Woolston & Co., in September, 1872, desiring to get credit with H. B. Claflin & Co., of this city, the senior member of the former firm, F. A. Woolston, and his wife consented to execute to Claflin & Co. & mortgage on a farm in lows for $4,000, This mort- age was given as collateral security for any indebt- edness which might be due to Claflin & Co. by Wool ston & Co. and was accompanied by a note for the same amount having two years torun, In Novem- ber, 1874, Woolston received a summons in an equity suit for the foreclosure of the mort- gage, but wrote his son in New York to to see Claflin & Co, and stop the — suit. ‘The son asserts that he did see them, and that they account until January, 1875, at which time the father claims there was less than $900 due, About that time he had concluded a sale of his farm to John Jerola- men, but was suddenly confronted, through an lowa bank, with the morgage and note, the latter held by Austin Corbin, and on which there was claimed $2,900 as the balance due. Sullivan vs. Henry Frecking, to recover $1,242 90. The auit was brought to recover for aisigned counsel fees in two suits, which were fought on Frecking’s account from the courts of New York to the Court of Appeals and back. The defendant resisted the claim on the ground that it was excessive, and that the amount claimed in one of the suits ($500), for which this claim was a fee in part, had been lost through the fault of the assignor. Mr. Delafield appeared for the Society for the Prevention of Cruelty to Chil+ dren, and Mr. Robert E.
