On August 4, 1876, Cornelius Donovan kept a news- paper stand at the corner of Vatbarine street and East Broadway, where he did a very good business, selling tho daily and weekly papers, aud among the latter publications was the Boys and Girls’ Weekly. On the moraing of the date in question, while Don- ovan was at his stand, then about eleven o’clock, the defendant in tho suit, Lewis H. Ostendorf, came up and, seeing a numbor of the Boys and Girls’ Weekly on the plaintill’s stand, at onco claimed that they were Nolen and demanded how they came to be on his Stand and im hiy possession, Pluinttif asked what Tight he bad to put such a question to him, whereupon the deiendant represented uimsell to be tbe agent of tue American News Company. The company itsel! was Made codeendants with Ostendort!, but on motion vl counsel, that no general agency was established, Judge Alker, betore whom the case was ied 1m the Marine Court, dismixsed the complaint ag Ayuinst the Company, the action then turning on the charge of false iaprisonment against the defendant ingividaally, The evidence turther showed that Ox Wwndoril procured the arrost of the plaintiff, and on the pul.cenau who made the arrest demanding upon whut uutbority tue arrest was asked for, he again rep- Fesenied bimeeil as the agent of tho News Company jd showed 4 badge im support of his representation. je uleo cluined that twenty-two copies of the Boys and Giris’ Weekiy were stolen trom, and were the property of the American News Company. At the Washington place Police Court yesterday Har- rison Hamilton, varnisher, of No. 51 Crosby street, and Peter Ward, clerk, of No, 406 West Fourtcenth street, were held in $500 bail each by Justice Kesmire for keeping policy shops at No, 198 Wooster street aud No. $70 West Kightceuth street. Mary Bennett, ulias Burns, was eld for trial on a charge of stealing a gold watch and chain, diamond ring and $200 in money from John Smith, a merchant of Galveston, Toxas, while the latter wus drunk im the saloon No. 130 West Twenty-sixth street, SANE OR INSANE. Yesterday a weak, pale woman who carried in her arms a young baby was arraigned in the Kings County Court of Sessions, before Judge Moore, to answer the charge of arson in the first degree, the punishment of which crime, in the event of conviction, is ten years’ imprisonment, The name of the prisoner is Louisa Williams, She is about thirty-four years of age, the wile of an insurance watchman of this city, and is the mother of four children. She was, taken into custody ona warrant issued by Fire Marshal Keady about a Month ago for setting fire to tenement house No, 40 Maujer street, Eastern District, in the mid- die of the night. ‘The house, which ts of frame, was set on fire in three places, There wero three families in the structure at the time, and but for the timely discovery of the flaines « calamity involv. ing loss of buman life migbthave occurred, After her arrest she confessed the deed, The property, which belongs to her husband, is iully insured. There ap- pears to be doubt, woll grounded, as to the sanity of the poor creature, and, on motion of her counsel, a commission of medical experts on the subject of in- sanity was appointed by the Court to examine into her mental conditicn before placing her on trial upon the indictinent pending against her. NORMAL COLLEGE GIRLS’ HUMOR. The young ladies of the Alpha Beta Gamma Socicty of the Normal College gave yesterday, in tho chapel of the college, a literary entertainment to sevoral hun- dred friends and iuvited guests, Among the visitors were President Hood and members of the Board of Education. The chair was filled by a very interesting young lady, with a grace worthy of a mother in gotham, but her modesty led herto give the cue to the young Jades on the plattorm and Wl efforts to procure her mame were un- availing. The stand and columns surmounting the platiorm were taste! festooned with ivy, and a large bouquet of flowers occupiea a prominent place. The exercises were opened by a march vy Miss Ella Calkins. Miss Minnie Ferrero followed in an amusing recitation, Miss Lilhe B. Cohen gave a very enter- taining reading from **Nine hours’ experience by four pean ladies at the Centennia:,’’ A piano duet, by Miss Emma Klauser and Miss L. C. Pettingill, was greatly admired—the young jadies displaying excelient musical Rvts and delicacy of vouch, Miss Mary H. Marcus and Miss Helena L. Davis gave a new version of tho trial scene between Bratus and Cassius, throwing into it much humor and some very taughable hits. One of these ladies gave evidence of rare dramatic power and elocutionary training. Most laughable, in- deed, was a mock debate, ‘Who Wrote Shake- speare?”’ in which Misses N. G. Cone, L, C. Pettingell, Adelaide Duff and Currie G. Roberts were the clever disputants. They all acquitted themselves most happily, but Miss Duff's description of Casibianca’s birth and subsequent life until be became 4 Ware rior—King of the Sandwich Islands—and of wielding the spear 80 successlully won the t) Shakespeaie, was very entertaining. Miss Roborte, altnough the youngest of the quartette, was quite originut and witty in her address, The proceedings clos.d by an eonntens trom the incognite president “REAL ESTATE. flied and an order isasked for may be granted ny of the de. | ‘The following sales were effected at the Real Estate Exchange yesterday :— Srott & Myera sold, by order of the Supreme Court in foreclosure, W. W. 3B, DUNCAN'S TINUED—HE EXPLAINS SOME OF HIS TELE- GRAMS TO HIS FATHER, The examination of Mr. Williara Butler Duncan tn the bankruptey proceedings went on before Kegister Ketehum, at the Bennett Building, yesterday, Mr, EF. T. Brown, counsel for E.G, Haight, the creditor op- posing Mr, Duncan's discharge, conducting tho exami- Bation, and Mr. T. N. Bangs appearing as Mr, Dun- can’s counsel. Before the questioning began Mr. Duncan said:— “I desire to make anasddition to my answer given on the 27th of October to the question, ‘In your cablegram what did you mean by saying ‘nobody sus- pects; confidence unimpairedt’’ | intended to say that our credit was so unaffected that there would be qifficulty in our continuing our business in- dettuitely by baving recourse to the ordinary sources of credit at our disposal, but I preferred to obtain what I considered requisite means irom a source to which | could and did explain the true situa- ‘ion of our affairs and for a definite amount and re- payable at a distant period of time, But to explain more fully the meaning of those words I would ark you to put im the various telegrams which were infor- | mally read at the time that this telegram—the basis of this question—was put in evidence,” The examination wus thon proceeded with as fol- lows:— “On Saturday morning, July 24, did you or your firm make any transfer of storehouse receipts?” “I think not on that date; we did, I think, on the 23d of July, deliver to Andrew Low certain receipts for merchandise which we held previously tor his account; these receipts were for cotton and hemp, were inclosed in a letter addressed to him, and delivered to his agent, Mr, James H, Falconer, and appropriated 4,000 bales of cotton and 6,000 bales of hemp, valued between $400,000 and $500,000; I do Rot recollect that we made aby other transfer about that time; this cotton was stored in Various store- houses 11 New York city, whose names ldo not recollect; the transfers were made in accordance with the understanding with Mr. Low that he shouid have the security at his disposition, and we considered nat we were doing that in the fulliiment of this under- standing; Mr. Low was in Europe at the time.”’ “Jn your telegram to your tatber of July 23, you ‘assets counted good really worthless,’ Please state of what theso assets consisted 7°’ “I cannot state specifically; but, probably, debit Dalances due to the firm, I think, m general terms, those ure what I reterred to. They might bave been soine bonds or stocks which wero represented by the books at cost, which, on closer examination, were found by me to be too highly valued at that ume. furnished all the information found in the schedule flied in the State or bankruptcy proceedings, 1 can give no more information than they contained,” “One of the telegrams in evidence reads:—‘Ir Bar- ings knew of bank credit secured by bank building, might they not object to 260 additional, makiny 400 total.’ What is meant by ‘bank credit secured by bank building?” ‘The telegram referred to was from Mr. Alexander L, Duncan to witness, under date of July 26. “My brother, kbowing that his credit by the bank referred to, was the credit of £150,000 granted by the Union Bank of London—knowing that it was granted under the guarantee ot my father, and that my father held sceurity consisting of certain parts of the assets of Duncan, Sherman & Uo., viz—Deeas of property in St. Louis, Chicago. Fourteenth street, this sity, and sundry bonds and mortgages, which securities were deposited with his agent im this country, undoubtedly thought and meant to express that Barmys might ob- Ject to giving 250 additional, A subsequent telegram in reply thereto tells him frankly to speak to Bariugs. The bank credit referred to is the credit of £150,000, granted by the Union Bank to my firm under the guarantee to them of my father. To comply with the requirements of the bank, he agreed with them to eg subject to their control, in case of need 18 property known or spoken of asthe ‘bank build- ion His (Alexander Duncan’s) agreement with my firm was that beiore using or availing himself of this credit we should place, trom our assets, security with his agent. Ot courso that security did not include the bank building, for we didn’t own 18 and it did not form a part of our assets. ’ “Then what is tTeant by ‘secured by bank building’ in that despa “[ mean that the Union Bank was secured. I mean that Alexander Duncan secured the Union Bunk on the bank butlding.”? ‘sHow did he secure them ?’” “He agreed to hoid it for their security for this £150,000 or any part of it remaining due. ”? Tnis credit of £150,000, was any part of it used, and were any bills drawn against 11 and paid by the Union Bank at the time of your suspension ¢”” “None were accepted, but £30,000 were running.” “Then, as I understand you, this guarantee of £150,000 was not used by the Union Bank ¥" “There was no responsibility on my father’s part that was outstanding under that guarautee.’? “That despatch als says, ‘Shall I mention to-mor- row or privately to-night?’ Was the transier of thin bank building kept private?”? “Certainly not I don’t know the meaning of that expression; that is my brother's despatch. ’” “Phen what did you mean in answering to that despatch, ‘Speak frankly to Barings!” “[ meant what it said, in piain English.” “Then you intended by that despatch to answer the portion of it which says ‘mention tt p tely to night”? 1nsinuated Mr. Brown. “Did LY” quietly inquired Mr. Duncan, “Did you answer that portion of the despatch, ‘Mention to-morrow or privately to-night?’ ’’ “+L answered the despatch as inquiring whether he was to tell Barings by telluig him to do so trankly. I had nothing to do with suggesting whether be was to do so publicly or privately. ’” “Did you answer that despatch which contained an fon you say you did not kuow the meaning aid.”” in the despatch to your father you say, ‘I repeat your personal interest sufe?’? What did you mean vy that?” “He had other personal interests than those in any ‘way conoccted with my firm, where the mteres: was simply a matter of account, and it was in reference to those other personal interests that I used that expres- hat do you mean by ‘where the interest was simply a matter of account’ in your last answer?” Pi in that the oniy business between Mr. Duncan and myself or my tirm was jccount with my firm, and apy charge: }hat account which may result irom uarantee under that letter of credit. ’? Vhat is meant by the expression ‘Fay can’t help bere,’ in one of the despatches ¥'? sked, 1 suppose, by the bank to renew his guarantee to thom 11 they would accepy the wh on the credit, which they declined to ac- se 14 Was presented after our suspension. Mr. Duncan undoubtedly meant from the context, where he says that he cannot direct the bank to accept (with- out asking security lodged), to refer to the security lodged with Fay for th rity of that credit and in uswng the words, ‘ay can’t holp here,’ to express that jae Sonciocly aid economically, the words costing $1 apiece by cable.” A GE.
