NEW ° YORK HERALD, WEDNESDAY, APRIL UW, 1877. --TRIPLE SHEET. i PROTECTING THE ORPHAN. & DECISION OF THE GENERAL TERM OF THE SU~ PREME COURT WHICH WILL BEJOICE WIDOWS AND OKPHANS—NO COSTS TO BE ALLOWED TO PARTIES DEFEATED IN A WILL CONTEST. The General Term of the Supreme Court, presided over by Judge Davis, seem to be engaged tn a laudable endeavor to correct the various abuses of the law, some of which were referred to at length im the Hexatp of Sunday. The decision of the Goneral Term unanimously rebuking Judge Donohae for bis “unjustifiable” and ilegal action tp fining # debtor the amount of judgment and costs which bad been ob- tained against him, for contempt in refusing to an- Swer a question, and committing him to jail until he should bave paid this unprecedented fine, was a sadly needed warning to others of our judges, While thut decision was a weicome protection of the outraged rights of personal liberty an- otber is equally important in guarding orpbans and widows from the rapacity of lawyers who are ready to contest wills, » when they have no genuine case, and, \f they are defeated, feel sure of getting at least heavy counsel fees out of the estate, Judge Davis has just delivered an elaborate opinion, concurred in by Jadges Brady and Daaiels, deciding that the Surrogate cannot allow costs to the defeated party in a will con- test, THR OLJECT OF THE DECISION, This decision is meant to break up a practice, or, rather, malpractice, which has been goiug on for years, and robbed many a poor Widow and beiple: orphan of the best portion of their inheritance for the Denefit of some speculative lawyer. In the present Anatance the amount of costs involved is only $3,000 out of an estate of about $100,000; but it 1s the prin- ciple which is of importance, and not the accidental amount in any case. The present case arose put of the contest over the will of Eliza Hearsey. The Surrogate found against the contestants, the Chiidren's Aid Society and St, Luke’s Home, but al lowed their counsel, Messrs. D. R, Jaques and H, 1, Clinton, $3,000 for tees and disbursements. The exec- utors of the will, which wag admitted to probate, up- pealed to the General Term trom that part of the Sur. rogate’s decision making the allowance, and the latter bas now been reversed, go that the lawyers in ques- Mon have to go without their foes and are not even ro- \mbursed for tneir actual expenses. They have, how- ever, appealed from this decision annulling thei allowances to the Court of Appeals, whose final adj’ cation of the question will, of course, be looked forw: to with unusual {nterest by, the legal {raternity, A! ones by numerous quotations from laws and pre that such allowances to defeated parties were ahh contemplated by the statute, Judge Davis pro- ceeds in his opinion as follows :— JUDGK DAVIS’ OPINION, We think, therefore, that the Surrogate has no power under the act “of 1870 to make ailowances to parties who do vot ‘‘prevail’’ 1p cases cuptested before him, He may excuse such parties, If the case be in his judgment @ proper one, from the payment of costs personally; but be cannot take the subject matier of the contest which he adjudyes to beloug to the success- arty and distribute it oF y partot it among his led antugouisty, A cousiruction which permits that to be done hostile to the spirit of our laws, which tn cases of established testacy requires estates to be divided according to the will of the testator, aud iu cuses of intestacy according to the stature al dis- tributions, It is also against public policy, for tt vir- tually offers a brive to reckless contestants and their counsel to prevent the settlement of esiaies by Promoting litigation wand engendering strife, wheo tor tbeir every interest ot the public calls speedy adjustment. It might abuses to the injury of the widows the creditors of deceased person: should be sedulous to protect. It would be @ bazard- ous expert t fora wealthy man to attempt to dis- Pose ol his estate by bis own will if it could be distrib- uted the mere will of the Surrogate among the counsel of all who choose to set up whatever pre- tence of contest tho ingenuity of avarice can devise, We do not mean by these suggestions to indicate wnat the will in this case was impruperly contested, but on the contrary we think the contestants had probablo Cause to resist the probate of the wil propounded and Lbat their contest was in all respects tairly conducted, and for that reason we have excused them trom costs im all th peals. With considering the several other questions presented by the appeal, some of which are fatal to a large portion of the allowance, we think it our duty to reverse the parts of the order appealed from, but without costs. THX WISTORY OF THE WILL, The above decision will revive the interest attaching to the case outs of which it arose, and which is also ere dtey the Court of Appeals. Eliza Hearsey, ‘an old lady ot halve g efle at No. 40 Chariton street, died on February 3, leaving an estaie valued at about $100,000. Twor ml is were found, one executed on July 11, 1874—only soven months belere ber death—which ieft her property to @ niece in wh ‘ Misa Noyes, and the family of James Loveridge, who Fe ruary 8, 1872, provided for Miss Noyes also but in a smaiier degree, left the Loveridges out in the cold entirely, and left a large portion of her estate to the Children’s Aid Society and St Luke's Home, The last named societics contested the will through their counsel, Messrs. D. R. Jaques and H. L. Clinton, on the ground of undue tniluence exercised by Miss Noyes and the Loveridge family.
