NEW YORK HERALD, THURSDAY, DECEMBER 5, 1878.-TRIPLE SHEET. THE COURTS. A Suicide's Widow Fighting for His Life Insurance, IMPRISONED FOR BIGAMY Important Decision by the Common Pleas, General Term. On the 15th of April, 1876, the community imme- Mately surrounding Central Park were very much shocked at the discovery of the body of aman hang- ing by the neck on one of the trees in the Park. ‘The suicide—for such he proved to be—had with great ®pparent care torn his handkerchief into three separate pieces, one of which he attached to the tree ‘nd then winding another piece around his neck tied the three together. He then placed himself on ® huge stone, which he had previously carried to the spot, and after thus having fully prepared himself, kicked the stone away and in a few moments, as is supposed, was strangled. This man was Isracl Ferguson, who years ago ‘was quite a prominent merchant in this city. Pre- vious to his death thus contrived by himself Mr. Ferguson had, on the 15th of June, 1864, taken out an insurance on his life in the Manhattan Life Tnsur- ance Company for $10,000, His widow, Ellenora A, Ferguson, has now brought a suit against the insur- ance eee, y to recover on the policy, alleging in her complaint that the premiums had all been regu- larly paia for cleven years preceding the death of her husband, and tnat the company had refused to pay the amount of the policy, The company claim that the suicide of Ferguson vitiated the policy, inasmuch as it was specially provided against in the mstrument Iteclf. and also sets up a counter claim of four separ- ate notes for $100 each, made by the deceased in his lifetime to the company, and which were never paid. Plaintiff makes o reply denying any knowledge of the counter claim. ‘The trial of the case was com- Mmenced yesterday before Judge Larremore in the Court of Common Pleas. Considerable difficulty was experienced at the outset in spctring % jury, each fone being interrogated by counsel as to his re- tions with insurance companies, and whether he believed that a person who committed suicide was under all circumstances necessarily insane. After the jury ‘y had been empanelled, however, with churacter- ic promptness by Judge Larremore the examina- tion of witnesses was at once proceeded with. The trial is an interesting one, involving, as it does, intri- tate questions of insurance law, end will probably oceupy several days. Mr. Joseph O. Brown appears for the plaintiff and Messrs. Fellows, Hoyt & Schell for the defendants. ONE WIFE ‘TOO MUCH. On March 3, 1867, a horseshoer named Michael Mc- Donough was married to Catherine McKeon by Rev. Father Healy, in St. Peter's Catholic Church, It was alleged that McDonough treated his wife harshly and at last abandoned her. His wifo, after the abandon- ment, went to reside with her parents and saw nothing ot her husband until 1873, when she met him at a funeral at Calvary Cemetery. He asked her to live with him once more, which she declined to do, For some years she saw nothing more of him, but recently learned that he had married Miss Catherine Smith, of No. 286 West Eleventh street, the ceremony having been performed July 29, 1876, in St. Luke’s Church, Hudson street. In September last Mrs. McDonough had Michael ar- rested at No. 357 Hudson street. The accused was ar- raigned yesterday in Part 1 of the Court of General Sessions on the charge of bigamy, to which he pleaded guilty. His counsel set forth that McDonough had tnjoyed an excellent character and married the sec- dud wife under the erroneous supposition that after a lapse of ten years he could remarry while his first wife was living. Judge Gildersleeve imposed the ‘mitigated sentence of one year in the Penitentiary. THE PROPERTY CLERK'S TREASURES. Among the more important decisions just handed flown by the Common Pleas, General Term, is that in the case of Ella M. Lynch against Charles A. St. Toha. The plaintiff, itscems, sued the defendant in the Marine Court to recover a diamond ring and gold thain which had been brought to defendant as prop- erty clerk at Police Headquarters by a policeman, 8t. John reftised to deliver the property to the Sheriff in obedience to an order of the Court, claiming that as these articles were delivered to him under the pro- ‘visions of the charter of 1873 no action of replevin would lie against him. ‘The defendant then wmoved that the Simpsons, pawnbrokers, who made ‘claim to the jewelry, be substituted in his place as defendants. Judge McAdam denied the application on the ground ‘that it was the duty of Mr. St. John to obey the process of the Court, and that the Code had axons the course to be pursued where proper- ty tik ‘ht to be replevined was claimed by another per- won. The Gencral Term of the Marine Court reversed the order of Judge McAdam, without giving any rea- son for their action. The General Term of the Court of Common Pleas have now reversed that reversal, hold- ing that Judge McAdam was right, and saying that the position taken by Mr. St. John woula make him the perpetual custodian of all property in his posses- sion as Property Clerk. SUMMARY OF Ly LAW CASES. In the suit of Havemeyer vs. Havemeyer, which has been on trial before Judge Van Vorst, in the Superior Court, tor the last two or three weeks, there was con- cluded yesterday an argument on a motion made on behalf of the defendant to dismiss the complaint. ‘The Court reserved its decision on the motion until this morning. Mrs. Isabella McKenna brought suit in the Marine Court %o recover damages against the Eighth Avenue Railroad Company for being compelled to get off one of their cars, which was tried Lefore Chief Justice Alker and a jury in the Marine Court yesterday, Mr. Christopher Fine appearing as counsel for the plain- tif and Mr. John Hardy for the defendant. The only eogeery before the jury were whether Mrs. McKenna aud paid her fare, and if so how much damages was she entitled to for hor unlawful expulsion. ‘The jury gave her $150. An important decision was rendored yesterday by Sudge Spier, in the Superior Court, in the cake of Catharine Christal against the Mutual Life Insur- ance Company. The plaintiff petitioned for an in- wpection und copies of the books and papers of the company, for the purpose of preparing her com- B50 on two policies on her husband's lite for 5,000 = $6,000 each, and which she claims were from her, and wrongfully paid to her assignee. Then motion was denied on the ground that plamtitf already had information sufticient to frame her com- plant. and the company should not be put to need- iuconvenience and trouble. Edmon Blankman appeared for the plaintiff and Elliott F. Shepard, tor the insurance company. Asuit has just been begun in the Superior Court by James Kt. Adams, on behalf of Janette Halle, agaiust the Univers! Life Insurance Company, of this city, to fecover $2,000. The complainant states that on the 25th of June, 1875, Abraham Halle insured his lite in this company for $3,000 in favor of his wife, the con- sideration to the company being an annual payment of $101 61, On June 4, 1874, Halle died. His widow, in whose favor the policy was taken out, gave due notice and proof of deatli, but has failed to get any payment from the company. Alexander & Green, ‘counsel for the defence, make no denial of the allega- tions in the plaintiff's affidavit, but aver a “scaling” of fifty per cent of the policy, the validity of which proceeding is conte ed by the plaintiff, While James Bradley was attempting to pass over the track of the Second Avenue Railroad on the 18th of November, 1876, in order to gain the sidewalk near the corner of the Bowery and Grand street he was knocked over by the horses attached to one of the cars and go severely injured that he subsequently died. His widow, Mary Jane Bradley has brought a suit in the Court of Common Pleas against the com- pany to recover $5,000 damages on account of the ac- cident. The trial of the day before Judge J. F. Daly, Jommon Pleas, The plaintiff in her mpieint stutes that the deceased left a family of seven children and that his labors were their only means of support. The de- fence is contributory negligence. The case is still on, ‘The case of George C. Kussell, administrator on the estate of Victor D. Butler, against Samuel J. Clark and his daughter Louisa for the alleged wrongful cx version of the personal effects of Mr, Butler, was called betore the Surrogate’s Court yesterday after- noon. The District of Columbia, and First National Bank of New York et al., vs. ap- pellant, Abner C Shoemaker.—These two cases, which come by appeal from the Supreme Court for the District of Columbia, present the same questions, and, by stipulation of counsel and consent of the Court, are to be argued together. They in- volve the legality of certain tax assessments made for municipal improvements upon prop- erty on Seventh street West and Seventh strect road in the city of Washington. ‘They are the first of more than twenty similar cases to reach this Court, and are of great interest to the, people of the District, as well as to the First National Bank of New York, which is one of the largest holders of the tax certificates. The principal question involved— namely, the legality of these assessments—lies at the foundation of all the impro' ments made in_ this District during the past six years, and upon its decision depends the payment of nearly $2,000,000 of similar assessments which are as yet uncollected. The argument was commenced by A. G. Riddle for the District of Co- lumbia, Adjourned until to-morro’ it at twelve o’clock. FULTON FERRY. For the first time in eight years the racks and bridges of the Fulton ferry slips are undergoing ex- tensive repairs. ‘The Brooklyn side slips were re- ‘paired about a month ago at an expense of $3,000, and now the New York side, which was sadly in need of an overhauling, is being attended to. About ten men are engaged in tearing down the old racks alon; the Harlem boat pier and as many more are employ: in repairing the bridge. Several barge loads of rot- ten piles and old timbers are carried away every day. The iron plating on the front of the bridge has been torn off and new timbers are being put in to be covered with new plating. A floating spile- driver with @ gang of men is also kept busy driving spiles to replace the detective ones and hoisting timbers. The expense of repairing the racks on this side will be about $9,000, and that ot the bridges about $1,000, The work is to be completed as soon as possible, and after the other side of the slip has been finished the work of repair- ing the ferry house will be immediately commenced. The expense of all this will exceed $15,000, In consequence of the repairing but one slip on this side can be used and only three boats are run. Con- siderable delay is caused by this, one boat having to lie in the stream until the slip is cleared. At six o’clock last evening, when an unbroken line of people filed into the ferry house, the jam was fearful and an eae of the boats were crowded almost to suf- ‘ocation. REAL ESTATE.
