of the ball it is more than probable that it was fired from the sidewalk. It might even have been fired from a strong rubber oe gre and have pro- duced the same effects, If it struck any one in the room ean! a slight scratch could have been caused, All parties laugh at the idea of an “at- tempted assassination,” aud in looking epee the pepttes asajoke. PROVISIONS OF THE STATUTES. ' ‘The law on the subject, as found in the Revised Statutes, is as follows: — 1.—All persons whatsoever, charged or trusted with the disbursement or application of money, goods or effects of any kind for the benefit of the Indians, shall settle their accounts, annually, » at the Department of the Interior, on the Ist day ot October, and copies of the same shall be laid before Congress at the commencement of the ensuing sea sion, by the proper accounting officers, together with alist of the names of all persons to whom money, olin year for the Doneft of the indians, specitying = ceding year for tl tit of the 8, spec: See me seal ail nttiont ton ckton dling wera tape : and showing who are delinquents, if ‘any, in forward: ing their accounts, according to the provisions of this sectio SEe. 2, om, “xo superintendent of Indian affairs or Indian agent or other disbursing officer in such ser- view shall have advanced to him on Indian or public account any money to be disbursed in future until such superintendent, agent or ote in fee service has settled his accounts of the ear, and has satisfactorily shown that all ieee favor of the government, which may appear to be on his hands, are ready to be paid over on the order of the Secretary of the Interior. Suc, 5,491.—Every officer or agent of the United Stutes who, having received public money which hi is not authorized to retain as salary, pay or emolue f ment, fails to render his accounts for same. ag * provided by law, shall be deemed guilty of embezzle- ment, and shall be fined in a ean equal to the amount of the money embezzled and shall be im- prisoned not less than six months or more than ten years. REGULATIONS PRESCRIBED. ‘The regulations, which are published in pamphiet form (edition of 1877), are as follows:— PanaGrarn 47.—All disbursing officers of this de- partment are required to render their cash and pro} erty accounts a8 soon after the expiration of eac uarter as practicable. A delay of more than thirty ys after expiration of 6 eee in rendering bean accounts red subject the juent officer to ings under section 5,491 Revised Statues, in'od Of the public funds and his surety for the re- covery of the public funds and property in his verre PARAGRAPH dal care must be taken in disbursement vee public moneys to prevent misay pie cation of funds. No sufficient excuse can be o! for misapply ing funds received by iit from this office, ith each notice of the issue of such requisition there is # tabular statement and a especial letter of instructions setting forth clearly ay the applicability tune under each head sub-head of aj Le hae and even the objects for which they be used. Furthermore, at pre where funds are provided under treaty stip the treaties generally Pececrine' ta cntie On ee pending such funds. * * * ParaGrarus 70 anv T1.—The rules of the Treasury require disbursing officers to report at the close of each week and month the balances of public funds in their hands oron deposit. These reports must con- tain a correct statement and be promptly forwarded every Monday morning and on the first day of each month respectively. In addition to the above quoted laws and reguls- tions there are others of minor importance fod to matters of detail that need not be further referred to here. HOW ACCOUNTS ARE SETTLED, ‘The accounts of agents having reached the Indian office are critically examined and referred to the Board of Indian Commissioners, any member of which “is empowered to investigate all contracts, expenditures and accounts in connection with ihe Indian service." (Act May 29, 1872.) They are then transmitted to the Second Auditor, with a memorandem of whatever ex ceptions may have been taken to them on account of errors or other irregularities. In the Second Auditor's pede still closer scrutiny awaits them, and eventu- jhe Second Comptroller overhauls them and ipponte his certificate to the final result, ‘he agent, whe who in Pi od ngyens Page ogg to be service long before the quadruple pana ant mill has ground his papers inte shape, is then notified that his accounts have been “adjusted” and is furnished with an itemized statement sho what vouchers have been “sus pended” or * wed," with the reasons therefor. fo will be seen from the foregoing that if there be even the shadow of crookedness in an Indian agent's secumame teanges Coe tteceed in cone Ox thee os ie examinations to which these accounts are subjected, It may be s question whether the United States derive any benefit from this four-barrelled system of exami- nation, but it is certain that the delay caused thereby is unfair to the Bee! bondsmen, whose liability is not determined by any statute of limitation, and who often find the: ves defendants in suits brought by the government to recover balances fitteen or twenty years after date, It may here be noted that, as the War Department has no board of officers analagous to the Board of Im dian Reggae enn the accounts of army to me examination only—namely, first, undergo a triple nd iy Second or Third Auditor, Tah third. by Comptroller. HOW THE LAW 18 OBSERVED. ‘After what hes been atssed above itis count to add that the law which requires Of Indian agents to be settled annually on the of October is nm bitsy wih the pe re would bes bre vaical —— wi present mac! fa yr eonll baggy Aeop these accounts adj as Fave bed up to as the law evidently templates, Property, like money, is accoun' A arvigs 4 the returns and v tango meron on pres scribed by the army regulations. the nensea! are interpreter and two enabanentek si to all issues of su Lad affidavit of one or moro tiditn to" tho ertiata of tt ont, im bl gg 2 “whether do seat strayed, stolen or dead.” Indian property accounts receive @ much more careful ¢: the ee ae Department than they yee a few year ayo, as will be ween by the following extract from 4 recent report of the Second Auditor :— “A nae Weer Rocke Tae Beek opened, jn nich 0 record is kept of all articles purchased for the dian service and for through this office, showing the date of pure! the description and price goods, the amount paid for transportation from the place of purchase to the place of ‘livery, etl alae tor which the articles ure intended, the name of the agent who receipts for them, ‘This record answers @ double purpose. It enables this office to prevent any overpayment on account of the transportation of Indian goods 4nd supplies, and it shows exactly whee articles each agent must ac coun’ for on his property returns. With such a record as this, properly kept, it seem that nothing short of fraudulent and for vouchers would enable ae to excape a full se countability for every of public property im trusted to his care. RIVER PIRATES AL WORK. Between a quarter to four and four o'clock yester day morning the safe of the Hoboken Ferry Company, at Hoboken, was robbed of about $300, The safe stood immediately inside the door of the wooden storeroom in the ferry house, between the two Barclay street slips, It is the custom to place the receipts in the safe at different hours of the day and night, and to remove them early in the morning, when they are taken to the come # offices, ou boxes containing the receipts had locked the safe, and the thieves carried off the contents ai except one. There are employed at the ferry house during the night a bridgeman and another man who is supposed to keep @ eral watch around, Be tween three and four o'clock in the morning it is the duty of the latter to go to the residences of the ferry hands to wake them for duty, and it was while this watchman was away that the robbery occurred, The money could not have been stolen from the safe ex vept during the brief time it was necessary for the bridgeman to attend to the arrival or departure of of the ferryboats. The only way the thieves ‘could have entered the ferry house, a» is surmised, was to row in under the gil James Rumsey, whieh was lying during the night in one of the street bon ag oa sneak around to the office of the storervom during the absence of the brid mye is generally stationed there. The case was the hands of Captain Donovan, of the Hoboken xesterday morn, who is now wt work ow bt its
