NEW WITNESS. bability of Proving an Alibi in the Convict’s Favor. ener ' [BT TELZORAPH TO THE HERALD. 1 Bosrox, April 6, 1877, Ove of those events in real life which abourdsin thrilling details and circumstances rarely found in the ‘most startling of romances, was developed in this city to-day, and just in the ‘nick of time’ to savo & possibly innocent man trom the pain and disgrace of a death on the scaffold. A man has ap- peared here who thinks he can prove an alibi in tho case of Joba P. Phair, convicted forthe marder of Sirs. #raze, and though the man wus to lave been hung to- @ay Governor Fairbanks at once ordered him to be foprioved till May 4. ‘THE CRIME REVIEWED. ‘The bistory of the crimo with which Phair is chat ‘as follows:—— On Tuesday morning, June 9, 1874, about half-past seven o'clock, the house occupied by Mrs, Anuic Fretze, a dissoluto woman, on Forrest street, was dis- covered to be on fire in the second story, in the room occupied by her as a siceping room. Ina few moments the flames burned through the floor, and the scorched and mutilated trunk of a hu- man body came falling turough. Ao examination was made, when, to the horror of all present, a huge ‘wound was found, extending from ear to ear, com- pletely severing the lurnyx, and four stab wounds in the right side of the neck, three of which struck tne vertebra, while the fourth passed bebind ahd severed the muscles in tne back part of the neck, The lungs showed that death en- sued before suffocation could have taken place, It was thought, very naturally, that robbers had com- mitted the horrible crime, asthe woman was known to bave money, jewelry and some valuable clothing in ber rooms, which were missing. PHAIR'S PLIGHT. Suspicion was directed to one Jobn Y. Phair, who ‘was at that time in the employ of Manefield & Stin- fon, machinists, at Rutland, and who was known to have beeo a frequent visitor at her house; also having been seen in ber company publicly in the stregts. On the Saturday be- fore, the 6th, he accompanied her to Barnum’s circus gnd alterwards went bome with her, He was not at his boarding house after Sunday, the until Tuesday morning, tho 9h, when Jef Rutiand on the 4:30 A. M. train for Boston {rom the Berwick House, and arrived there in tbe afternoon and registered bis name as “E, F. Smith,” St. Albans, Vt He then went to a broker named Abraham and pawned a lady's wateh and chain for $35, giving his Dame and residence the same as at the Bote, He stayea at the Adams House that might and next day pawned to one Pierce an opera glass, shaw! and rings, one of which westorn from ber finger. In a closet of the room he ocoupied at the hotel was found a half shawl, which he had evidently forgotten, ana which was identified | as one which Mrs Freize owned and wore, HIS ARREST. He left Boaton on the evening train of June 10, ‘which was duo at Rutland on the morning of the 11tb, and at Cuttingsville, a few miles from Rutland, he was arrested and taken to jai. At the examination ho was proved to be the person who Fogistered the name of E. F. Smith, and also bythe brokers as the one who pawned the watch and other articles, THE TRIAL FOR MCRDER. In the September following he was tried at the County Court at Rutiand: (Judge H HH. Wheeler presiding), and was ably defended William G. Veazey. The jury, after a deliberation, rendered a verdict’ of “Guilty of murder in the first degree. Exceptions were by bis counsel, and February 4, 1875, case came beiore the Supreme Court, and mew trial was denied. Phair was present in court and listened with close attention to the reading of the decision which swept — his lust hope of a nm tral and bis doom, preserving the same cool soem he bas exbibited all througn the trial He was then sentenced by Judge Pierpoint to bo hange April 6, 187 between the hours of one and four o'clock P. M. An effort was recently made for a reprieve, which the Goveruor could not find sufficient reason for granting. PHAIR’S STATEMENT. This was publisbed in the papers of this city this moruing, and fouod thousands of eager readers. Awong these was M. D. Downing, of the Novelty Manulacturing Company, No, 50 School street. A VALUABLE MEMORANDUM, After reading the statement, Mr. Downing jumped out of bis chur and exciaimed, ‘My God! they have got the wrong man! This man is innocent!” His words and excited manner astonished bis associates, und as soon as lie became culm he stated that be went to Providence on the morning of June 10, 187 and returned upon a train which left Providence forenoon and reached Boston about noon on that jay. His memorandum book was reterred to at once and the time was found to be correct. On that train zoming to Boston he met and talked with a man whom te firmly belioved to be Phair, und, on reading the sbove statement of Phairs, he saw bow slink he might possibly supply. Yesterday was the heaviest day of the book trade sale at Clinton Hall. 1t was opened with Worcester’s ictionarics from J. B, Lippincott & Co., each edition of which was largely duplicated, The Webster's, trom G. & C. Merriam followed, There were no duplicates in this lot, but the original number was very large. There were 69 unabridged, 1,000 primary, 600 common school, 200 high school and 250 copies of other editions, McDermott’s globes followed, and sold weil, Then came Harper & Brothers, with their large Invoices , | 2 the catalogue There were a number of duplicates in this lot The tibrary of select novels, numbering 470 volumes, was withdrawn {rom auction and offered ‘ata hideral discount at long credit to be sold at prival sale, Tae Abbott books opened Harpers’ invoices, aud sold remarkably well. One hundred and twenty of narlotie Broute’s novels were sold, 23 sets of George Ehot’s novels, ip six volumes; 56 volumes of Charles Noranoil’s works, 100 of ‘Tennyson’ 's complete works. Will Carleton’s Poems were all largely duplicated; 132 copies were sold; 300 of the new Half Hour series. The publications of the World Publishing House were next sold, but not at high prices, These included 87 Chattervox Junior, a large oumber of the World editions of standard authors, in 75 volumes; 60 copies of the Centennial, United States, und 50 of Youatt on the Horse. Heary Holt & Co. sold among other works 20 copies ke u pe od Anthology, 20 of the Milton Anthology, 20 at 77 volum of the well known Leisure Hour jes, inciuding the works of the iamous Russian novelist, Tourgnénofl, and of Hardy, Mrs, Alexander, Droz, Aterbach, The dore Winthrop, Mra, Jenkin, Bjorosen, &c.; 10 sets of six volumes of Holt’s Library of Poetry, 10 sets of Mill’s works, of Taino’s works (also on Holt’s list), bis Fistory of English Literature was the favorite; 17 of three volumes beimg taken; but 10 sets ‘aine’s works, in 13 volumes, were also sold, ates & Lauriat found takers for 100 copies of the very popular Sidome, Among their sales were 10 each of 10 volames of Epocbs of Modern History, and 10 each of 8 volumes of Ancient History. About three weeks ago smallpox broke out in the private school kept by the Sistory of Mercy, corner of Willoughby and Classon avenues, Brooklyn. The Bourd of Health held a special meeting yesterday, at which they considered the subject in detail aud arrived at the conclusion that it would be necessary to take extraordinary measures ip order to stump out the threatened epidemic in that section of the city. Accordingly they appointed four physicians us vaccinators to go from house to house to vaccinate such persous as have not been vaccinated in the past seven years, Of those who were recently ttacked by the ‘disease all with the exception of two or three who had the facilities for being 1solated at their homes were removed to the County Hospital. Mr. Opdyke, pastor of the Bethel Methodist church, at Tottenville, was arrested yesterday by Constable Goggin, on a warrant issued by Justice Garrett, of Stapleton, charged with conspiracy.
