De a RMT TT Te ee TR Te eRe eer ee TRON eRe SRMMRMN Ne. ROR nee ere ‘ RAPID TRANSIT. [CONTINUED FROM EIGHTH PAGE.] ples boldly with the constitutional questions, but with the Court itself. The judges in General Term, avers, decided that was not before them, He declares that the constitutional questions were never argued, aot, therefore, ought not vo have Leena passed uj goes so far us to tell the Court that both Chi Daly and Judge Rovinson acted only upon an assump- tion, ‘These judges, he says, determined that the company was without corporate authority, except in a limited degree, because none had been shown in a case where it was pot at issue, [t 18 for this reason that he DOW seeks to reopen the whole case and to bring the whole chain of title before the Court, It is upon this point that the interest and importance of litigation depend, for upon its determination {x involved not only the question of rapid transit on the west side, bat the very existence of the Klevated Railroad. The Patten injunction may pro: reaching in its conse- quences, for, if the action is successfal, it may tur out that a petty tavern in Greenwich street will defet the whole scheme of rapid trangit, The further bear- {ug of the cage was adjourned until Monday morning. Shoulders were put to the wheel this morning, with the result of shoving up the most prominent stocks from % to 1¢ per cent, but the effort soon gave out, and, there being no sympathizing Jupiter ready at hand to give a sup- plementary lift, prices fell back and closed weak and ut the lowest point of the day. The volume of transactions was as meagre as prices were feeble, amounting to only about half the number scored yesterday, of which one-third was to the credit of Western Union. Bulls im this stock who have been bellowing promises of higher figures scem to bave become out of breath to- day, and, acting as though they had lively recollec- tions of the route to Jordan, with the obstacles to rapid transit which it is popularly supposed must be encoun- tered by the waytfarer, gave up late m the afternoon all attempts to surmount the acclivity of higher tigures and sank by the roadside exhausted, It 1s by no means certain that pebbles were not placed in the shoes of tho pil- grims, by one Jay Gould, inthe shape ef fresh sales of short stock, or through a scattering of long shares by the brief-winded upholders of the fancy. At any rate the weakness of the new favorite quickly spread to Lake Shore and Michigan Central, wiich yielded in ® moderate way, and thence to the entire hist with like effect. For rapidity and extent of fluctuations, how- over, Ilinois Central proved to be the pea in the shovel. The fact that the books wiil close on Satur. day created a brisk demand for cash stock, to the vex- ation of the shorts, who had to supply’ themselves at borrowing rate, which ranged from % to % per cent for a single day’s use, while the price of the Stock itself skipped up to 65 at the very opening of | business, This quotation failed to hold, however, against an assault from ‘“(aderland’’—which was simply a con- tinuation of the movement made a few days since—- and it as quickly receded to 6234, with final transac- tons at 63, The closeness of the cash stock, and the general difli- culty of borrowing from day to day, as we have pefore remarked, caused an evolution of seller 30 options, which were placed at 2 per cent below the regular price, There wasa further tumble of nearly one point tn the ‘St. Paul preferred stock, due to the unfavoravle present and future prospects of the roud’s business, and the chance of a spring dividend, which is growing small by degrees and beautifully less, ‘Tho call by the Treasury for another $10,000,000, five- twenty bonds, for account of the Syndicate which has Ube placing of the 43¢ per cents in charge, making $60,000,000 in ail, 1s looked upon as a bright spot in thy aation’s credit, under the circumstances of a po- tical nature which exist both at home and abroad, and promises well for a successful floating of a mate- rial portion of the loan, The entire proceedings of the session were as dull as aroaring farce played by amateurs, which in fact the day’e business Was, for the professional performers failed to put in appeurance, except in the case above alluded to, ‘THE SALBS TO-DAY.
