NEW YORK HERALD SUNDAY, RAPID TRANSIT'S DEFENCE oo Ex-Judge Porler’s Speech in Behalf of the Metropolitan Elevated Railway. “THIS ROAD IS OUR PRIDE.” West Side Gromblers Have Their Final Say Before the Attorney General. The Attofney General listeacd again yesterday morning to complaints agatust the Metropolitan Ele- ated Railway, Before the proceedings opened be nnoanced that he must leave in the afternvon for Albany, and that the bearing would therefore bave to be greatly shortened, The attendance yesterday dwindled down to nothing as compared with the pre- wious day, and only tour property owners were pres- ent when the proceedings were opened. Mr. McDonald, who appeared in bebalfof McLean Shaw, the owner of one share of the New York Loan and Improvement Company, ana also of the property owners, made a longiby speech, asserting that Shaw Nad not bought bis one share las. July in order to @erve as the dummy complainant in this case, but in good faith, He claimed that by its violations of the law the Now York Loan ana Improvement Company had forfeited its charter and had ceased to exist, The Attorney Genorai—What, then, is 118 condition now? Mr. McDonald—Ii’s nothing, nothing at all It’s Absolutely dead, WHY BRING THE SUIT? The Attorney General—Then what is the use of my bringing this nuit against uf Mr. McDonald (after long hesitation and silence)— Woll, sir, 1 believe the Attorney General has to spread tho fucts on record~ that’s all. Ex-Judge Asnbel Green (dryly)—He wants a certifi- @ate of interment. (Luugbier). You will flud the Now York Loan and Improvement Company one of the hveliest corpses you ever cumo across. (Laugbter.) Mr. McDonald read trom the law books to show that the Attorney General bad often interfered against Moneyed corporations on account of irregularities, A STUNSING QUESTION. The Attorney General—Even couceding these de- fects as irregularities in the organization of the New York Loun and Improvement Company it is conceded (bat the organization bas since been perfectly com- pleted ; that the company bas gone into business; tnat stock is ali paid up; thatit bas expended a large amount of money; that its stockholders are all satis- fied, and that there are no creditors. Now can you show me any case iu which it has ever been held to be the duty of the Attorney General to intertere in order to wind up, in the midst of its business, @ sol- veut company? Mr. McDonuld—I have no such case in my brie! now. Mr. McDonald then went on to point out the duties of the Attorney General at great length, when the Attorney General courteously said theso matters Were pointed out by the statute already and it was Deediess to take up the time in this way. Mr. McDonald quoted from English authorities to show that the Attorney General of England was Vested with torial and a kind of inquisitorial Power to go through corporations’ and peopl fairs generally and see whether they did right or . Wrong. The Attorney General (calmly)—I don’t think that @octrine bas come across the water yet. “THE THREE CONSP/RATORS.” Mr. McDonald continued reading extenstvely from the law books to show that 1! three men (Garrison, Pullman apd Navarro), got up a conspiracy against the public thoy sbould be stopped and punished. The Attorney General (weartly)—Ob, of cours there is no doubt about it—no more than if thr burglars broke into a house, Mr. McDonald went on roading, while the Attorney General beld his head wearily between bis nunds, Mr. McDonald concluded with an urgent appeal, as toliows:—“We ask you to wipe out this thing con- 4 iu gin and born in iniquity.’? KX-JUDGE GREBN’S ARGUMENT, Ex-Judge Ashbel Green said that this was an effort on the part of men who wanted to collect their debts And damages to use the Attorney General for their private objects. 1t wi cohesion of public plunder, They asked the Attorney General to destroy this road, of, at least, to so discredit the means which had established 1 as to lead to Ms destruction. This bankrupt New England Iron Company wanted the Attorney General to help them collect a debt by threatening 10 break up the Now York Loan und Improvemout Company—a debt which bad siumbered for years and never bad ripeved into ajadgmout, What public rigut did these gentie- right be ty owners, pany, they woud not use the road was mort. gaged?
