we z THE COURTS. | sis| | The Appeals in the Tweed Million Suit. Conclusion of the Argument Before the Supreme Court, General Term. , ———— Revival of the Crooked Whis- key Litigations. | PROPESSED ANXIETY FOR A SPEEDY TRIAL Se Before the Supreme Court, General Term, there was aturther argument yesterday on the appeals taken in the Tweed $6,000,000 sult. In supplementary pots submitted ny Mr. Dualey Field it was insistcd that the prosecuting counsel tuiled to keep good faith in regard to the stipulation to try the $6,000,000 suit »y the Jury erapanelied in tue $1,000,000 suit. He stated that bhe second, like the former suit, alleges a conepiracy between Tweed and Watson to defraud, but the war- Fants in that case are city warrants, while in thia case they are county warrents. A stipulation was hurriedly prepared for the plaintiffs’ ccunsel and signed, and the plaintiffs subsequently elected to try the $4,000,000 Suit. This port of the plaintiffs counsel, be insisted, Involved a breach of faith, The defendant's covnsel were compelled by sevore illness in the family of ono of them to ask tor an adjournment of the trial fora tew days, a request which no Christian or gentieman could ouject to, and no Court could retuse. ‘Was made to persuade the Court this adjournment, the plaintifle’ counsel extorted from the defendunt’s counsel an abandonment of their chent’s rights. Mr. Peckbam went into an extended relutation of she bree, “at that there was po proo! of conspiracy be ‘weed, Woodwaia and others of the so-called “Ring.” He then gave a history of tne formation of the Ring, of the manner in which the stolen money was divided, and contended st 1. that the evi- deuce of conspiracy was plain and incontrovet je. de eonciuded the argument, and the Court took “the papers. As at the previous argument, Mr. Charte: O’Conor was present and listcned attentively to the oppusing counsel, although taking bo part besides oc- casional suggestions to Mcssry, Peckham and Carter, his associato prosecuting counsel. ‘The price of the Herad to-day and henceforth will be three cents, Tomar THE CROOKED WHISKEY SUITS. One of the long pending Whiskey Ring cuses was yesterday called ap in the United States Circuit Court; before Judge Benedict, who presides over tho crimiual branch of the Court for the present term. There are several persons under indictment for alleged violations vf the revenue law, and »t the inception of the prose- ution it was supposed that the government officials had unearthed a series of systematic frauds in this city 8 gigantic as those which made the St. Lous Whiskey Ring sults 60 notorious, Time, however, or subsequent investigation into these alleged frauds has _ considerably damped the zeal with which the prosecutors and theit witnesses went bolore the Grana Jury and objained in- dictments against a number of woolesale deal@rs mm this cit, nd who Were subsequeatly arraigned and held to bail in large amounts, Among the wholesale liquor dealers indicted at the time on a charge of dealing in crooked whiskey were W. S. Miller & Co., aguinst whom wore found jour indictments, These purties have from time to time endeavored to bring on a trial, but the District Attorney was not prepared, or the time of the judges was so preoccupied, that It was not till yewterday tueir case was brought beiore Judge Benedict. Even then, however, the prosecution was at fault, and Messrs. Miller & Co.'s counsel formally moved that nis chents be discharged upon ther own fecognigunce, their case naviug been uiready stricken wT the calendar by the District Attoruey. Coun- bl stated to the Covrt that he had called upon the District Attorney a number of times to obtain Wwiormation that bad been promised him, but that je had always been put off with excuses. lhe de- bendunts were indicted last May; they have never put im a dilatory plea ora plea in abatement; they de- manded & speody trial and tney could not get it. Their buximess haa suffered materially, and they were spoken of throughout the West as the compamions of Babcock apa other suspectca persons. The Iistrict Attorney bad inquisitorial powers given to him to examine the books and papers of the firm, and he took only oue book and failed to revurp that. At the conclusion of the counsel rgument une of the defendants said that he would like to say afew words, but the Court suggested to bim that the plea of tounsel was suilicient. Assistant District Atiorney Foster said that he regrotied that the delendant should be obliged to suller under the imputation fora longer periog, but he must object to the motion, as the As- wstant District Altorney bad not been gality of neglect, bhis being the frat time the case was un the calenvar, He was willing, however, thut the bail should by re- duced one-half, The Court took the papers. There is no guod reason why he should be deprived of the fruits of his superior dengeace because he proceeded as a defendant on this action, It would be inequitable at this late day to question the justice of the order, and it would be con- Urary to setuied principles, The motion must there- fore be denied.
