43 10 WASHINGTON. . FROM OUR REGULAR CORRESPONDENT. Wasuixarox, Sept, 18, 1878. BANKING CAPITAL INVESTED IN UNITED STATES BONDS—IS THE PREMIUM PAID ON GOVERN= MENT SECURITIES FXEMPT FROM TAXA~ TION ?—2 QUESTION FOR THE COURTS, ‘It will be remembered that the Attorney General geverai weoks ago gave an opinion to the effoct that an reporting the ameuat of capital invested in United States bonds national banks and savings institu tons were entitied to roport only the par or face valuo of the bonds, The Jaw re+ quiring tho taxation of banking capital is separately executed by both the Commissioner of In- ternal Revenue and the United States Treasurer, the one collecting the monthly tax of one.twenty-fourth of one per cent and the other tbe eevera) semi-annual toxes. The latter bas held that only the face value of the United States bonds could be deducted, while the Commissioner has allowed the deduction of tbe actual amount invested, which, in many cases, included a igh premium paid for government securities, Tho Commissioner adheres to nis views, and the bunk- fng institutions are in a quandary as to what course to pursuc, If the opinion of the Attorney General 1s accepted as final then the Commissioner is bound to coliect from the banks the tax on all such premiums heretofore regarded as exempt, and, as tho period extends over ton or eteven years, tho aggre- gate amount of back tax must be very large. On the contrary, it the ruling of the office of the Commis- missioner is correct then the banking institutions © entitled to a refund of the taxes paid under tho United States Treasurer’s ruling, which, in the aggregate, must amount toa Jarge sow. Claim agents Dave been at work jor some time accumulating e1ses and presenting arguments in favor of a refund of the tax coliected on the amounts paid in excess of the pur value of the bonds, The opinion of tke At- torney General, it is believed, would be sustained in the United States courts, and for this reason there 13 now no desire on the part of the claimants jor refund to press theirs cases before the Treasury Department The language ot the law 1s, “fhe amount invosted in United States Donds.”” The wkole question is whether the govern- ment can take cognizance of tHe fact that a certain lass of its bonds are worth more than their face Value, and whether the premium 18 entitled to.be re- garded as a part of tte amount invested in United Btates bonds, The matter is likely to go to the ceurts for settlement, RESIGNATION OF SENOR ZAMACONA, THE MEXICAN MINISTER—HIS PROBABLE sSUC- CESSOR. : Notice has been received at the Mexican Logatton ‘of the acceptance by Presiaent Diaz of tbe resignation of Sefior Zamecova as Minister to the United States, The provabie successor of Sefior Zamacona, men- Uoned in recent advices trom Mexico—Gomez Yalacio—was at one time Chargé @’Affaires in Wash- ington, and also beld the office of Mexican Com- missioner hore about seven years ago. It is thought that Sefior Zamacopa will be made Minister of State upon bis return to Mexico next month, If so he will succeed Sefior Mata, whose health compels him to abandon the oold winter of the Mexican capital for ‘Ube more genial chmate of his home near the Guilt. THE NEW BARGE OF¥YICE—PROPOSITION OF THE CITY ACCEPTED. ‘The Supervising Architect of the Treasury to-day telegrapbed to Collector Merritt at New York that tno Secretary of the Treasury accepted the proposition of the city of New York In regard to tho eile for tne new barge office. NEW YORK HERALD. THURSDAY. SEPTEMBER 19, 1878,--TRIPLE SHEET. THE ALLEN-MOLLOY TRAGEDY. BESULTS OF DEPUTY CORONER CUSHMAN’S 4U- TOPSY—THE SHOOTING A UNIVERSAL TOPIC OF CONVERSATION—CORONER WOLTMAN TO HOLD AN INQUEST TO-DAY—'‘R0SY BROWN” MAKES ANOTHER &TATEMENT—ALLEN AND HIs WIFE. “The” Allen remained in a cell at the Fifteenth precinct police station yesterday, cool and clear headed, yet showing unmistakable signs of dejec- tion, His shooting of Edward Molloy, the private detective, was the one topic of conversation yesterday with ‘men about town.” Among ‘all those who referred to the subject in the presence of the Hrnanp reporter, not one opined that the Shooting was premedityted. Some thought it very remarkable that Allen should baye carried ao pistol on this particular day againet his cus- tom, and that the trigger should bavo been raised s0 unaccountably at the moment when Molloy was examining it, Yet evon they were conservative i their suspicions, and thought there would not bo suflicient evidence at the inquest to-day to hold Allen, As one experienced police officer expressed it, “If the killing wos not accidental it 1s the best put up crime on record.’? THE AUTOPSY. Deputy Coroner Cushman held an autopsy on the body of Molloy atecleven A. M. An external exami- nation revealed a pistol sbot wound io the inner angle of the right eye. On opening the skull the butlet was found to have passed through the orbital plate of frontal bone, traversing the night hemisphere of brain, its airection being backward and to the left to the posterior portion of the left hem- iephero of the brain. A flattened bullet was discoverod resting upon the inver portion of the ogcipitat bone Thero wss considerable extravasion of blood and laceration of brain substanco along the course of the wound, All the other organs were e: amined and found in a remarkably healthy condition, Death was caused by Jaceration of the brain and shock from the pistol shot wound tn tho head, There was nothing reveaied in the examination to invalidate the account of the occurrence ren- dered by Allen, Molloy’s body will be buried to-morrow, at ono P. M., 1» Calvary Cem- etery, Several persons called at Leeke’s, the undertaker in Carmino street, to inquire about the funeral arrangements and render assistance if necessary. Among them a woman who sald she knew Molloy in county Meath, Ircland. His father was a landed proprietor, bhe said, and “Eddie”? had no need to. zo from home, though it bad been wrongly stated thas he left to escape tha penaities of a petty tore forgery. Sbe said b came to America and in 1862 was tha hostler ot Colon’ Van Buren at Fortress Munroe, on Genera) Dix’s staff. ~Oo coming to New York the Colonel had no further need of bis services, and he was provided with employment asa govornment detective. This woman knew of no relatives of Molloy s in this coun- try, but Updertaker Leake said the funeral was in charge of a gentleman who pronounced himself a cousin of the deceased, bnt did not leave his name. PREPARING POR TUE INQUEST. The entire investigation of the homicide prelimi- pary to the inquest was left in the hands of Cap- tain Byrnes, of the Fificenth precinct, who, assisted by Detective Slevin and others, under- took to securo all possible evivei that might bear on the relations existing homicide between Allen and Molloy, Their efforts, ao far as learned, revealed nothing o! an important na- ture, At the request of Coroner Woltman Captain Byrnes subpoenaea nine persons to appear at the inquest, Most of these witnesses have simply to testify to having seen the two men In company on Monday night, Ibe only witness who will bo able to speak of the events im- mediat preceding the act is Andrew An- drow! sort ot employs at Allen’s gam- bling house. ‘To the Hxratp reporter yester- day Andrews sald that bis siatement to Coroner Woltman, already published, contained about all he kvew of the affair, When he heard the report of the pistol and ran te the rear room where Allen and Molloy had been sitting, the Jatter was sirerched upon the floer, whether dead or dying he did uot stop ‘to see. As Allen Jelt him at the door to find a doctor, he said to An- drews:—"Stay here by the door till i come buex, and lot ne one goup stairs,” The establishment at No. 615 Broad yesterday, having only been visited iective Ferris in the morning to see that everything was all right, Many of the habitués of the placo gath- ered ‘at the corner of Broadway and Houston street to look wistfully at the closely drawn shutters of their former bowor and express their sympathy with the unfortunate proprietor. It was learned on good authority that since the last police raid, about three months ogo, there has been scarcely’ “pust- ness’? at No. aoe the raid, is said, < sore timo ; Ted. .to procuro, a new fet of gaming ‘implementa, and when the machinery was once again in working order acnild of fortune won suflicient money to cripple the bank effectually. Several persons visited Allen at the station house, among whom were Walter Shupe and Carolan O’Brien Bryant. ROSY BROWN’S STORY. Among the witnexses to morning is Mre. Overin, or Btatement-to Coroner Wottman of the, relations be- tween dlolloy bie comment. She claims to have been on iotumate terms with Molloy and called at the undertakors, yosterday to seo the bowy, Some idie ramors the inquest this Were circulated to the eflect tnat Mra. Overin bad been spirited away by tho friends of Alien, who feared hor revelations at the inquest, Dot their absurdity was demonstrated by an interview with the woman herself, She claimed that she had lived with Ida Allen, The’s wife, gome thirteen years ego in a disreputable docal- ity, whero sue became acquainted witb ner nusband, Heury Overin, who now accuses her of bigamy. She wi introduced to Molloy, she sald, bya mutual irt and ber relations with him re purely of employer and employ. She assigned him detective work to perform and paid him for the services, She eaid ber husband’ and his friends, “The” Allon being among the latter, offered hergmoney to surrender her clatm upon her husband; but she refused, On Suo- day evoving, she said, she met Molloy at Eighth street and Broaaway and gave him some instructions which tbe wished him to follow and to report again on Monday evening. He did as directed, They separated at twelve o'clock, agreeing to meet again at elgnt o’clock Tuesday morn- ing. This appointment was kept, and at halt- past eight Molloy left her to meet again, according to Agreement, at the Court of General Sessions at eleven o'clock. She had no knowledge of uis intention to meet Allen, ALLEN’S DOMESTIC LPR. Since the shooting there bas been much scandal in circulation concerning the relationship between Mra, Allen and her hasbana. It was positively stated that Mrs, Allen separated from her husband recently on Molioy’s account. Last evening Mrs. Allen visited her imprisoned husband at the Filteenth precinct station house, and remained in close conversation with him for over three hours, The Hxnap reporter gained gecess to the meeting iu order to ask Mrs, Allen about the rumors concerning her. She was sitting outside her busband’s cell, the iron gate ed between, while dejection plainly itselt on both their countenances, questions of the she with ditfidence, yet firmly. Sh published rumors of domestic diflerenc house and had been ata loss to anderstand or to count for them. The writer quoted the statement that they had been separated recently on aceonnt of * Molloy, when Mrs. Alien replied with emphaste:— “False, false, every word of it is false, We have never been divided on account of Motioy or of any other man in the world.” “Thea your relationship with Mr. All been altered?” “in no way whatever.” “And you ve. bad your home with him during the Ww weeks 1”? ‘es, though business affairs may bave required my undivided attontion at tnterval “What wero Molloy’s exact reiations to yourseit and pusband?"’ “He bas been living with as for many years, and the association was never anplonsant,”? Here Mr. Allen indorsed bis wife’s remarks, adding that Molloy had been a favorite with them bot. “Had he lived with yoa during the past fow months??? asked the writ To this Mr, Alien repiied:. in our house aud think he possossed His clothes were there, and though he bi cupied hte room regul coming to the hou “Was be there on Monday night?” Mr. Alien—No; but he wee at the Broadway hou: from eleven o’ciock until nearly midmgnt, when he accompanied Billy Irving to a Jager beer saloon, and afterward took a Third avenue oar for up town. Both husbana aod wile then assured the writer again that their domestic relations had been 1 vo ‘ay impaired, and the interview terminated, The event bas ceased much comment in political circles, whore its effects upon Mr. Alien’s position aro considered. He many opponents loaders of the greenback-lavor party who, it is generally thought, dvaniage of his present difficuities to pscssbihes be ¢ his influence, SILV.: ER J LAKE HORROR, bas not NO CLEW YRT TO Tit IDENTITY OF THE BEAU} TIFUL VICTIM—DR, ROSEH'S ANTICIPATIONS DISAPPOINTED—NOT THE ELLEN MURPHY HE WAS LOOKING Fron. Coroner Dempsey, who is depending on the police for somo new developments in the mystery on which he has started an inquest, had received nothing yesterday to Warrant a continuance of the pro- ceedings. Tho police, though they claim to have been working very earnestiy, have nothing new to report, Ono of the many clews that are being worked up is that of the malt, or as at first reported salt, bag found in the barrot wits the bods, Many ofaim shat: Reigee who.d.gouy beo buss abert sime in Vat a 1s a brewer, may not be entirely ignorant of this malt bag, and though many suggestions have been thrown oUt .concerning the connection between the wo, DO effort has yet been made to prove it taken, DR, ROSH MISTAKEN. Dr. Kose, the gentleman who thought he could identify the body as that of Eilen Murpby, who baa been 19 his employ and who an im- portant witness in bis pending divorce eult against his wite, yesterday acknowledged to the Coroner that his anticipations Were disappointed, and he was satis- fied that the subject of the inquest was ,not tho woman he sought. He cniled at tue Coroner's office iv yesterday and having made the »ckoowieds- ment he started to New York to view the body an Ellen Murphy wao died in Bayard y, and whose body was placed in the Morgue for identification, In this mission he was as unsuccessful as he had veen in his Staten Istand on for about two hours after he lett the Isiand Coron Dempsey received tue following telegram New Yi The body at the Morgue here is not that of the Murphy Lam looking for. ir. ROSK. So ends what was carly regarded as an cadeanath clew. THE MAN WITH THR SILVER HAIR. The clew furnished by Ossip Hieman, the cress gatherer, 18 the most promising yet offered, andvil, as 18 hoped, the informant ts able to identity the old man, the mystery will be unravelled in short order, Mrs. Amelia Meyers, the midwite whose name has been counccted with this case, has not been ar- rested, though the police have ber under strict surveillance. This worthy pe has an old friend who answers, in ome particulars the m described by Hicman ak baving dug hole which the body was found. The police are now look- ing lor the friend of the dame, but ure silentas to how they succeeded, ELEGANT LINGERIE. A carotal examination of the chemise found around the corpse, made by a Hxnaup reporter yestorduy, proves that garment to be of tne fest fab- rication, The pleating on the front ot the gar- ment, which 1s of the finest jinen, has been done’ by band, ana this fact, taken 1m counrction with the aristocratic hands, fect and ears of the dead woman, indicate that sho came from a class high above the range of Elien Marphy. 1t bas beon already stated in these columns that deceased bore every trace | of high birth, and if anything were necessary to corroborate these natural indications, on which this ciaim was founded, it is now found in this chemise. There can be no doubt that the woman was taken {rom New York and buried on Staten Island, although the Corover, without giving any reason for bis conviction, declares that tbe body founa fs that of Hilen Murphy, the mistress of Ricge. The true clow to the mystery bas not yet been found, and when it ts and is pur- Sued to a conclusion many believe it will be found that the poor victim was not a servant but a carefutly purtured young lady. Even now, it 18 said, it may be known to some well connected persons who is this girl, but the fear of publicity deters theta from coming forward, In all probability Coroner Dempsey will continue his. inquest to-night, as two new and important wit- nekses witl be produced in the morning. The body of Ellen Murphy, who No. 80 Biyard streeton Tucsday morning. lies at the Morguy unclaimed by ber friends, Too idea brought out in yesterday’s HxRALD that the body might be that of Ellen Murphy woom Louts Riege was lookiag for has guived credeuce in. some quarters. Deputy Coroner Cushman held an‘examination of the bouy. TAKING THE BULL BY THE HORNS, A steer broke away from the herd in which it was being driven to the abattoir, atthe corner of Second avenue and Forty-second stroet, early last evening. Having run up and down the strcets it entered Isaac Dolman’s stables, in East Twenty-fourth street, but was driven out, Tho enraged animal was finally con- f the kightocath pre- cinct, who im the Graco- Roman wrestling match given by the Police Atbietic Cinb. The buil saw that ho had met bis match und offered no further resistance. The officer took it by the horns and threw it down, after whicn it’s throat was cut. OFFICER MEAGHER’S ASSAILANTS. Officer Meagher, of the Twenty-first precinot, while attempting to arrest ‘Red’ O'Donnell, on tho night of August 18, received a blow on the head froma heavy slupgsbot in the hands of O'Donnell. He was removed in ap insensible condition to Bell Hos- pital, and tor tour or fivo days bis life was despaired of. Tbree men, named Terence Clark, Edward Casey and Jobn tiurley, were arrested on a charge of aidin O'Donnell, who escaped. They were arraigned before Judge Duffy and committed at the timo to await the result of inguries, On Tuesday Officer Meagner was discharged irom the hospital, aud yesterday appeared and testified against the prisoners in the Tombs, They were all held in default of $1,000 bat! to answer at Spectral Sessions.
