THE COURTS. Some Interesting Testimony in the Countess Heinruch Case, A LONG ACCOUNT. Important Question Relating to Trade Marks and Labels. ete! As old, older perhaps, than the language in which ! this is writien, is the proverb that “sbort accounts make long irieuds.* A forcible illustration of the truth of this proverb seems to be the case of the Coun- tess Heinruch, vow on trial beiore Judge Van Brant tm the Special Term|of the Supreme Court in this city, ‘The generalities of tue case, so tur a# generalities can e be gathered from the ploadings in @ lawsuit, have already very fully appeared in the HeRa.y; but the testimony, as it drops trom day vo day trom the lips of the witnesses, presents features ip business and social lite which ali people do uot “carry on wneir sieeves.’? As Dus been alreagy stated in the HekaLp, wwe late Dan Marley was 4 dealer in rare and old furniture, articles of ornament aud exceptional faucy, The Countess Hemruch seemed, os she tuys, to have had idews which ran in the eame groove with the Broauway deaior, Their business Cealings ran through years, and, if putin type, would fill volumes of uccounts So long and coniused were those accounts thas ihey have payed the way to litiga- ions as long abd Complicated us (bemseives. When this mortgage was lorecios tue house of the Countess was cleaned out of every stick of furniture, without excep- tion, A lew days alter the execuior of the jaw had fone his work SMurley arrived at the piace, He wus ustiered into the kitchen, said the witness, and was offered a Seat vu the Wastituy Dench or form, because that was the ouly seat in the house. “Have you some, Mr. Muariey,"? said the Countess (or Lady Heipruch, as te Wituegs staced 11), “10 gloat over the desolation you Dave wrougut?’ Marley was surprised, wept and Mouned over the desolaiiou, and asked we Countess to take a walk, so that tuey might talk tLever aione Bod di je some Way to repair the injury. “Lt Was uot my favil,'’ said Mariey, accord! pall iS} the (estimony. “1 had bad advisers, fone was done by the advice of Bariow.” “We 10K Mr. Marley vhrough the house,” contioued the same Witness, “ana suowed him the pailetol straw on whl we slept.” “On which who slept?” uskeu the cout tor thé defendant, **l'be Countess and ver servants,” kuswered Lhe Witness. The complainants were Marsh & Co,, and the defendants were George Warren and Alexander L. Fairweathe The complainants allege that they are the inventors of a Washing mixture, and that in connection with the sale pf said mixture they devised and used a tryde mark consisting of a woman, attired as women usually are when engaged in wash- ing clothes; and that in addicion to their trade mark, they composed and usod vy way of directions a certain mode and manner of using i, and in addition they used the words “shake well before using,” which they have duiy registered aud that the deten- dants are iniringing upon their directions, and their caution by using colorabie inttations thereof on their bottles, They also allege ibat Warren wag formerly in their empioy, avd walle thore acquired a means of manutacturiiy tueir mixture, and after leaving their employ entered into partnership with the other deiendant, and at once comme the man- Ulacture Of @ Huid Ol -substantially Lue same deserip- tion, which they have extensively sold to complain- ants’ customers to the damage of complainants $10,000, vad they bring this suit to recover said dam. ages and for an injunction to restrain Warren & Co, from Using On their botties the printed directions and caution as used on theirs, There i% no pretence tuat the tronuspiece or trade mark is simulated or pirated, Dut the complaint 1s that the label portion 1s a color. able imitadon of tue complaimants’ composition and misleads the public. Mr. Amos Broaduax appasred in support ol the motion nd argued that the label pore Hou Was protected under the Copyright act by the re. cent act of June 13, 1874, aud that the defendants ought to be enjuined. Mr. ‘Unaries Biandy represented the defendants and read the opposing anawer to tho bill and affidavits, denying all of the equities set forta in the bill, He argued on behalf of the detendents at length that the provisions of t.e Copyright act afforded ho civil remedy to the complainants; that tne only Statute of the Cuited States which in any Way gave a remedy to the compuinants, such as they now seek, the Trade Mark act passed 8th July, 1870, wnd that only aflorded aremedy for ao infringement of a trade mark, ond that « labei was not a trade mark, ap- less it contained some of the essential elements of a jrade mark,.and (hat the printed directions in question did not contain these elements as they contain 30 symbol or device or emblem oF Mark of Originality which asually goto make up wtrage mark, and thi ihe complainants have no more right to the exciusive ase of the langaage there set forth than they have to fegister a dictivuary and seck ite exciusive ase; und he further argued that, in case tne provisions of the Trade Mark act did not apply, thut then there was no statute of the United States which gave a remedy to tbe complainants, aud tue Court was without furisdic- diction ay a Court of Equity. masmucu as the complain. Avis And delendauts are residents of the same State, He farther argued that the Trade Mark uct was uncon. stitutional, as Congress ouly Lad the power to pass a law ju that regard to promote scicnce and ihe tine arts, and that there ts potning utifc oF arvistic in the fnvention of a trade mark, and expecially in this, Judge Blatchiord reyerved 15 decision on Lhe questions raised, Amos Broadnax appeared for the cumplaine anis and Messrs, Hall and Biandy tor the defendants, = PASSING COUNTERFEIT MONEY.
