Mr. Bliss on Monday addressed a ietter to Mayor Ely, in which he cited the foregoing judgment, and said that, having heard the May tended to nominate a candidate for the anéy yesterday, he wished to apprise him that h an ap- pointment, if confirmed, would be invalid. Mr, Bliss added that lie was susteined in his position by Corporation Counsel Whitney. He held that bis client (Mr. Stiner), having laid claim to the office, ‘there could not be four claimants for three offices. Messrs. Bliss and Stiner called yesterddy and found Mr. Merkle, to whom they recited the judgment of the court and made a forma! demand for the office, which was refused. Hence the legal pr proceedings. THE CO COUNTY CANVASS. THE CONTROVERSY BETWEEN MESSRS. HALL AND HATZEL IN THE EIGHTH DISTRICT—MANDAMUS PRQCEEDINGS BEFORE JUDGE LAWRENCE. ‘Whe quostion as to the result of the election for Al- derman in the Eighth Aldermanic district was the subject of a somewhat protracted and interesting a gnment before Judge Lawrence, in Supreme Court, Chambers, yesterday, on a motion to compel the Board of Canvassers to recanvass the yotes, the ac- casion drawing together numerous city politicians and others interested in this political controversy, It was claimed that in the Eleventh election district of the Eighth Assembly district George Hall, on the Tammany ticket, received 200 votes, and Jacob Lutzel, who was running on the same ticket, only reccived twenty-three. It is now charged’ that this is ® serious mistake, and that the truth is Hatzel received 93 votes and Hall 130, which would have resulted in that district in the election of Hat The clerical mistake, it is alleged by Hall, occurred in this manner :—In making np the count the clerks Were short of stationery and the returns were made up on a small piece of paper having 123 votes: to Hat- zel were given the second ad third tines, making his vote 93. BALL'S DEFENCE. It was argued on behalf of Mr. Hall by his coun- set that a mandamus should be grauted because the Board of Canvasecrs, in whom resided diseretion- ary powers, bad decided by vote of 14 to 1 not to go behind the’ returas. By these returns it was shown that Halt had received 200 votes to Hatzel’s 23. Under the Inw inspectors are not allowed to change the vote. Hatzel_ has no reason to complain, as a specimen bal- lot with his name on it is attached.’ If this mandamus was complicd with it would. stop the county canvaea, and to order a new election for a trifte would not be equitable. After further argument the Court took the papers, reserving decision, THE GRAND JUR ANNUAL. ‘Twelve members of the Grand Jury, including the foreman, yesterday visited Blackwell's Island. They conchided their “official visit’ with a bountiful lunch, provided at the public expense by the Com- | missioners of Charities and Correction. The Com- missioners, according to the usual annual custom, were highly complimented during the Innch by the jurymen on the excellent condition in which they found the public institutions. Commissioner Cox offered a toast to the Grend Jury's health, and the foreman offered a toast to the health of the Commis- sioners. Both toasts were drank enthusiastically. AN ACTRESS’ ATTEMPTED SUICIDE. Bertha Parks, twenty-five : years of age, an actress in the ballet “Les Papillons” in the Italian opers “Rigo- letto,” now being produced at the Academy of Music, and residing at No, G04 East Twelfth stroot, attempted suicide lest evening by taking opium at her reeidence Her husband, George Parks only left her for a short time, and when he returned he saw the pros. trate form of his wife upon the floor.
