A CASE OY INTEREST TO PROPERTY OWNERS MEFORX 4 WILLIAMSDULG JUSTICE—A CLEVER 2OGUK, A case came up before Justice Eliott, of Williams burg, yesterday, which will attract general attention tm real estate circles when tried, as showing the case ‘with which swindles can be accomplished tn real ea tate transactions, Family differences are at the bot- tom of the case and will no doubt add to the public interest in the matter, One Fred. A. Conkling or Conklin, arrested on a ebarge of tuserting in au assignment of mortguge the ‘words “I guarantee the above umount to said Conk- ling,”? was arraigned, and after an investigation was committed to uwait the action of the Grand Jury, the evidence tending to convict him of forgery and of ob- taining $3,000 from tue complainant under faise pre- fences, ‘The fall history of the case is as follows:—Frederick Augustus Conkling, a long time resident of Norwich, Coun., and lieutenavt colonel of the Eighth Counec- ticut National Guard, whose headquarters are in that | town, thought to better his fortune in Now York, Ho therefore came here with some little means and estab- lished a real estate office in Nassau street, the business Deing conducted under the name of Conkling & Uo., & sou of Mr. William H. Foulks, of Groenpoit, being hired as clerk. After some time the offce was ro- moved to Third avenue, aud there Conkling bud Fotlks, Jr., arrested on a charge of larceny, At the examination of tho charges against the young man it ‘was shown by the testimony that there was a peculiar Manner of transacting business ingbe oitice, and in consequence of Foulks’ discovering it ne was given permission to «raw what money he desired, but help- ing himselt too freely Conkling had him arrested, Soou after a nolle prosequi was eatered by the District Attorney and no further steps were liken against young Fouiks. The matter opened the eyes oi the oulks family, however, aud subsequent developments ‘led to the arrest tor iorgery. Cummings, of No. 320 Bust Filty-second street, made his uc Qguaintance und had some business trunsuctiops with him, Conkling held a house im this city, and exchanged it for mortgages made by one ‘John Melntyre on houses and lots im Buyonne, XN. Atter nis return from Europe Conkling iniormed Cumrnings that Melutyre could not pay the interest, he being at that time in jail for some criminal offence. By Cummings’ aavico he again saw Melutyre, who pleaded tnavility to do apyting in consequence of his incarcerauon, but proposed to dced the property tree apd clear to’ Commuings to bulapce his indebteaness, ‘This was quickly accepted by Conkling, who drew up all the papers, und, aga nowry, took Mclutyre’s ac- Kuowledgement. He then calied on Cummings und re- ported Wiiat had been done, but said, uiso, that be wd ivund back interest and back taxes au to muke a deticieney on the previous contract of 3 or $700. The negotiations im settlement resul: the payment of $600 and ihe conveying of the prop- erty to Conkling by Cummings, thus cancelling the mortyage aud the assignment. Mr. Fouiks knew of Mr, Curmmings and of his Telability, and on the strength of tue guarantee and Conkting’S representations paid nim $3,000 for the Worthless assiguinent. On this occasion Mr. Cummings was communicated With, and, answering in person, he atonce pronounced the paper a forgery, as the assignment was cancelled by wis couveying all the property involved in the mortgage. He has been foremost in Sunday school werk and all charitable enterprises. Thorburn’s irends attribute his course to inganity induced by tn. toxication, but the community believe there has been too much method in his madness. These events pro- duce great depression and excitement bere, Ibe firm of T. J. Gates & Co, was always regurded as flourishing abd subsiantial until about a year ago when they com- menced the exportation of flour to South America, in which they were unsuccessful, und to that source is ba ibuted their financial emburrassment und possible ruin, CONFKSSION AND COMMITTAL, Bagby was brought before the Mayor this aftrenoon, The evidence showed that Bagby first brought the deticit to the notice of the bank. Frank L.
