BUSINESS TROUBLES. IMPORTANT DECISION RELATIVE TO THE CLAIMS Oy KEXSEB—THE RING PLUMBER'S OBED- ITORS—FAILUBES IN THE SILK TRADE, Register Dwight yesterday received the opinion of Judge Biatehford on several disputed points in rela- tion to the claims of a number of the creditors of John HL. Keyser, the Ring plumber, aining the register im every particular. The claims oft Johu Regan for $5,070 01; Frederick A. Palmer, $6,671 94; William Turton, $12,225 49; Frederick Michel, $3,462 50; James Graham, $3,077 50, and Wiliiam F. Hueston, $2,832 14, are rejected. It appears that they proved their claims before Charles Goelier, a notary public— who also appeared as ap attorney tor the bankrupt— and offered them for filing. Objection was made on the ground that Mr, Govller was, by reason of bis thus Sppearing, incapacitated to act assuch potary or to take such proofs of claims, and¢he question was sub- mitted whether such proof ought to be admitted, Register Dwight held that jt was pst the principlea of the Bankrupt law and against good custom to allow the attorney for the bankrupt to ap- Pear in apy other capacity in the proceedings, and that the proofs drawn by and sworn to before the duly recorced attorney for the bankrupt should not %e filed, Judge Blatebford concurs tn the conclusions of Register Dwight, writes that such proof of debts ought not to be filed, . ‘The other decision is relative to the claims of the bankrupts brother, William J. Keysor, for over $70,000, The latter offered his oa for proof prior to the voting for an assignee, and the admissien of such proof with the right to vote for the assignee was Dbjected to by counsel for one of the creditora on the following grounds:—That the claim was secured; that the body of the deposition for proof of the debt does not contain the name of the officer, nor the nature of the office held by the individual who took the deposition; that the depo. sition 18 subscribed and sworn to before a notary pub- lic who does not certify the proof is satisiactory to him; that the proof so offered contains an allegation that his claim was for money loaned. At un exumina- tion of the bankrupt he testified that the claim was Made up of a loun for $10,000 and the purchase by the bankrupt in 1862 of an interest of Mr. J, Koyser in the business for the sum of $38,000; that In this ex- |mination the bankrupt testified that be had paid bis brother $5,284, which is not deducted from : the ‘total amount of the claim; hat the wankrupt testified that bh brower held certain security which is not referred to in the proof of claim; that W. J. Keysor vor a 4 other witness was offered for aguinst the proof of aim or tol @ matter; that W. J. Keyser was alluwod to pro is claim and to vote for an assignee, aud bis determines the choice of arsigues ‘Register Dwight withheld the approval of the certificate of election until the opinion of tho Judge was obtained on the certificate, and submitted bis opinion that the Claimant is entitled to vote upon the proof in the amount to which be has not been secured, as appears Ba eptece, Judge Blatchiord sustains him in bis ruling. Secor VAILURRS OF SILK DEALERS, R Kennedy, wholesale silk dealer and turer of ribbons at No, 510 Broadway, and at Dass, bas been adjudicated an {uvolun- tary bankrupt on the petition of iour creditors, and matter has been referred to Register Dayton to take further proceedings. was generally known In the trade as *she Worcester Silk Company,” which the petition alleges hud no real or corporate existence, but was a name assumed by Kennedy without any au. shority for the purpose of carrying on bis individual busivess, Being a man of very good business address be readily obtained credit, and several of the creditors are euUrprised at the condition of his affairs. In submitting bis affairs to his creduors the Mabilities appeared to be upward of $30,000, with only $6,000 assets, the latter mainly in’ book accounts, ‘The great deficiency puzzied nis creditor: amounting to the extent of bis sales for six month: Soon aiter ho requested to take Lis books and accounts to Worces..r ou the plea of writing them ap, that be could live more economically there, and would be in a Position, by the assistauce of iriends, to make some offer for a setticment, His request was granted by the creditors, and ail his property was removed to Worcester, and since then all access to the books and pavers has been denied to the representatives of the creditors, As soon a8 ap assignee is chosen steps Wiil be taken to compe! hiw to deliver up The petition alleges that nearly ull bie indebtedness Was contracted 10 notes indorsed by him as agent ot the Worcester Silk git) credicors ure —Jobn |. There had been uw great deui of abuse in this matter aud the committee were deter- mained to stop this extravaqance, ‘They had desired the owners of the various buildinge to make reductions in their ront, but this bad not been done and the com- Mitiee did Lot feel authorized to tuke up a tive or ten lease at such exorbitant prices as bad been det my d, The troops did not care about removing from their old quarvers, ana the property owners seemed to think that the matter might *be adjusted.
