A PASTOR’S PREDICAMENT. | diction HE MCAYFREY CASE—BOTH SIDES OF THE STORY TOLD-—A LIVELY TIME IN COURT. ‘The caso of Mrs Leavitt against the Rov. D. M. Me- Cafirey, of the Church of Vur Saviour, was again before Judge Smith, at the Fifty-soventh street Court, yester- day morning. The court room was completely filled ‘with the triends of the accused and of the complainant, ‘There were at lcast one hundred and fiity people pres- ent, most of them of the congregation over which the Rev, Mr. MoCaffroy has presided. Mr. Natnan Nesbit appeared for the defendant, Judge Smith held the examination ina private room. dir. McUaflrey put in an appearance carly and seomed quite desirous of hav- ing the matter fully investigated. An unusual number ot reporters were on hand, anxious to get she full pal Biculars of the caso, They sharpeued their pencils in vain, for the caso was adjourved till Monday, ‘The fol. lowing were the proceedings :— Judge Smith—As this case isan important and ou- cious one, I deem it proper that a stenographer should be appointed to write down whut is said. On several occasions | befriended ber, and pot only her but her husband and a poor woman friend named Mrs, Bennett. Later on Mrs, Leavitt, through asking my ¥, Decame attached to our chureh choir. We wero to have a concert on April 4th, and sho was desirous of taking part in it. I received several visits from Mrs, Leavitt and Mrs, Bennett, and visited them twice, ‘once tinding them ont, and’ on the occasion of my sec: ond visit meeting with the husband and Mrs. Bennett. Mr, Leavitt locked me ina room, and then I becumo subject to his vilest abuse. Yesterday morning, during Mr. and Mrs, Leavitt's absonce, two women of Mr. McCaffrey’s congregation catled at their rooms and began intimidating Mrs. Bennett and Mra. He was in Montclair afterward, and had some difficulty with the bishop of the parish. He was a ircquent drinker, and leit New Jersey in consequence of discontent ex: pressed against lim by the people of his place. Jostin disappeared after bis exit, and his whereabouts were unknown until he turned up in the Yorxville court on the charge of Bridget Carr, who says she bas a child by bim three weeks oid. Joslin at the time denied any knowleage of such a person as Bridget Carr. Sbe, bowever, said he haa offered to settie the case and sho had retused, It would seem there was gome truth in the girl's statement. THE RING SUITS. Mr. Townsend eaid to our reportor that be was doing all he could to effect his client’s re- lease, but that no offers had yet been defi. nitely accepted by the prosecution, Ihe nego- tations were. still pending, but no papers had been drawn up, as has been stated. The prob- avility was, however, that a settlement would be effected and that Tweed would be released. This need not necessarily imply the discharge of Tweed, as tno Proceedings 1n his case might be similar to those in the case of Woodward, who, on paying a part of the judg- meot against him, was merely released on his own re- cognizance, and the judgment sull held over nim. It $s vertain that persistent efforts are being made by counsel toward a compromise of tho suits against Tweed and Sweeny, and if a definite offer on the part of Tweed is mado by his counsel looking toward a com- prom will most likely be consiaered, Last evening « HgRaLD reporter called upon Mr Wheoier H. Peckham, at his residence, to ascertain, it possible, how much of truth there was In tho current rumors regarding the compromise. Mr, Peckbam said that nothing had been decided, that no definite offer | bad been made to him, and therelore he was unable to gay What Mr. Tweed’s counsel would be willing to give ‘hs a basis of Immunity from the further prosecution of | the suits.
